Platform/Service: The Agora-x mobile and/or web application and any related interfaces, websites, and services.
User/you: Any individual or entity accessing or using the Platform.
Advertiser: A User who posts an ad.
Content/Ad: Any text, images, tags, locations, and descriptions submitted by a User for publication.
Paid Features: Optional promotional tools for ads (e.g., highlight, banner, prioritization) accessible after balance top-up.
2. Acceptance of Terms; Permitted Use
By accessing or using the Platform, you agree to be bound by this document, which includes our Terms of Service, Privacy Policy, and Content Policy. If you do not agree, do not use the Platform. You agree to use the Platform only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations.
3. Nature of the Service; Relationship of the Parties
Agora-x is a listing-only classifieds platform. We are not a marketplace, broker, dealer, payment processor, escrow agent, or insurer.
We are not a party to any sale, purchase, delivery, warranty, or other transaction between Users.
We do not guarantee the quality, safety, legality, authenticity, fitness for purpose, or availability of any goods or services advertised.
Any communications, payments, or agreements occur directly between Users outside the Platform and at their sole risk.
We may provide tools or links to facilitate User-to-User contact only, without assuming any obligation or liability for outcomes.
4. Accounts, Verification, and Legal Age
You must be 18 years of age or older (or the higher age of majority in your jurisdiction).
We may require an email address and verification via code. We do not collect device type for identification purposes.
You must provide accurate, current information and not impersonate any person or entity.
We may suspend or terminate accounts for suspected violations, fraud, or misuse.
5. User-Generated Content (UGC) and License to Display
You retain all rights in your Content. By submitting Content for publication, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, display, distribute, and promote the Content on the Platform and in related marketing channels for the duration of the listing and for a reasonable period thereafter for archival, evidentiary, and operational purposes.
You represent and warrant that you own or have obtained all rights and permissions necessary for your Content and that it does not infringe any third-party rights.
6. Content Policy; Prohibited Goods and Services
You shall not post Content that is illegal, misleading, fraudulent, abusive, hateful, harassing, defamatory, obscene, or that infringes intellectual property, privacy, or data-protection rights. Non-exhaustive prohibitions and restrictions include:
Firearms, ammunition, explosives; controlled substances; prescription drugs; adult content/pornography; pirated/counterfeit materials; unlicensed gambling; personal data of others; unlawful fundraising; illegal services; impersonation and identity fraud.
Items requiring special licensing or documentation (e.g., certain medical devices) may be restricted or prohibited depending on the jurisdiction.
We reserve the right to review, moderate, restrict, or remove Content at our discretion and/or where legally required, without refund or compensation.
7. Moderation; Removal; Freezing
We may use automated and human review.
We may hide or remove Content or suspend/terminate accounts, temporarily or permanently, for violations, security concerns, or legal obligations.
We may report unlawful activity to competent authorities when required by law.
8. Paid Features; Balance Top-Up; Taxes; Refunds
The only in-app financial activity is balance top-up to access Paid Features for ad promotion.
Payments are processed via app stores and/or licensed payment processors. We do not store payment card data.
Pricing, taxes, and fees may vary by country, currency, and store policies.
Refunds: Subject to the rules of the platform through which the purchase was made (e.g., Google Play / Apple App Store) and mandatory local consumer laws. Where permitted by law, digital services may be non-refundable once consumption begins.
Abuse, fraud, or evasion related to Paid Features may result in account actions.
9. No Warranties; Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR ABSOLUTE SECURITY.
10. Limitation of Liability; Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOSS OF DATA; OR DAMAGES ARISING FROM USER-TO-USER TRANSACTIONS, EVEN IF ADVISED OF THE POSSIBILITY. WHERE LIABILITY CANNOT BE EXCLUDED, IT SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your Content or use of the Service, (b) your breach of this document or applicable law, or (c) your violation of third-party rights.
11. Regional Compliance; App-Store Requirements
EU/EEA/UK: Compliance with consumer-protection, advertising, and privacy laws (GDPR/UK GDPR).
United States: Compliance with federal and state laws, including CCPA/CPRA where applicable.
Brazil (LGPD), Canada (PIPEDA), Australia, Singapore (PDPA), South Africa (POPIA), India (DPDP), Gulf jurisdictions (e.g., UAE, KSA, Qatar), and others: Compliance with applicable local privacy and content rules.
