Welcome to OctoPass. These Terms of Service ("Terms") govern your use of the OctoPass mobile application and related services (collectively, the "Service"). By downloading, accessing, or using OctoPass, you agree to these Terms. If you do not agree, do not use the Service.

1. About OctoPass

OctoPass is a productivity and screen-time management application designed to help users reduce distractions and earn additional screen time by completing challenges and games.

OctoPass uses Apple's Screen Time APIs and Family Controls framework to provide app limits and restrictions.

OctoPass is not a medical, psychological, or healthcare service.

2. Eligibility

You must be at least 13 years old to use OctoPass.

If you are under the age required in your jurisdiction, you must have permission from a parent or legal guardian.

3. No Guarantee of Results

OctoPass is intended as a productivity tool.

We do not guarantee that:

• You will reduce your screen time.

• You will improve focus or productivity.

• You will achieve any specific outcome.

• App restrictions or notifications will always function correctly.

Individual results may vary.

4. Screen Time Features

OctoPass relies on Apple technologies, including FamilyControls, ManagedSettings, and DeviceActivity.

You acknowledge that:

• Restrictions may not work in all situations.

• Some apps or activities may not be detected.

• Notifications may fail or be delayed.

• Screen time tracking may contain inaccuracies.

• Limits may not be enforced under all circumstances.

• Apple system updates may affect functionality.

OctoPass makes no guarantee that app blocking or time limits will be uninterrupted or error-free.

5. Challenges and Games

Challenges, puzzles, quizzes, memory games, and similar activities are provided for entertainment and productivity purposes only.

We do not guarantee:

• Accuracy of challenge content.

• Educational value.

• Availability of any specific game.

• Permanent access to any challenge or category.

Content may be modified, added, or removed at any time.

6. Subscription Services

Some features require an active subscription.

Subscriptions are billed through Apple App Store and are subject to Apple's terms and policies.

Subscriptions automatically renew unless canceled through your Apple account settings.

You are responsible for managing your subscription.

7. Payments and Refunds

All purchases are processed by Apple.

OctoPass does not directly process payments.

Refund requests are handled solely by Apple.

We do not control Apple's refund decisions and make no guarantees regarding refunds.

8. Free Features and Premium Features

Certain features may be limited to subscribers.

We reserve the right to:

• Change free features.

• Modify premium features.

• Add or remove functionality.

• Introduce new subscription plans.

• Change pricing where permitted.

9. No Medical Advice

OctoPass is not:

• Medical treatment.

• Psychological treatment.

• Therapy.

• Professional advice.

Nothing within OctoPass should be interpreted as medical, psychiatric, or health advice.

Always consult qualified professionals regarding health concerns.

10. User Responsibility

You are solely responsible for:

• Your use of the Service.

• The apps you choose to restrict.

• Your screen time habits.

• Your device settings.

• Your decisions and actions.

You agree not to rely exclusively on OctoPass for time management or digital wellbeing.

11. Availability

We do not guarantee that the Service will always be available.

The Service may experience:

• Bugs

• Interruptions

• Maintenance

• Delays

• Errors

• Temporary outages

Features may change without notice.

12. Intellectual Property

OctoPass and all related content, including but not limited to:

• Logos

• Designs

• Graphics

• Games

• Challenges

• Software

• Text

• User interfaces

are owned by OctoPass and protected by applicable intellectual property laws.

You may not:

• Copy

• Sell

• Reproduce

• Reverse engineer

• Modify

• Redistribute

any portion of the Service without permission.

13. Prohibited Conduct

You agree not to:

• Abuse the Service.

• Attempt to bypass restrictions.

• Reverse engineer the application.

• Interfere with operation of the Service.

• Use the Service unlawfully.

• Exploit bugs or vulnerabilities.

• Copy or redistribute content.

14. Third-Party Services

OctoPass may rely on third-party services including but not limited to:

• Apple

• RevenueCat

• Firebase

• Analytics providers

• Cloud providers

We are not responsible for the operation, availability, or policies of third-party services.

15. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCTOPASS DISCLAIMS ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

• ACCURACY

• RELIABILITY

• CONTINUOUS AVAILABILITY

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCTOPASS AND ITS OWNERS SHALL NOT BE LIABLE FOR:

• LOSS OF DATA

• LOSS OF PROFITS

• LOST OPPORTUNITIES

• INTERRUPTION OF BUSINESS

• DEVICE ISSUES

• SCREEN TIME TRACKING ERRORS

• FAILURE OF APP BLOCKING

• MISSED NOTIFICATIONS

• INDIRECT DAMAGES

• INCIDENTAL DAMAGES

• CONSEQUENTIAL DAMAGES

YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

17. Indemnification

You agree to defend, indemnify, and hold harmless OctoPass and its owners from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Service.

• Your violation of these Terms.

• Misuse of the application.

• Violations of applicable law.

18. Termination

We reserve the right to suspend, restrict, or terminate access to the Service at any time without prior notice.

19. Changes to These Terms

We may update these Terms from time to time.

Changes become effective when posted.

Continued use of OctoPass after changes constitutes acceptance of the revised Terms.

20. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Netherlands, without regard to conflict of law principles.

22. Apple App Store Additional Terms

You acknowledge that:

• These Terms are between you and OctoPass, not Apple.

• Apple is not responsible for the Service or its content.

• Apple has no obligation to provide maintenance or support.

• Apple is not responsible for claims relating to the Service.

• Apple and its subsidiaries are third-party beneficiaries of these Terms.

By using OctoPass, you acknowledge that you have read and agree to these Terms of Service.
