Terms of Service
1. General
These Terms of Use (collectively referred to as the “Terms,” “Terms of Service,” “User Agreement,” or “Agreement”) establish the legal relationship between you and Parwah in connection with your access to and use of our products and services. You may use Parwah as an individual or on behalf of a company, organization, or other legal entity.
For purposes of these Terms, “Parwah,” “we,” “us,” and “our” refer to Parwah and the entity responsible for operating the relevant services. Depending on the context, Parwah may also be described as the “Website,” “Application,” “Platform,” or “Services.”
The terms “you,” “your,” “user,” and “visitor” refer to any individual or entity that visits, accesses, registers for, or uses Parwah.
Unless otherwise specified, “Content” and “Materials” include information, communications, text, images, photographs, audio, video, data, software, and other materials or content made available through the Website, Application, Platform, or Services.
By accessing or using Parwah, you represent and confirm that you are 18 years of age or older, or that you have reached the minimum legal age required in your applicable state, country, or region if that age is higher.
If you do not satisfy the applicable age requirement, you are not permitted to access, register for, or use Parwah or any related Services.
2. Content and User Conduct
When accessing or using Parwah, you agree to comply with these Terms, applicable laws and regulations, and any other rules or requirements applicable to the Services.
You must not use the Products or Services for any unlawful, abusive, harmful, or unauthorized purpose. Prohibited conduct includes, but is not limited to, the following:
(i) Engaging in conduct that defames, threatens, harasses, intimidates, or otherwise infringes upon another person's privacy, publicity rights, intellectual property rights, or other lawful rights and interests.
(ii) Taking any action that could interfere with the proper functioning of the Application, Platform, or Services, including actions that may damage, disable, overload, disrupt, or otherwise negatively affect their operation or availability.
(iii) Uploading, posting, transmitting, displaying, distributing, or otherwise making available any text, audio, sound, image, photograph, video, or other material that Parwah reasonably considers hateful, threatening, obscene, abusive, discriminatory, racially or ethnically offensive, defamatory, or otherwise unsuitable for the Services.
(iv) Providing Content that belongs to or is protected by another person's intellectual property rights without having the necessary authorization. When submitting or sharing protected Content, you represent that you are its lawful owner or creator, or that you have obtained all required licenses, permissions, and other authorizations. You are solely responsible for any royalties, licensing fees, compensation, or other payments that may be owed to third parties in connection with your Content.
(v) Attempting to improperly access, penetrate, modify, attack, disrupt, damage, or destabilize the Website, Application, Platform, Services, systems, or source code. You must also not falsely claim or imply that a third-party website, application, product, service, or other resource is operated by, sponsored by, or officially affiliated with Parwah when no such relationship exists.
(vi) Accessing or using the Products or Services through an interface, tool, software, system, method, or other technical means that Parwah has not provided, approved, authorized, or expressly required.
(vii) Introducing, transmitting, distributing, or making available worms, viruses, malware, malicious scripts, or other software, files, programs, or code intended or reasonably capable of causing damage, disruption, unauthorized access, or interference.
(viii) By submitting, uploading, transmitting, displaying, or otherwise making Content available through the Application or Services, you grant Parwah a worldwide, non-exclusive, royalty-free, transferable license to access, reproduce, transmit, publish, display, distribute, modify, adapt, and otherwise use such Content as reasonably necessary for the operation, promotion, advertising, and marketing of Parwah's products and services.
(ix) Creating, uploading, transmitting, displaying, or distributing Content that depicts physical violence, encourages or promotes violent conduct, supports criminal activity, or is otherwise likely to expose you or Parwah to criminal or civil liability.
(x) When you voluntarily provide information or Content to other users through the Application, including photographs, text, screenshots, videos, or other communications, you understand that you may not retain complete control over that information after sharing it. Depending on the recipient's actions and the way the information is subsequently handled, the Content may be copied, redistributed, disclosed to additional persons, or become publicly accessible.
You remain responsible for all Content that you submit, upload, transmit, display, or otherwise make available through Parwah. You are also responsible for ensuring that your conduct and use of the Products and Services comply with these Terms and all applicable laws and regulations.
