Grading

There are three components to your grade in this class. Your final is worth 60% of your grade. Class participation is worth 15% of your grade. Your in-class practice-based activities are worth 25% of your grade. There is no midterm. The 40% of your grade that is not the final can change your grade significantly.

Final Exam (60% of your grade)

The final exam is an 8-hour, take-home exam that you can take on any day of Exam Period. It will be available at 6 AM on the first day. There are three questions and no multiple choice. The first question is a standard issue spotter. The second question also requires you to spot issues, but it will direct you to write an argument (advocacy writing). The third question is an essay (thesis, evidence, conclusion) on a matter of intellectual property law to which there is no answer (yet). Your job is to give me your view, backed by evidence.

Class Participation (15% of your grade)

Active class engagement is essential to success in this class. Your class participation grade, which aggregates the quality and quantity of your direct participation in class and your active participation/teamwork and leadership skills in our in-class activities, can make the difference between a B+ and an A-, at a minimum. Beyond the grade, studies show that an active back-and-forth in class correlates with enhanced performance on the final exam.

Practice Based Activities (25% of your grade)

These are a series of group projects that apply what we learn in class to real life situations, whether drafting mock legislation and supporting your proposal with evidence and argument in a white paper, or drafting litigation documents. Your submission/work product will be worth 25% of your grade and you will be graded as a group.
