"I need to fund my trust - how do I do that legally?"

Elements For Successfully Funding Your Trust:

1) Properly titling the property in your name and then into your trust. This is critical for avoiding probate and to ensure that the assets pass outside of Probate Court. If you own any real property or personal property, such as electronics, vehicles, guns etc., it must be properly titled and transferred to your trust. Many people set up a Revocable Living Trust but do not take the time to title their assets correctly. One should never assume "because I have a Revocable Living Trust that I am automatically protected from Probate." You absolutely need to follow through on titling your assets correctly.

2) Transferring all of your assets to the trust (with proper title or re-titling). This includes bank accounts, brokerage accounts, safe deposit box contents, business interests, real estate, vehicles etc. If you are married, then any marital asset goes into the Trust to avoid probate.

3) Funding your Trust with your assets - cash must flow through the trust account it will not work if you simply put names on checking accounts so they can sign for transactions.
