PRIVACY POLICY
The products made available through this service ("Products") are licensed, not sold, to you for use only under the terms of this agreement (the "License"). If any Product is accompanied by a separate license agreement, the terms of that agreement will govern its use, provided that you have accepted the separate agreement. The Application Provider ("Licensor") reserves all rights not expressly granted to you under this License. The Product provided to you is referred to as the "Licensed Application."
a. Scope of License
The License granted to you by the Application Provider for the Licensed Application is non-transferable, revocable, and limited to personal use only. You may use the Licensed Application solely on devices that you own or control, such as your iPhone or iPod touch, and only in accordance with the Usage Rules outlined in Section 9.b. of the App Store Terms and Conditions (the “Usage Rules”). This License does not permit use of the Licensed Application on any device that you do not own or control. Additionally, you may not distribute, rent, lease, lend, sell, or sublicense the Licensed Application, nor make it available to others over a network where it could be accessed by multiple devices at the same time.
You may not copy, reverse engineer, decompile, disassemble, attempt to derive the source code, modify, or create derivative works of the Licensed Application, any updates, or any portion thereof, except as explicitly permitted by this License or the Usage Rules. If you attempt to do so, you violate the rights of the Application Provider and its licensors, which may result in legal action against you. The License also governs any upgrades provided by the Application Provider that replace or supplement the original Licensed Application unless a separate License is provided for the upgrade.
b. Consent to Use of Data
By using the Licensed Application, you agree that the Application Provider may collect and use certain technical data and related information. This includes, but is not limited to, data about your device, system software, and peripherals, which may be collected periodically to provide software updates, product support, and other related services. The Application Provider may use this data to improve its products and services. Importantly, no personal information regarding your interactions or content entered into the application will be collected or stored by the Application Provider. The data collected will be anonymized and used solely for improvement purposes.
c. Termination
The License will remain in effect until terminated by you or the Application Provider. Your rights to use the Licensed Application will automatically terminate without notice if you fail to comply with any of the terms of this License. Upon termination, you must cease all use of the Licensed Application and delete all copies, full or partial, from your devices.
d. Services; Third-Party Materials
The Licensed Application may provide access to certain services and websites operated by the Application Provider or third parties (collectively, "Services"). Accessing these Services may require an internet connection and, in some cases, your agreement to additional terms of service. While using the Services, you may encounter content that could be deemed offensive, indecent, or objectionable. The Application Provider is not responsible for any such content, and your use of the Services is at your own risk.
Some Services may also include links to or display materials from third-party websites or services ("Third-Party Materials"). The Application Provider does not review, endorse, or assume responsibility for any such Third-Party Materials or websites. These are provided as a convenience, and you agree that the Application Provider is not liable for any loss or damage caused by your use of third-party services, materials, or websites. The Application Provider is not responsible for the availability, accuracy, or legality of such Third-Party Materials.
You also acknowledge that financial data or location information provided by any Services is for general informational purposes only and should not be relied upon as professional advice. You should consult a professional before making any financial decisions based on this information. Furthermore, location data should not be used as a primary tool for navigation in situations where accuracy is critical, as the Application Provider cannot guarantee the reliability of location data in all circumstances.
e. No Warranty
You understand and agree that your use of the Licensed Application is at your own risk, and the Application Provider makes no representations or warranties, express or implied, regarding the Licensed Application. To the fullest extent permissible under applicable law, the Licensed Application and any related services are provided "as is" and "as available." The Application Provider disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.
The Application Provider does not warrant that the Licensed Application will meet your requirements, be uninterrupted, or error-free, or that defects will be corrected. Any oral or written advice given by the Application Provider or its authorized representatives does not constitute a warranty. If the Licensed Application is defective, you will bear the cost of necessary repairs or corrections.
f. Limitation of Liability
To the extent permitted by law, the Application Provider will not be liable for any incidental, special, indirect, or consequential damages, including but not limited to loss of profits, data, or business interruption, arising from or related to your use or inability to use the Licensed Application, regardless of the theory of liability. This includes damages even if the Application Provider has been advised of the possibility of such damages. In no case will the total liability of the Application Provider exceed the amount you paid for the Licensed Application, not exceeding fifty dollars ($50.00).
Some jurisdictions may not allow the exclusion of certain warranties or limitations on liability, so the above limitations may not apply to you in full.
g. Export Restrictions
You may not export or re-export the Licensed Application except in compliance with U.S. export control laws and the laws of the jurisdiction in which the Licensed Application was obtained. Specifically, the Licensed Application cannot be exported to any country subject to a U.S. embargo or to individuals or entities listed on the U.S. Treasury Department’s Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List. By using the Licensed Application, you confirm that you are not located in such countries or on such lists and agree to comply with all applicable laws regarding the export and use of the Licensed Application.
h. Government Use
The Licensed Application and its documentation are considered "Commercial Items" under U.S. government regulations (48 C.F.R. §2.101), and are licensed to U.S. Government end users only under the terms of this agreement, with all rights reserved to the Application Provider.
i. Governing Law
This License Agreement will be governed by and construed in accordance with the laws of the State of California, excluding its conflict of law principles. Your use of the Licensed Application may also be subject to additional local, state, national, or international laws, which you must comply with.
