Session Description: Forty years of trial work, mostly in homicide and “big” civil cases, has taught that in trial we are “on the record” most of the time, and “off the record” sometimes, but what happens “beyond the record” is often the most important and the most entertaining part of trial. This session will review events in and around trials that illustrate the surprises that even well-prepared witnesses can present, actions that relieve the tension of court, and happenings that cannot be foreseen.
Much of the criminal trial work was done with co-counsel. With no apologies to the Honorable J. Craig Cox, formerly a real attorney before he got himself benched, participation in and creation of incidents in this presentation cannot go unacknowledged.
Learning Objectives:
The attendees will learn how an attorney works with sudden, unexpected changes in witness testimony on the stand during trial.
How to build a case for trial.
What parts of a case that, even if entertaining, should not be included in trial.
