Introduction

These terms and conditions (the "Terms") govern your use of the "Hit The Hills" mobile game (the "Game") developed by Owl Ma Games (the "Developer"). By downloading, installing, accessing or using the Game, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, access or use the Game.

License

Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-sublicensable, revocable license to download, install and use the Game on a mobile device that you own or control.

Intellectual Property

The Game and its content, including but not limited to software, graphics, sounds, music, and other proprietary material, are protected by intellectual property laws. The Developer and its licensors retain all right, title and interest in and to the Game, including all related intellectual property rights. You acknowledge that the Game is licensed, not sold, to you for use only under these Terms.

User Conduct

You agree to use the Game only for lawful purposes and in accordance with these Terms. You agree not to:

a) Infringe, violate or misappropriate any third-party right, including but not limited to any intellectual property rights;

b) Use the Game for any illegal, harmful, or malicious purpose;

c) Use the Game to upload, post, transmit, share or store any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable;

d) Impersonate any person or entity, including but not limited to any of the Developer's employees or representatives.

Disclaimer of Warranties

THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE GAME WILL BE ERROR-FREE, UNINTERRUPTED OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE GAME.

Termination

The Developer may terminate these Terms and your use of the Game at any time, with or without cause, with or without notice. In the event of termination, you must cease all use of the Game.

Governing Law

These Terms and your use of the Game will be governed under the laws of the jurisdiction in which the Developer is headquartered.

Changes to these Terms

The Developer reserves the right to modify these Terms at any time. Your continued use of the Game following any changes to these Terms will indicate your acceptance of the revised Terms.
