Rezoning hearing rescheduled for January 28, 2026

The public hearing to rezone several properties along Texaco Road and Mulberry Drive in Silver Spring Township has been rescheduled for January 28, 2026. The following notice is posted on the township's website:

Public Notice - Public Hearing - Texaco Road Rezoning

The Board of Supervisors of the Township of Silver Spring hereby gives public notice that it will hold a public hearing and will vote on enactment of Ordinance No. 07 of 2025 during its regular meeting on January 28, 2026, at 6:30 p.m. in the Township Municipal Building, 8 Flowers Drive, Mechanicsburg, PA 17050, with a virtual attendance option available. Ordinance No. 07 of 2025 amends the Code of the Township of Silver Spring, Chapter 415, by amending the Zoning Map by rezoning multiple parcels in the area between Texaco Road and Mulberry Drive from I-2 General Industrial to I-1 Light Industrial and a portion of one to I-1 Light Industrial to R-1 Residential Zoning.

Ordinance No. 07 of 2025 may be examined without charge at the Municipal Building aforesaid during regular business hours. If you are a person with a disability desiring to attend the public hearing and require an auxiliary aid, service or other accommodation to participate in the hearing, please contact the Township Manager at 766-0178 x3320 to discuss how Silver Spring Township may provide a reasonable accommodation.

Error in mailing address causes public hearing delay

Due to an error in the mailing address, one property owner did not receive a 30-day advance notification prior to the scheduled rezoning hearing. Due to this legal requirement, the Board of Supervisors had to table the rezoning hearing until its next meeting in January 2026.

Rezoning hearing scheduled for December 17, 2025

A public hearing is scheduled for December 17, 2025 to rezone several properties along Texaco Road and Mulberry Drive in Silver Spring Township. If the rezoning is approved, numerous properties will be returned back to the Light Industrial (I-1) zoning prior to changes made in March 2022. The following notice is posted on the township's website:

The Board of Supervisors of the Township of Silver Spring hereby gives public notice that it will hold a public hearing and will vote on enactment of Ordinance No. 07 of 2025 during its regular meeting on December 17, 2025, at 6:30 p.m. in the Township Municipal Building, 8 Flowers Drive, Mechanicsburg, Cumberland County, Pennsylvania with a virtual attendance option available to consider. Ordinance No. 07 of 2025 amends the Code of the Township of Silver Spring, Chapter 415, by amending the Zoning Map by rezoning multiple parcels in the area between Texaco Road and Mulberry Drive from I-2 General Industrial to I-1 Light Industrial and a portion of one to I-1 Light Industrial to R-1 Residential Zoning.

Additionally, during the same meeting, the Board of Supervisors will hold a public hearing and will vote on enactment of Resolution No. 27 of 2025, which amends the Silver Spring Township Comprehensive Plan. The amendments to the Comprehensive Plan include clarification that the I-1 Light Industrial District does not include warehousing and distribution as uses and encourages reuse of such nonconforming uses and include updates the Future Use Map to correspond to the above-summarized amendments to the zoning map.

Update on Trindle Spring Trade Center Warehouse Lawsuit
SUMMARY OF STATUS OF DEVELOPER PDC NORTHEAST LPIV JH/IM, LLC’S LAND USE APPEAL
OF SILVER SPRING TOWNSHIP’S DENIAL OF ITS PROPOSAL
TO BUILD A WAREHOUSE IN THE TOWNSHIP
(Trindle Spring Trade Center)

On October 17, 2025, Judge Matthew P. Smith of the Court of Common Pleas of Cumberland County held oral argument on the attempt by PDC to overturn the decision of the Silver Spring Township’s Board of Supervisors to deny PDC’s Land Development Plan. After argument, Judge Smith took the matter under advisement and will render a decision at some point in the future. We anticipate that his decision should come within about a month.

BACKGROUND
PDC has indicated that it is the equitable owner of approximately 122 acres of land in the Township with addresses of 401 Mulberry Drive and 107 Texaco Road. On February 5, 2024, PDC submitted an application with the Township for approval of construction of a 1,205,280 square foot warehouse, which it claimed would be used for the storage, transfer, and distribution of consumer goods. PDC indicated throughout the process that no end user had been identified.

Silver Spring Township in its land development ordinance requires that the developer provides a traffic impact report for a new development which contains an estimate of the vehicular impact of the use of the property. The developer is directed to utilize the Institute of Transportation Engineers Trip Generation Report in making this estimate. During the application process, PDC utilized the code for a nonfulfillment warehouse. However, at a hearing on the application, PDC’s engineer admitted that this could be an improper code, since the user of the property may be a fulfillment warehouse, which would generate considerably more trips than PDC estimated. The result of which is that the road improvements and traffic impact fees of the project would be inadequate and not protect the people of Silver Spring. The Silver Spring Township Board of Supervisors denied the application, and PDC appealed.

THE PROCEEDING
As a result of the appeal, both parties have filed briefs, and the proceeding with Judge Smith gave the parties an opportunity to present their arguments to the judge. It also gave the Judge an opportunity to ask questions.

During the argument, the judge, while not giving away how he would rule, did indicate that code was an objective standard, and it seemed that he believed it was at the discretion of the Board of Supervisors to determine if the correct code, and therefore the estimate of traffic was correct.

The parties now await the court's decision, which will be posted here when issued.

A win for township residents

On April 23, 2025, the Board of Supervisors approved Ordinance 2025-03, which makes Warehouses and Wholesale Trade Establishment a conditional use (rather than a by-right use) in the General Industrial Zone (I-2). This change will affect any new plans submitted.
