Please read these Terms of Use ("Terms") carefully before using the

"LocaPing GPS Tracker" mobile application (the "App"). By

downloading, installing, or using the App, you agree to be bound by

these Terms. If you do not agree, do not use the App.

1. DESCRIPTION OF SERVICE

The App lets a group of users (a "Circle") share their real-time

GPS location with each other, define Safe Zones with arrival/leave

notifications, exchange messages within the Circle, and review their

own location history kept locally on their device. The App is

intended for use between consenting family members or close

contacts who have voluntarily joined the same Circle by sharing a

6-character invitation code.

2. ELIGIBILITY

2.1 You must be at least 13 years old to use the App. Users between

13 and 17 must have permission from a parent or legal guardian.

2.2 You are responsible for complying with all local laws regarding

the sharing of location data, especially when adding minors or

other dependents to a Circle.

2.3 The App is not intended for surveillance, stalking, or any

monitoring of a person without their knowledge and consent.

Such use is strictly prohibited and may violate local law.

3. YOUR ACCOUNT AND CIRCLE

3.1 The App creates an anonymous identifier for your device on first

launch. You are not required to provide a real name, email, or

phone number.

3.2 The 6-character Circle code grants any holder the ability to

join your Circle and view shared data. Treat the code as a

password — do not post it publicly.

3.3 The user who creates a Circle is the initial "Owner" and may

remove other members. Ownership can be transferred to another

member before leaving the Circle.

3.4 You are solely responsible for who you invite to your Circle and

for the consequences of granting them access to your location.

4. USER CONDUCT

You agree NOT to use the App to:

(a) Track any person without their explicit knowledge and consent;

(b) Harass, intimidate, stalk, or harm any individual;

(d) Spoof or falsify your GPS position to deceive other members

(the App may flag suspected mock locations);

(e) Transmit unlawful, threatening, defamatory, obscene, or

otherwise objectionable content through the in-app chat;

(f) Attempt to reverse-engineer, decompile, or interfere with the

App's operation, security, or other users' data;

(g) Use the App in violation of applicable laws or regulations,

including those relating to children's privacy and consent.

5. LOCATION SHARING

5.1 The App requires permission to access your location. You may

revoke this permission at any time in iOS Settings; doing so

will disable most features.

5.2 The App may continue to collect location data in the background

if you grant "Always" permission. The App will indicate

background usage as required by iOS.

5.3 Location data is shared with members of your Circle in real

time. We do not sell your location to third parties.

5.4 You may stop sharing your location at any time using the

in-app toggle, by leaving the Circle, or by uninstalling the

App.

6. SUBSCRIPTIONS, IN-APP PURCHASES, AND ADS

6.1 The App may offer optional in-app purchases ("Premium") that

unlock additional features such as extended location history,

additional Safe Zones, removal of ads.

6.2 Subscriptions automatically renew at the end of each billing

period unless cancelled at least 24 hours before the renewal

date. You can manage and cancel subscriptions in Settings →

Apple ID → Subscriptions on your device.

6.3 Payment is charged to your Apple ID. Refunds are handled by

Apple under their refund policy.

6.4 The free version of the App may display advertisements. With

your consent under App Tracking Transparency, we may share a

limited advertising identifier with our ad partners (AdMob,

Adjust) for measurement and personalisation. You can change

this choice at any time in iOS Settings.

7. INTELLECTUAL PROPERTY

7.1 The App, its source code, design, trademarks, and content

(excluding user-generated content) are owned by EXO Studio and

protected by copyright, trademark, and other laws.

7.2 You retain ownership of the content you submit (chat messages,

avatars, Place names). By submitting such content, you grant

EXO Studio a worldwide, non-exclusive, royalty-free licence to

store and transmit it as necessary to provide the Service.

7.3 You may not copy, modify, distribute, or create derivative

works of the App or its content except as expressly permitted.

8. PRIVACY

Your use of the App is also governed by our Privacy Policy:

By using the App, you consent to the collection and use of your

information as described in the Privacy Policy.

9. THIRD-PARTY SERVICES

The App uses the following third-party services. Their terms and

privacy policies apply to data shared with them:

• Firebase (Google) — Authentication, Realtime Database, Crashlytics

• Apple MapKit — map tiles, routing, geocoding

• Apple StoreKit — in-app purchases

• AdMob (Google) — advertising (free version)

• Adjust — attribution and analytics (with your ATT consent)

10. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES

OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF

MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND

NON-INFRINGEMENT.

EXO Studio does NOT guarantee that:

(a) GPS data displayed in the App is accurate, complete, or

up-to-date;

(b) The App will be uninterrupted, error-free, or secure;

be delivered reliably or in a timely manner.

The App is NOT a substitute for emergency services. Always call

local emergency services (112, 911, 113, etc.) in case of a real

emergency. Do not rely on the App as your sole means of safety

monitoring.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXO STUDIO AND ITS

AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE

FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE

DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER

INTANGIBLE LOSSES, ARISING FROM:

(a) Your access to or use of, or inability to access or use,

the App;

(b) Any conduct or content of any third party on the App;

(d) Any other matter related to the App.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM SHALL NOT

EXCEED THE AMOUNT YOU HAVE PAID FOR THE APP, OR US $20, WHICHEVER

IS GREATER.

12. INDEMNIFICATION

You agree to indemnify and hold harmless EXO Studio from any

claim, damage, loss, liability, cost, or expense (including

reasonable attorneys' fees) arising out of:

(a) Your use of the App;

(b) Your violation of these Terms;

or intellectual property rights;

(d) Any content you submit through the App.

13. TERMINATION

13.1 You may stop using the App at any time by uninstalling it from

your device and/or by tapping "Delete account" in the Profile

screen, which wipes local data and removes you from any

active Circle.

13.2 EXO Studio may suspend or terminate your access to the App at

its sole discretion, without notice, for any breach of these

Terms.

13.3 Sections 7, 8, 10, 11, 12, and 14 survive termination.

14. GOVERNING LAW

These Terms are governed by the laws of the Socialist Republic of

Vietnam, without regard to its conflict-of-laws provisions. Any

dispute arising out of or related to these Terms shall be subject

to the exclusive jurisdiction of the competent courts located in

Vietnam, unless a mandatory consumer-protection law of your

country of residence requires otherwise.

15. CHANGES TO THESE TERMS

We may modify these Terms from time to time. The "Last updated"

date at the top reflects the most recent revision. We will inform

users of material changes through an in-app notice or via the

contact email associated with the Apple ID. Continued use of the

App after such changes constitutes your acceptance of the revised

Terms.
