1. INTRODUCTION

These Terms and Conditions (“Terms”) govern your access to and use of the PettyWorx mobile application, website, and related digital services (“Platform”).

PettyWorx (Pty) Ltd (“PettyWorx”, “we”, “us”, “our”) operates a digital marketplace that connects clients with independent third-party service providers for household, business, and on-demand services.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. PLATFORM ROLE AND DISCLAIMER

PettyWorx is not a service provider. We do not perform services and do not employ service providers.

All service providers listed on the Platform operate as independent contractors. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between PettyWorx, clients, or service providers.

PettyWorx’s role is limited to facilitating introductions, bookings, communication, and payment processing through the Platform.

3. USER ACCOUNTS

You must be at least 18 years old to use the Platform.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

PettyWorx may suspend or terminate accounts that violate these Terms or applicable law.

4. BOOKINGS AND PAYMENTS

All bookings must be made through the Platform.

Payments must be completed via the Platform unless expressly permitted otherwise.

PettyWorx may charge platform fees, commissions, or subscription fees, which will be disclosed before payment.

5. LIMITATION OF LIABILITY

To the fullest extent permitted by law, PettyWorx shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, revenue, data, or business opportunity.

PettyWorx’s total aggregate liability for any claim arising from the Platform shall not exceed the total amount paid by you to PettyWorx in the six (6) months preceding the event giving rise to the claim.

PettyWorx is not liable for any loss, damage, injury, or delay arising from:

• acts or omissions of service providers;

• reliance on profiles, ratings, reviews, or advertisements;

• disputes or transactions between users and service providers.

Use of the Platform is at your own risk.

6. THIRD-PARTY SERVICE PROVIDERS

Service providers are independent contractors and are solely responsible for the services they provide.

PettyWorx does not guarantee service quality, outcomes, or suitability and does not supervise service delivery.

You expressly release PettyWorx from all liability arising from services performed by third-party service providers.

7. SATISFACTION RESOLUTION (PLATFORM CREDIT)

PettyWorx may, at its sole discretion, issue platform credit for future bookings where a complaint is submitted within 72 hours of service completion.

Credits are non-transferable, non-refundable, and do not constitute an admission of liability.

8. INSURANCE AND RISK

Clients are responsible for maintaining appropriate insurance for their property and ensuring a safe working environment.

Unless expressly stated, PettyWorx does not provide insurance cover.

9. NON-DISCRIMINATION

Users may not engage in unlawful discrimination on any protected ground under South African law when using the Platform.

10. CONSUMER PROTECTION ACT

Nothing in these Terms limits rights afforded under the Consumer Protection Act 68 of 2008.

11. DISPUTE RESOLUTION

Parties agree to attempt informal resolution for at least 30 days before instituting formal proceedings, except where urgent relief is required.

PettyWorx may elect arbitration in South Africa where appropriate.

12. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa.

13. BREACH AND ENFORCEMENT

PettyWorx may suspend or terminate access for breach of these Terms or applicable law.

14. GENERAL

If any provision is held unenforceable, the remainder remains in force.

Failure to enforce any provision does not constitute waiver.

These Terms constitute the entire agreement between you and PettyWorx.

SERVICE-SPECIFIC TERMS (SCHEDULES)

Schedule A: Dog Walking

PettyWorx is not liable for actions or behaviour of animals during services.

Dog owners remain fully responsible for their animals, including injury, damage, or incidents.

Booking Cover does not apply unless expressly stated.

Schedule B: Child & Family Assistance

A responsible adult must be present on the premises during the service.

Service providers are not specialised caregivers and do not provide medical or special-needs care.

PettyWorx assumes no liability for incidents arising during such services.

Schedule C: Elder Support Services

Services are non-medical and do not include nursing or clinical care.

Clients remain responsible for medical decisions and emergency contacts.

PettyWorx is not liable for outcomes arising from elder support services.

Schedule D: Placement & Introduction Services

PettyWorx provides introduction and referral services only.

Final hiring decisions and employment compliance remain the responsibility of the client.

Placement fees are non-refundable, subject to replacement guarantees where offered.

Schedule E: Subscription Services

Subscription services provide administrative and platform tools only.

PettyWorx is not responsible for employment compliance or labour law obligations.

By using the Platform, you confirm that you have read, understood, and agreed to these Terms and Conditions.

Full name, identity number or passport number, date of birth, photograph, qualifications, employment history, and verification documents (for Service Providers).

Contact Information
Mobile number, email address, residential or service address, location, country, and other contact details you provide.

Payment details, transaction history, billing information, and bank account details for Service Provider payouts (processed via secure third-party payment providers).

Platform Usage and Technical Information
Device information, IP address, operating system, browser type, app version, usage data, booking history, log data, geolocation data (where enabled), and interaction with Platform features.

Communications and Support Information
In-platform messages, emails, customer support communications, feedback, reviews, and ratings.

Marketing and Behavioural Information
Preferences, responses to promotions or surveys, cookie data, and records of marketing consent or opt-out decisions.

Not all personal information is mandatory. However, failure to provide certain information may limit your ability to access or use parts of the Platform.

We may also generate anonymised or aggregated data for analytics, reporting, and improvement of the Platform.

Platform Management and Improvement

improving functionality, performance, and user experience;
conducting analytics, research, and reporting;
developing new features and services;
ensuring Platform safety and integrity.

Relationship Management

communicating service-related notifications and updates;
providing customer support;
responding to queries and feedback;
notifying users of changes or interruptions to the Platform.

Marketing

sending promotional communications where consent has been provided;
managing opt-in and opt-out preferences.

DISCLOSURE OF PERSONAL INFORMATION

PettyWorx does not sell personal information.

Within PettyWorx

With employees, contractors, and affiliates who require access to perform Platform-related functions.

Quality Standards

We set clear expectations for how jobs should be handled.

Service providers who fail to meet standards may be suspended or removed.