3. Third-Party Technology
Parwah may use or incorporate technology, software, components, libraries, tools, or other materials that are supplied, owned, operated, or controlled by independent third parties. Such third-party technologies may form part of the Application or may be used to support, enable, or enhance certain features of the Services.
Unless Parwah expressly states otherwise, third-party software or technology incorporated into the Application may be subject to these Terms to the extent that the relevant provisions are applicable to its use.
Third-Party Websites, Products, and Services
For convenience or to provide additional functionality, Parwah may include links, integrations, references, or other methods that allow you to access websites, applications, products, or services operated by independent third parties (collectively, “Reference Sites”).
The availability of a Reference Site through Parwah does not mean that Parwah has reviewed, approved, sponsored, endorsed, or recommended the relevant third party or any of its products, services, content, or activities.
You are solely responsible for deciding whether to access or use any Reference Site. Any information, content, materials, products, or services obtained through a Reference Site are accessed at your own risk.
Parwah does not control third-party websites, applications, products, or services and, to the fullest extent permitted by applicable law, is not responsible for their availability, accuracy, security, content, policies, practices, or performance.
Your use of any Reference Site may be governed by separate terms, privacy policies, and other conditions established by the relevant third party. You should review those terms and policies before providing information or using any third-party service.
4. Payment Policy
Certain features, products, or services available through Parwah may require you to pay fees. By making a payment, you agree to comply with all applicable payment terms, conditions, and requirements provided by Parwah.
You are solely responsible for any fees, charges, duties, or taxes associated with your purchases or other payments made through Parwah, unless otherwise required by applicable law.
Prices, product availability, service availability, and other commercial terms may be modified at any time without prior notice, subject to applicable laws and regulations.
Except where a refund is required by applicable mandatory laws or regulations, or where Parwah has expressly provided a specific refund policy for a particular product or service, all purchases made through Parwah are final and non-refundable.
Any item, virtual item, product, or service purchased through Parwah is non-refundable regardless of whether it has been used, consumed, or remains unused, except where a refund is required by applicable law or expressly permitted under a specific Parwah policy.
5. Account Termination
You may discontinue your use of the Application and Services at any time by choosing to permanently delete your Parwah account.
Account deletion can be initiated within the Application by following the path below:
Mine → Settings → Delete Account
Parwah may, at its reasonable discretion and without advance notice, limit, suspend, or terminate your access to the Application, Services, account, or your rights under these Terms where we reasonably determine that you have breached, or may breach, any provision of these Terms, or where your conduct may otherwise cause harm to Parwah, other users, the platform, or the normal operation of the Services.
Any suspension or termination may take effect immediately where Parwah considers such action necessary to protect the Services, users, or its legitimate interests.
Unless applicable law requires otherwise, termination or suspension of your account does not create a right to reimbursement for paid content, products, virtual items, or other Services that were purchased or used before the relevant termination or suspension.
6. Your Data and Feedback
The collection, use, processing, storage, and protection of your personal information are governed by our Privacy Policy, which forms an important part of your use of the Services.
To the extent permitted by applicable laws and regulations, Parwah may retain, store, or otherwise maintain Content, materials, or other information that you submit or provide while using the Products and Services when reasonably necessary for legitimate operational, legal, security, or other permitted purposes.
If you send Parwah any comments, suggestions, ideas, recommendations, proposals, or other opinions concerning the Application, Products, Services, or their features (“Feedback”), you agree that Parwah may use and benefit from such Feedback without restriction.
You grant Parwah an exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, distribute, display, incorporate, or otherwise exploit your Feedback for any lawful purpose, including commercial and non-commercial purposes. Parwah may exercise these rights without being required to pay you or any other person, or to provide acknowledgment, credit, or attribution.
Parwah has no obligation to treat your Feedback as confidential and is not required to implement, respond to, or otherwise make use of any Feedback you provide.
You understand and agree that submitting Feedback does not give you ownership or any intellectual property or other proprietary rights in Parwah, its Products, Services, features, or any improvements, modifications, corrections, or other developments that may result from such Feedback.
