Terms and Conditions for Uploading and Selling Notes on Notefy

Welcome to Notefy. These Terms and Conditions ("Terms") govern the process of uploading, approving, and selling notes on our platform. By submitting notes for upload, you agree to comply with these Terms.

1. Eligibility

1.1. Users must be at least 18 years old or have obtained parental/guardian consent to upload notes to Notefy.

1.2. Users must have full ownership rights or the necessary permissions to upload the notes. 1.3. Notes must not contain any copyrighted, plagiarized, defamatory, or inappropriate content.

2. Submission and Approval of Notes

2.1. All uploaded notes are subject to review and approval by Notefy’s moderation team. 2.2. Notefy reserves the right to reject, remove, or modify any content that violates these Terms or does not meet quality standards.

2.3. The approval process may take up to 5 business days.

3. Payment Structure

3.1. Base Payment: Upon approval of submitted notes, the user will receive a nominal compensation of Rs. 2 per page.

3.2. Revenue Share: Users will receive 10% of every purchase made of their notes, calculated based on the final sale price set by Notefy.

3.3. Charity Contribution: The remaining revenue from note sales, after deducting the user’s share, will be transferred directly to a charity or NGO selected by Notefy. (ie. SalaamBombay)

3.4. Payments will be made to the user's designated bank account or preferred payment method on a [monthly/quarterly] basis.

4. Pricing and Sales

4.1. Notefy retains the right to set, modify, or discount the pricing of notes for promotional purposes.

4.2. Users will be notified in advance of any significant changes in the pricing structure.

4.3. Notes once sold are non-refundable to the buyer, except in cases of technical issues.

5. Ownership and Licensing

5.1. By uploading notes, users grant Notefy a non-exclusive, worldwide, royalty-free license to store, distribute, and sell the notes on the platform.

5.2. Users retain intellectual property rights over their uploaded notes but agree that Notefy has full control over the sales process.

5.3. Users cannot request the removal of their notes if they have already been sold to customers, but they may request the removal of future sales at any time.

6. User Responsibilities

6.1. Users must ensure their notes are original and do not infringe upon any third-party rights.

6.2. Users must not engage in fraudulent activities, including artificially inflating sales or submitting duplicate content.

6.3. Any disputes related to ownership of uploaded notes must be resolved by the user. Notefy is not responsible for legal claims arising from disputes over intellectual property.

7. Content Moderation Policy

7.1. Notefy reserves the right to reject, modify, or remove any content that:

• Violates copyright laws or intellectual property rights.

• Contains offensive, defamatory, or inappropriate material.

• Does not meet the quality standards set by Notefy.

7.2. Users may appeal content rejection by contacting Notefy within 5 days of notification.

8. Governing Law and Dispute Resolution

8.1. These Terms shall be governed by and interpreted in accordance with the laws of India.

 8.2. Any disputes arising from these Terms shall first be resolved through negotiation. If unresolved, disputes may be referred to arbitration in India.

9. Data Privacy and Security

9.1. Notefy is committed to protecting user data and complies with applicable data protection laws, including [GDPR/IT Act of India].

9.2. User payment details, uploaded content, and personal data will be stored securely and will not be shared with third parties without user consent, except as required by law.

9.3. Users may request deletion of their personal data and uploaded notes by submitting a formal request to Notefy support.

10. Termination and Account Suspension

10.1. Notefy reserves the right to suspend or terminate a user’s account if they are found violating these Terms.

10.2. Users found engaging in fraud, copyright violations, or abusive behaviour may face permanent bans.

10.3. Upon termination, pending payments will be processed as per the standard payout schedule unless there is an ongoing investigation.

11. Limitation of Liability

11.1. Notefy is not liable for any loss of revenue, data, or reputation due to unforeseen technical issues or policy changes.

11.2. Notefy makes no guarantees regarding the number of sales a user’s notes may generate.

11.3. Users agree to indemnify Notefy against any claims arising from their uploaded content.

12. Amendments and Updates

12.1. Notefy reserves the right to modify these Terms at any time. Users will be notified of significant changes via email or platform notifications.

12.2. Continued use of Notefy after updates to these Terms constitutes acceptance of the revised Terms.

By uploading notes to Notefy, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

Welcome to Notefy. These Terms and Conditions ("Terms") govern the process of purchasing notes on our platform. By purchasing notes, you agree to comply with these Terms.

1. Eligibility

1.1. Buyers must be at least 18 years old or have obtained parental/guardian consent to purchase notes on Notefy.

1.2. Buyers must provide accurate and complete account information during registration and transactions.

2. Purchasing and Pricing

2.1. The price of each note is determined by Notefy and is displayed on the platform.

2.2. Notefy reserves the right to modify prices, offer discounts, or introduce promotional campaigns at any time.

2.3. The final price payable includes any applicable taxes, processing fees, or other charges.

3. Payment Terms

3.1. Payments must be made through the available payment gateways provided by Notefy. 3.2. Buyers agree to provide accurate billing and payment information.

3.3. Notefy is not responsible for any transaction failures due to incorrect payment details or insufficient funds.

4. Delivery and Access

4.1. Upon successful payment, buyers will receive immediate access to the purchased notes via their Notefy account.

4.2. Purchased notes will be available for download or access through the Notefy platform, subject to any limitations specified by Notefy.

4.3. Notefy does not guarantee lifetime access to purchased notes, and content may be removed due to legal, copyright, or other regulatory reasons.

5. Refund and Cancellation Policy

5.1. Purchases made on Notefy are non-refundable unless a technical issue prevents access to the purchased notes.

5.2. Refund requests must be submitted within 5 days of purchase, along with proof of the issue.

5.3. If a refund is approved, the amount will be credited back to the original payment method within 7 business days.

6. Intellectual Property and Usage Rights

6.1. Purchased notes are for personal use only and may not be copied, resold, distributed, or shared without explicit permission.

6.2. Unauthorized distribution of purchased notes will result in account termination and potential legal action.

6.3. All intellectual property rights of the notes remain with the original author.

7. Prohibited Activities

7.1. Buyers must not attempt to:

• Reverse-engineer, duplicate, or modify purchased content.

• Distribute, publish, or resell notes without authorization.

• Use automated systems (bots, scripts) to access or scrape content from Notefy.

• Engage in fraudulent activities, including unauthorized chargebacks.

8. Data Privacy and Security

8.1. Buyer information is handled in compliance with applicable data protection laws, including [GDPR/IT Act of India].

8.2. Notefy does not store sensitive payment information; all transactions are processed through secure third-party payment providers.

8.3. Buyers may request account deletion and data removal by contacting Notefy support.

9. Account Suspension and Termination

9.1. Notefy reserves the right to suspend or terminate a buyer’s account for:

• Violations of these Terms.

• Unauthorized distribution or misuse of purchased content.

• Fraudulent payment activities.

9.2. Buyers whose accounts are terminated due to violations will not receive refunds for previously purchased content.

10. Limitation of Liability

10.1. Notefy does not guarantee the accuracy, completeness, or usefulness of any notes purchased on the platform.

10.2. Buyers acknowledge that notes are uploaded by independent users and Notefy is not responsible for any errors, outdated content, or misinterpretations. 10.3. Notefy shall not be liable for any loss, damages, or claims arising from the use of purchased notes.

11.1. Notefy reserves the right to modify these Terms at any time. Buyers will be notified of significant changes via email or platform notifications.
