Welcome to Palate (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of the Palate mobile application (the “App”).

By using Palate, you agree to these Terms. If you do not agree, please do not use the App.

1. Use of the App

Palate provides restaurant discovery and recommendation services based on user preferences and location.

You agree to use the App only for lawful purposes and in accordance with these Terms.

You must not:

• Use the App in any way that violates applicable laws or regulations

• Attempt to gain unauthorized access to the App or its systems

• Interfere with or disrupt the functionality of the App

2. No Guarantees on Recommendations

Palate provides suggestions for restaurants based on available data and user inputs.

We do not guarantee:

• The accuracy, completeness, or reliability of restaurant information

• Availability, quality, or safety of any restaurant

• That recommendations will meet your expectations

All decisions made based on the App are at your own discretion.

3. Location Services

Certain features of the App require access to your device’s location.

By enabling location services, you consent to the use of your location data as described in our Privacy Policy.

You can disable location access at any time in your device settings.

4. Intellectual Property

All content, features, and functionality of the App—including but not limited to text, design, graphics, and branding—are owned by Palate or its licensors and are protected by applicable intellectual property laws.

You may not:

• Copy, modify, distribute, or reproduce any part of the App without permission

• Use our branding or trademarks without prior written consent

5. Third-Party Services

The App may rely on third-party services (such as mapping, restaurant data providers, or analytics tools).

We are not responsible for:

• The content or accuracy of third-party data

• The practices or policies of third-party services

Your use of such services may be subject to their own terms.

6. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

• Merchantability

• Fitness for a particular purpose

• Non-infringement

We do not guarantee that the App will be uninterrupted, secure, or error-free.

7. Limitation of Liability

To the fullest extent permitted by law, Palate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data

• Loss of profits

• Personal injury or dissatisfaction related to restaurant experiences

Your use of the App is at your own risk.

8. Termination

We reserve the right to suspend or terminate access to the App at any time, without notice, for any reason, including violation of these Terms.

9. Changes to These Terms

We may update these Terms from time to time.

We will update the “Effective Date” above when changes are made. Continued use of the App after changes means you accept the updated Terms.

10. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles.
