A. User-Generated Content and Prohibited Conduct:
This application allows users to create, upload, share, or interact with content (hereinafter referred to as "User Content"). By using the application and its features related to User Content, you agree to comply with the following terms:
The creation, uploading, sharing, or dissemination of any User Content falling under the following categories is strictly prohibited (collectively referred to as "Objectionable Content"):
Violates applicable laws and regulations.
Is defamatory, libelous, slanderous, threatening, or harassing towards others.
Is discriminatory based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic.
Is pornographic, obscene, or contains inappropriate adult content.
Invades the privacy or discloses the personal information of others without permission.
Infringes upon the copyright, trademarks, or other intellectual property rights of others.
Is misleading, misrepresents the truth, or disseminates false information.
Contains viruses, malware, or any other harmful components.
Is for unauthorized advertising, solicitation, or spam.
Any content that we deem inappropriate, negatively impacts the user community, or violates general ethical standards.
Abusive conduct includes but is not limited to:
Harassing, threatening, or behaving offensively towards other users.
Attempting to gain unauthorized access to other users' accounts.
Using automated tools or unfair methods to increase engagement or manipulate the system.
Any other behavior that we deem disruptive or negatively impacts the experience of other users.
We have zero tolerance for any conduct related to Objectionable Content or abusive behavior. Users who violate these terms may have their content removed, their accounts temporarily suspended, or permanently terminated without prior notice.
B. Subscriptions, Payments, and App Store Addendum
Upgrade Plans and Auto-Renewable Subscriptions
The Application offers paid upgrade plans to remove advertisements and unlock an uninterrupted experience:
The specific price for each plan is displayed directly within the Application at the time of purchase, in the currency and pricing tier designated by the App Store / Google Play for your region.
Terms for Auto-Renewable Subscriptions (Monthly, 6-Month & Yearly Plans):
Payment will be charged to your Apple ID account (App Store) or Google Play account upon confirmation of purchase.
Subscriptions automatically renew at the same price and duration unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You may manage your subscriptions and turn off auto-renewal at any time by accessing your App Store / Google Play Account Settings after purchase.
Any cancellation will take effect at the end of the active billing cycle; no refunds will be provided for the remaining period of an active subscription.
If a free trial period is offered, any unused portion of the trial will be forfeited when you purchase a corresponding subscription.
2. Payment, Refunds, and Restorations
All payment transactions are processed directly by the Apple App Store or Google Play, not by us. Refund policies are subject to the terms and regulations of the respective platform. For App Store purchases, refund requests must be submitted directly to Apple. We do not have access to, nor do we store, your credit card details or payment method information.
3. Additional Terms for Applications Downloaded from the Apple App Store
For Applications downloaded from the Apple App Store, the following minimum terms apply as required by Apple. In the event of any conflict between the Terms above and the provisions of this section, the provisions of this section shall prevail with respect to the Application downloaded from the App Store.
Acknowledgement: This Agreement is concluded between you and the Application developer only, not with Apple. The developer, not Apple, is solely responsible for the Application and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
Scope of License: The license granted to you is a non-transferable license to use the Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
Maintenance and Support: The developer is solely responsible for providing any maintenance and support services with respect to the Application. You and the developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
Warranty: The developer is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Application (if applicable) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
Product Claims: The developer, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
Intellectual Property Rights: In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party’s intellectual property rights, the developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-Party Terms of Agreement: You must comply with applicable third-party terms of agreement when using the Application.
Third-Party Beneficiary: You and the developer acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
