‘Oceans4us Bargara ocean swimmers’ is not able to assume legal responsibility to it’s members or others. While we are intent to share our passion for outdoor swimming, all swimmers must be solely responsible to determine their own health, ability to join a swim and for making their own assessment as to the risks involved in any particular swim including when joining or leaving a swim at any location.  Further is it your sole responsibility to assess any risks involved in swimming along a coastline of various terrains, rocky or otherwise and your responsibility to assess any risks when deciding to swim out deep in the ocean or in shallow water.  

Swims arranged by members of the ‘oceans4us Bargara Ocean Swimmers’ are not led or supervised by individuals with swimming or life saving qualifications and no insurance is in place.  I understand that all swims are a social meet up & accept that I am involved at my own risk.  The ‘Oceans4us Bargara ocean swimmers’ has no control or influence over those who arrange ‘Oceans4us Bargara ocean swimmers’ social swims.

The decision to participate in any swim must therefore be taken individually, and swimmers must not rely (in whole or in part) on views or information provided by the ‘Oceans4us Bargara ocean swimmers’ and/or its members.  If you are in any doubt about the safety of a swim or your ability to complete it, you should not participate.

In becoming a member of ‘oceans4us Bargara Ocean Swimmers’ I am fully aware and acknowledge that participation may involve risks, both known or unknown.  I acknowledge that ocean swimming can be a dangerous sport.   

Further, to the maximum extent permitted by law you release and hold harmless:

    1.    the ‘oceans4us Bargara ocean swimmers’;
    2.    each individual acting on behalf of the ‘oceans4us Bargara ocean swimmers’; and
    3.    any person involved in organising a ‘oceans4us Bargara ocean swimmers’ swim,

exclude any liability for personal injury, death or other harm or loss to its members or any other person or organisation as a result of their negligence or other breach of legal duty.
