Terms of Service

Effective as of October 27, 2023

These terms and conditions are a legally binding agreement between you ("Player," "User") and OneSoftz governing your use of X Fighter. By accessing or using the Game, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Game.

Account Registration

To access certain features of the Game, you may be required to create an account. You agree to provide accurate and complete information during the registration process and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Intellectual Property

The Game, including all content, graphics, design, code, and other materials, are protected by intellectual property rights and belong to OneSoftz. You are granted a limited, non-exclusive, non-transferable license to use the Game solely for personal, non-commercial purposes.

You may not, without our prior written consent, copy, modify, distribute, display, perform, transmit, publish, or create derivative works from the Game.

User Conduct

You agree not to:

a. Use the Game for any unlawful or unauthorized purpose.

b. Post, transmit, or share any content that is harmful, offensive, or violates the rights of others.

c. Engage in any conduct that may disrupt or interfere with the Game's operation.

Develop, Improve and Update the Service

We will be changing and improving the Service. As part of this continual evolution, we may make modifications or changes (to all or part of the Service) such as adding or removing features and functionalities, offering new digital content or services or discontinuing old ones. We may also need to alter or discontinue the Service, or any part of it, in order to make performance or security improvements, make changes to comply with law, or prevent illegal activities on or abuse of our systems. These changes may affect all users, some users or even an individual user. When the Service requires or includes downloadable software, that software may update automatically on your device once a new version or feature is available, subject to your device settings.

In-Game Purchases

The Game may offer in-game purchases. By making such purchases, you agree to pay the specified fees and understand that all sales are final.

Your use of the Game is also governed by our Privacy Policy, which explains how we collect, use, and disclose your personal information.

Terminations and Suspensions

OneSoftz reserves the right to suspend or terminate your account or your access to all or part of the Service if: (a) you materially or repeatedly breach this Agreement; (b) we are required to do so to comply with a legal requirement or a court order; or (c) we believe there has been conduct that creates (or could create) liability or harm to any user, other third party.

We may terminate or suspend your access to the Game at our discretion, with or without cause.

Disclaimers and Limitations of Liability

The Game is provided "as is" and "as available." We make no warranties, express or implied, regarding the Game's availability, accuracy, or reliability.

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Game.

ONESOFTZ WILL NOT BE RESPONSIBLE FOR ANY VIRUSES OR MALICIOUS CODE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY.

Third-Party Links

The Service may contain links to third-party websites and online services that are not owned or controlled by OneSoftz. OneSoftz has no control over, and assumes no responsibility for, such websites and online services. Be aware when you leave the Service; we suggest you read the terms and privacy policy of each third-party website and online service that you visit.

Changing this Agreement

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Game.

We may change this Agreement, (1) to reflect changes to our Service, (2) for legal, regulatory, or security reasons, or (3) to prevent abuse or harm . If we materially change this Agreement, we’ll notify you and give you the opportunity to review the changes, except (1) when we launch a new product or feature, or (2) in urgent situations, such as preventing ongoing abuse or responding to legal requirements. If you don’t agree to the new terms, you should delete your account and stop using the Service.

Severance

If it turns out that a particular term of this Agreement is not enforceable for any reason, this will not affect any other terms.

No Waiver

If you fail to comply with this Agreement and we do not take immediate action, this does not mean that we are giving up any rights that we may have (such as the right to take action in the future).

Governing Law

These Terms are governed by the laws of Bangladesh. You agree to submit to the exclusive jurisdiction of the courts in Bangladesh for any disputes arising under or in connection with these Terms.