You are fully responsible for the Content and other materials that you submit, upload, transmit, or otherwise provide through Parwah. This responsibility includes ensuring that such Content is lawful, accurate, reliable, appropriate, original where applicable, and does not infringe copyright, intellectual property rights, privacy rights, or other rights belonging to any third party.
By providing any Content or Feedback to Parwah, you represent and warrant that you have all rights, permissions, licenses, and authority necessary to submit the relevant materials and to grant Parwah the rights and licenses set out in these Terms.
7. Limitation of Liability
Certain features and functions of the Application depend on an internet connection. Such connection may be provided through Wi-Fi or your mobile network operator. Parwah is not responsible for any interruption, limitation, or reduced functionality of the Application caused by the absence of a suitable internet connection, including situations where you have reached or exceeded the data limit provided by your mobile network operator.
When accessing or using the Application through a mobile network rather than Wi-Fi, your agreement with your mobile network provider will continue to apply. As a result, you may be charged for mobile data usage or other services provided by your network operator or other third parties. By using the Application, you acknowledge and accept full responsibility for any such charges, including roaming fees that may arise when you use the Application outside your usual country or region without disabling mobile data roaming.
You are also responsible for ensuring that your device is capable of accessing and using the Application. This includes maintaining sufficient battery power and ensuring that your device remains operational. Parwah will not be responsible for any inability to access or use the Services caused by your device being switched off, running out of battery, or otherwise becoming unavailable.
Parwah makes reasonable efforts to keep the information and functionality provided through the Application accurate and up to date. However, certain information and services may be supplied or supported by third parties. Because such information may depend on third-party sources, Parwah does not guarantee its completeness, accuracy, reliability, or continuous availability. To the maximum extent permitted by applicable law, Parwah will not be liable for any direct, indirect, incidental, or consequential loss arising from your reliance on such information or functionality.
Parwah may modify, improve, update, or otherwise change the Application from time to time. The technical requirements for operating systems and other platforms on which the Application is available may also change. You may therefore need to install updates in order to continue using the Application.
Although Parwah may provide updates when appropriate, Parwah does not guarantee that the Application will always be updated, maintained, or compatible with every version of an operating system or every device. You agree to install and accept Application updates when they are made available to you.
Parwah also reserves the right to discontinue, suspend, or terminate the Application or any part of the Services at any time, without being required to provide advance notice, unless such notice is required by applicable law or otherwise stated by Parwah.
Unless Parwah expressly provides otherwise, following termination of the Application or your access to the Services:
(a) all rights and licenses granted to you under these Terms will immediately cease; and
(b) you must stop accessing and using the Application and, where applicable, remove or uninstall it from your device.
Indemnification
You agree to defend, indemnify, and hold harmless Parwah, its employees, representatives, and related parties from and against any third-party claims, liabilities, losses, damages, costs, and expenses arising out of or relating to:
(a) your acts or omissions while using the Website, Application, or Services; or
(b) any Content or other materials submitted, uploaded, transmitted, displayed, or otherwise provided by you.
8. Changes to These Terms
Parwah may revise, amend, or update these Terms of Use from time to time in response to changes in our Services, business practices, applicable laws, or other relevant circumstances.
When changes are made, the updated version of the Terms will be published on this page. We encourage you to review these Terms periodically so that you remain aware of the latest applicable provisions.
Your continued access to or use of the Application or Services after the revised Terms become effective will constitute your acceptance of the updated Terms.
If you do not agree with any revised provision, you should stop using the Application and Services.
9. Arbitration
Parwah specifically draws your attention to the provisions of these Terms that may limit or exclude Parwah's liability or otherwise affect your rights and interests. You are encouraged to carefully review these provisions and independently assess the potential risks associated with using the Application and Services.
If any dispute, controversy, or claim arises between you and Parwah in connection with these Terms or your use of the Application or Services, the parties should first attempt to resolve the matter through good-faith negotiation.
If the dispute cannot be settled through negotiation or mediation, the dispute shall be referred to the Hong Kong International Arbitration Centre ("HKIAC") for arbitration in accordance with the arbitration rules applicable at the time the arbitration is commenced.
The seat and place of arbitration shall be Hong Kong.
The arbitral award shall be final and binding upon both parties, subject to any rights or remedies that cannot legally be excluded under applicable law.
