Executive Order 13950: Combating Race and Sex Stereotyping (EO1395O) was signed on September 22, 2020, and it goes into full effect sixty days later, on November 21. In response to EO13950, many institutions have preemptively suspended diversity training. Examples include the University of Iowa, Sandia Labs, Lawrence Berkeley National Laboratory, and Department of Defense. The order negatively impacts all members of the American Physical Society (APS), regardless of institutional affiliation. Some institutions are under active investigation by the Department of Labor, which has been collecting information about noncompliant trainings since the order was first signed.
Although Joe Biden and Kamala Harris won the 2020 presidential election, inauguration is still months away (January 20, 2021), and the executive order will remain in effect until it is rescinded. Between now and then, the executive branch has the opportunity to do broad and lasting damage to diversity efforts in physics and beyond. For example, as described in a recent Venable webinar, if an organization is disbarred from receiving federal funds due to EO13950 before January 20th, the disbarment may persist for years whether or not the order is rescinded by President Elect Biden. Thus, there is an urgent need for action now.
We recognize that the American Physical Society joined other professional organizations in co-signing a letter to the Executive Office of the President calling for EO13950 to be rescinded. In addition to this important step, we are calling on APS to engage in additional forms of response until the executive order is rescinded:
Initiate, join, or write an amicus brief in support of a lawsuit opposing EO13950. Existing lawsuits include one filed by NAACP Legal Defense Fund, National Urban League, and the National Fair Housing Alliance and another by Ropes & Gray and Lambda Legal.
Lobby or advocate for the Biden-Harris transition team to rescind EO13950 on January 20, 2021, and to permanently delete or seal all records of submissions to the hotline, emails, and other avenues through which the US Department of Labor is currently collecting information about noncompliance with the order.
Pay APS-affiliated diversity trainers—especially independent contractors—to update their training to be in compliance with EO13950, or to compensate the costs of contracts, agreements, or offers that were canceled due to the order.
Launch a grassroots advocacy campaign for APS members to protect individuals and institutions from EO13950, similar to what the society has been doing in response to other executive orders or legislation that negatively impact the physics community.
The undersigned call on the American Physical Society (APS) to take further action against Executive Order 13950, as described in this petition. Signatories include APS members, physicists and physics educators who are not members of APS, and allies from beyond the physics community.
The petition authors officially delivered the petition to APS on Monday, November 30th, at 8:45 AM EST. At that time, the petition had been signed by 352 people, 174 of whom were APS members.
The petition authors stopped accepting new signatures on Thursday, December 10th, at 2:00 PM EST. In total, the petition was signed by 391 people, 200 of whom were APS members.
Over 250 signatories—including 151 APS members—indicated that they would like to be contacted in the future to discuss actions we can take to resist EO13950 at our workplaces.