Compliance with Google Play and Apple App Store policies regarding content, payments, and refunds.
12. Intellectual Property Policy; Notice and Takedown (DMCA or Equivalent)
We respect intellectual property rights. If you believe Content infringes your rights, submit a written notice including: identification of the protected work, the allegedly infringing material (URL or sufficient detail), your contact information, a good-faith statement, and your signature. We will review and may remove the material or request further information. Counter-notices may be available where permitted by law.
13. Privacy and Data Protection
13.1 Data We Collect (Data Minimization)
Account Data: Email address; name (optional); password stored as a hashed/cryptographically protected value (never in plain text); country/language; verification status. We do not collect device type for identification.
Ad Data: Text, images, city, category, tags, and contact details you choose to publish.
Usage/Technical Logs: Basic logs such as IP address, timestamps, and crash reports necessary for security, abuse prevention, and operation.
Payments (Top-Up): We do not store card details. We receive limited billing metadata from the payment processor (e.g., success status, amount, currency, transaction identifier, timestamp).
Location (Optional): Approximate location for nearby results, only with your consent and controllable in settings.
13.2 Purposes of Processing
Operating accounts and verification; providing and improving the Service; moderation and abuse/fraud prevention; security and incident response; service and security notifications; compliance with legal obligations (e.g., taxes, lawful requests); analytics using aggregated or de-identified data where feasible.
13.3 Legal Bases (Where Applicable: GDPR/UK GDPR)
Performance of a contract; legitimate interests (security, fraud prevention, service improvement) balanced against user rights; consent (e.g., non-essential cookies, location, marketing); legal obligation.
13.4 Sharing and Disclosure
Service Providers/Processors: Hosting, storage, email/notification, basic analytics, fraud prevention, and payments; bound by confidentiality, security, and purpose limitation.
Authorities/Compliance: Disclosures as required by law or to protect rights, users, or the public.
We do not “sell” personal data as defined under CPRA; if practices change, we will provide a clear opt-out mechanism.
13.5 International Transfers
Data may be processed outside your country. Where required (e.g., GDPR), we use appropriate transfer mechanisms (e.g., Standard Contractual Clauses, adequacy decisions, or transfer impact assessments).
We retain data only as long as necessary for the purposes described, then delete or anonymize it. Examples include tax-required billing records and reasonable security/abuse logs.
We implement reasonable technical and organizational measures, including encryption in transit, password hashing/cryptographic protection at rest, access controls, and monitoring. No method is 100% secure; we will notify as legally required in the event of a breach affecting you.
EU/EEA/UK (GDPR/UK GDPR): Access, rectification, erasure, restriction, objection, data portability, and withdrawal of consent.
United States (CCPA/CPRA): Rights to access, delete, and opt out of “sale”/“sharing” where applicable.
Brazil (LGPD), Canada (PIPEDA), Australia, Singapore (PDPA), South Africa (POPIA), India (DPDP), Gulf jurisdictions, and others: Local rights including access, correction, deletion, and objection, where applicable.

The Service is intended for adults (18+). We do not knowingly collect data from children. If we become aware of such collection, we will delete it in accordance with applicable laws (e.g., COPPA in the U.S.).
13.10 Cookies and Permissions
Strictly Necessary: Session and security.
Analytics/Performance/Marketing: Used only with consent where required and can be withdrawn.
Manage permissions through device/app settings or our in-app controls.
13.11 Third-Party Services and Links
The Platform may contain links to third-party services we do not control. Review their policies before providing data.
14. Governing Law; Dispute Resolution
Mandatory, non-waivable consumer-protection rules in the user’s country of residence shall be honored. Subject to that, disputes shall be resolved by {{binding arbitration / courts of {{Primary Jurisdiction}}}} under {{arbitration institution and rules, if any}}, with any statutory rights to opt-out preserved where applicable. Claims that cannot be subjected to arbitration under local consumer law are excluded.
15. Severability; No Waiver; Assignment
If any provision is held invalid, the remaining provisions remain in effect. Failure to enforce any provision is not a waiver. We may assign or transfer our rights and obligations as permitted by law. You may not assign without our prior written consent unless mandatory law permits otherwise.
16. Changes; Notices; Versioning
We may update this document. We will provide clear in-app or website notice with an effective date. Continued use after the effective date constitutes acceptance where permitted by law. We maintain archived versions for evidentiary purposes.
