1. Parties
This Agreement is made between Paramount Parking & Storage ("Licensor") and the individual or company ("Driver/Licensee") entering into this contract for the purpose of licensing parking space(s) at the Licensor's premises in Olathe, KS.
2. Grant of License
Licensor grants a revocable license to the Driver/Licensee to use designated parking space(s) for vehicle parking only. This agreement does not constitute a lease or confer any interest in real property. No exclusive possession is granted.
3. Responsibility
The Driver/Licensee is responsible for all actions of individuals they allow to operate or park vehicles on the premises under this license.
4. Payment Terms
Driver/Licensee agrees to complete a recurring payment form. Payment methods accepted include credit card, debit card, T-Checks, check, or cash. All payments are due at least seven (7) days in advance of the renewal date. Rates are non-refundable. Changes in pricing require written notice by mail, email, or text. Late payments will incur:
$10 late fee after 3 days
$25 late fee after 10 days
Vehicle considered in default after 14 days, subject to impound and $50/day storage fee
5. Cancellation Policy
Driver/Licensee must cancel this agreement in writing at least 7 days prior to the end of the agreement term. All outstanding balances and damage charges must be paid. Licensor may cancel agreement at any time with or without notice for any reason including default or violation of rules.
6. Default
Failure to comply with any term of this agreement may result in immediate termination. Driver/Licensee is responsible for all legal and collection costs, including attorney’s fees.
7. No Refund Policy
All payments are final. No refunds are granted for cancellation or termination for misconduct, default, or violation of terms.
8. Hold Harmless & Indemnification
Driver/Licensee agrees to hold harmless and indemnify Paramount Parking & Storage, its officers, employees, and agents from any claims arising out of use of the premises, including but not limited to:
Theft
Vandalism
Fire
Weather events (wind, rain, flood, earthquake, etc.)
Acts of God or terrorism
Accidental or intentional damage Driver/Licensee assumes full responsibility for all loss or damage to property while on the premises.
9. Maintenance Restriction
No repairs of any kind are permitted on site. Violators will be asked to leave. Only Paramount Truck / Trailer Repair is authorized to perform maintenance on the property.
10. Property Damage
Driver/Licensee is liable for all damage caused to fencing, gates, pavement, buildings, or any part of Licensor’s property. Parking brakes must be applied.
11. Gate Access and Security
Gate codes must remain confidential. Driver/Licensee must lock the gate every time upon entry and exit. Violations will result in immediate termination of license.
12. Abandoned Vehicles
Vehicles left unpaid for 14+ days will be considered abandoned. Licensor may seek court orders to claim ownership. Driver/Licensee will be liable for all associated legal and storage costs.
13. Personal Vehicle Parking
Personal vehicles must be parked in designated areas. No personal vehicles may occupy truck parking spaces.
14. Right to Relocate Vehicles
Licensor reserves the right to move any vehicle to another lot due to non-payment or operational needs.
15. Property Security Notice
Licensor provides fenced, lighted premises only. It is the responsibility of the Driver/Licensee to secure vehicles and property. Recommended protections include:
Kingpin locks
Steering/wheel locks
GPS tracking devices
16. Loaded Trailers
Unhooking from loaded trailers must be done with wood blocks under landing gear. Licensor is not responsible for sunken or damaged trailers.
Acknowledgment
By renting or occupying a space at Paramount Parking & Storage, the Driver/Licensee acknowledges and agrees to be bound by these Terms & Conditions. If the Driver/Licensee does not agree to these terms, they must not use or occupy the premises.
