The Notepad team ("we," "us," or "our") is committed to protecting the privacy of our users ("users" or "you"). This Privacy Policy (the "Policy") explains how we, as the controller and/or business entity, collect, store, use, manage, and protect your user information (including your Personal Information), in accordance with applicable data protection laws, when you use the Notepad application, including all its features ("our Service" or "Notepad").
Please note that the scope of this Policy is limited to your user information (including your Personal Information) that we collect or receive when you use the Service. For the purposes of this Policy, "Personal Information" means any information or combination of information that can be used to identify, contact, or locate the individual about whom the information is collected. This Personal Information may include your name, gender, phone number, email address, date of birth, image, geolocation, personal identification number, biometric information, and financial information. This Policy is part of and incorporated into the Notepad Terms of Service (the "Terms of Service").
This Policy sets out the basis on which any personal data we collect from you or that you provide to us will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. By accessing or using our websites, services, applications, products, and content (including but not limited to our platform) (collectively, the "Services"), you accept and consent to the practices described in this Policy. Capitalized terms not defined in this Policy have the meanings ascribed to them in our Terms of Service.

By using our Services, you agree to this Policy and consent to our collection, use, processing, retention, disclosure, and sharing of your user information, including your Personal Information, in the manner set forth in this Policy. If you disagree with any term of this Policy or any subsequent changes to this Policy, please do not use our Services.
Types of Personal Information We Use We may collect and use the following information about you:
1. Information about your device, including its International Mobile Equipment Identity ("IMEI"), Unique Device Identifier ("UDID") or Android ID, Identifier for Advertising ("IDFA"), Identifier for Vendor ("IDFV"), Integrated Circuit Card Identifier ("ICCID"), Media Access Control ("MAC") address, time zone setting, language selection, device type, operating system version, list of mobile applications installed on the device, and screen resolution. We use this information for statistical and/or analytical purposes.
2. Location Data. When you use the Platform on a mobile device, we may process your location information using the Global Positioning System (GPS), including location information based on your SIM card, IP address, or mobile device location settings, as well as location information (GPS) activated on your mobile device. If you do not want to share your location with us, you can turn off the GPS function on your mobile device.
3. Mobile Analytics. We use mobile analytics software to better understand and improve the functionality of our services. Such software may record information such as how often you use an application, events that occur within an application, overall usage and performance data, and the location from which the application was downloaded. 4. Log Information. When you use certain services (including generating and viewing certain content), we automatically collect certain relevant log information stored in our services ("Log Information"). This Log Information may include: a. details about the time and frequency of your service use; and b. device statistics, including key operational paths, errors, crashes, language, and time zone. This log information is used to improve our services and is not used to individually identify our users.
5. Information Collected by Third-Party Services. The services we provide to you may include application programming interfaces (APIs) or software development kits (SDKs) from our service providers, which may include tracking tools from such service providers. These third parties may use the APIs and SDKs in our services and collect and analyze user information. Third parties may have access to your information, such as your device identifier, region (defined as a location where a specific language is spoken), location information, and IP address, in accordance with their respective privacy policies.
We use this information to improve our services and conduct statistical analysis. It is used to enhance user experience.
Information Sharing and Disclosure: We will not share or disclose your personal information, in whole or in part, with third parties (other than our service providers) except for the following purposes: a) protecting the safety of others or their property; b) preventing or addressing fraud; c) protecting our legal rights; d) complying with laws and regulations generally designed to protect internet security and the rights, property, and safety of us, our users, third parties, or government agencies, judicial authorities, law enforcement officials, or private parties; and e) evaluating or completing transactions in connection with mergers, acquisitions, financing due diligence, reorganization, bankruptcy, administration, sale of company assets, or other events in which your information may be sold or transferred.
Information Security: We take steps to ensure that your information is treated securely and in accordance with this Policy. Unfortunately, the transmission of information via the internet is not completely secure. Although we use encryption and other means to protect your personal data, we cannot guarantee the security of information transmitted through our services; any transmission is at your own risk. We may modify it from time to time to improve the overall security of our systems. Data Retention: We will retain your information (including your Personal Information) for as long as necessary to fulfill our business or legal purposes, in accordance with applicable laws and regulations, and so that we can continue to provide you with our services.
Privacy: Under applicable laws, you have the right to request confirmation that we are processing your Personal Information; access your Personal Information or a copy of your Personal Information; receive an electronic copy of the Personal Information you provided to us, or request that we send that information to another company (the "right to data portability"); object to or restrict our use of your Personal Information; seek correction or amendment of inaccurate, untrue, incomplete, or misprocessed Personal Information; withdraw your consent; and request deletion of Personal Information we hold about you, subject to certain exceptions provided by law. We will process your request within a reasonable time after receiving your email or post, in accordance with applicable law, and will cease collecting, using, and disclosing your Personal Information, subject to certain exceptions provided by law. To protect your privacy, we will take steps to verify your identity before implementing your request. Please note that if you withdraw your consent or delete your Personal Information, your use of some of our services may be affected.
California residents have the right not to receive discriminatory treatment from us for exercising their rights under the California Consumer Privacy Act.
Children's Information: We do not knowingly collect or solicit personal information from children under the age of 13 (additional restrictions may be set forth in the "Supplemental Terms - Specific Jurisdictions"). If you are under 13, please do not send us your personal information, including your name, address, telephone number, or email address. If we discover that we have collected personal information from a child under the age of 13 (or any other age specified by applicable law in your jurisdiction), we will promptly take steps to delete such information.
Cross-Border Data Transfers: You understand and agree that all information collected by or through us may be transferred, processed, and stored anywhere in the world, including, but not limited to, Singapore, China, the cloud, our servers, the servers of our affiliates, or the servers of our service providers, in order to provide the Services.
Governing Law: Except as provided in the "Supplemental Terms - Specific Jurisdictions," this Policy, its subject matter, and its formation shall be governed by the laws of Singapore. Any dispute arising out of or in connection with this Policy, including any question regarding the existence, validity or termination of this Policy, shall be referred to and finally settled by arbitration at the Singapore International Arbitration Centre (“SIAC”) in accordance with the following rules: the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in effect, which are deemed to be incorporated herein by reference. The place of arbitration shall be Singapore. The arbitral tribunal shall consist of three (3) arbitrators. The language of the arbitration shall be English.
Amendments to this Policy: You agree that we may update this Policy in accordance with relevant laws and regulations or our business decisions, and you agree to be bound by any such amendments. We will post any material changes to this Policy on Notepad or notify you by other means as required by law.
