These Terms & Conditions apply to the Nyla mobile application (hereinafter referred to as the “Application”), developed by Gledson Cruz (hereinafter referred to as the “Service Provider”) as a commercial service.
By downloading, accessing, or using the Application, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use the Application.
The Application allows users to create private memories consisting of photos and text.
After signing up, users may create up to five (5) memories free of charge. This free usage is provided so users can evaluate the Application before deciding to purchase a subscription.
Once the free limit is reached, an active subscription is required to continue creating new memories or accessing premium features.
The Application offers paid subscriptions on a monthly or yearly basis, which are processed through the Apple App Store.

The Application does not offer a free trial for subscriptions, as users can already use the Application for free up to the defined limit.
Payment will be charged to your Apple ID account at the time of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
The renewal charge will be applied within 24 hours prior to the end of the current period.
You can manage or cancel your subscription at any time through your Apple App Store account settings.
The Service Provider does not manage payments directly and does not store payment card details. Subscription management and entitlement handling are performed using third-party services.
The Application relies on third-party services to provide analytics, crash reporting, and subscription management. These services operate under their own Terms & Conditions:

By using the Application, you acknowledge and agree to the terms of these third-party services.
The Application, including but not limited to its design, features, trademarks, source code, and content, is the exclusive property of the Service Provider.
You may not copy, modify, distribute, reverse engineer, decompile, or create derivative works from any part of the Application. Any unauthorized use of the Application or its intellectual property is strictly prohibited.
You are responsible for maintaining the security of your device and your access credentials.
The Service Provider strongly advises against jailbreaking or rooting your device, as this may compromise security, expose your device to malware, and cause the Application to malfunction or stop working entirely.
Certain features of the Application require an active internet connection. The Service Provider is not responsible for the Application failing to function due to lack of connectivity or insufficient data allowance.
If you use the Application over a mobile data connection, you may incur charges from your mobile network provider. You are solely responsible for any such charges, including roaming fees.
The Application is provided on an “AS IS” and “AS AVAILABLE” basis.
While the Service Provider makes reasonable efforts to ensure the Application functions correctly and is kept up to date, they do not guarantee uninterrupted availability or error-free operation.
To the maximum extent permitted by law, the Service Provider shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of, or inability to use, the Application.
The Service Provider may update, modify, or discontinue the Application at any time.
You agree to accept updates when they are made available. Continued use of the Application may require installing updates.
The Service Provider may also terminate or suspend access to the Application without prior notice. Upon termination:
Your right to use the Application will cease
Any licenses granted under these terms will end
You must stop using and, if necessary, delete the Application from your device
The Service Provider may update these Terms & Conditions from time to time. Any changes will be posted on this page.
Your continued use of the Application after changes are published constitutes acceptance of the updated Terms & Conditions.
