Welcome to the website of the North Fayette Parent Teacher Organization (“PTO,” “we,” “our,”or “us”). This website exists to support our mission of promoting family engagement and supporting student success through volunteerism and community events. By using this website, you agree to the terms, disclaimers, and policies outlined below. If you do not agree, please do not use this website.
1. Disclaimer of Affiliation
The North Fayette PTO is a nonprofit, volunteer-run organization. We are not affiliated with, sponsored by, or representing the Fayette County School System, its schools, or administrators. Any views, content, or communications on this site are the independent work of the PTO.
2. Acceptable Use
You agree to use this website lawfully and respectfully. Prohibited conduct includes, but is not limited to:
a. Posting or transmitting offensive, defamatory, or unlawful content;
b. Misrepresenting your identity or affiliation;
c. Attempting to interfere with the website's functionality or security;
d. Using this site or its contents for commercial or promotional purposes without written consent;
e. Reusing, copying, or distributing site materials, especially images of children, without express permission.
3. Intellectual Property and Image Restrictions
All content on this site, including text, graphics, logos, photos, videos, event materials, and documents, is the property of the PTO or used with permission.
You may not:
a. Download, screenshot, copy, repost, distribute, or alter any image, especially of children or families;
b. Use any PTO logos, event materials, or text without written approval;
c. Reuse any content from this site for commercial or public purposes without prior consent.
All rights are reserved.
4. User Responsibilities
You agree that:
a. You will comply with these terms and all applicable laws;
b. You will not share or repost photos of other children, families, or volunteers without permission;
c. You are solely responsible for any content you submit via email, forms, or comments.
d. You will notify us promptly if you become aware of any misuse of the site or media.
5. Privacy Policy
We value your privacy. The PTO does not collect personally identifiable information unless you voluntarily provide it (e.g., signing up for emails or submitting donations).
Third-party tools used on the site (such as PayPal, Square, or Google Analytics) may collect information via cookies or payment forms. These tools have their own privacy policies, and we are not responsible for how they collect or use your data.
We do not knowingly collect information from children under 13 in compliance with the Children’s Online Privacy Protection Act (COPPA). If you believe we have done so inadvertently, please contact us and we will delete the information promptly.
6. Donations, Events & Newsletters
Donations are processed through secure third-party platforms. The PTO does not store or access your financial information.
Event Participation is voluntary. The PTO is not liable for injuries, damages, or losses incurred during events.
Email Newsletters are optional. You may unsubscribe at any time. Your email address will not be sold or shared.
7. Photo and Media Use Policy
Photographs or videos of PTO events may be posted on this site or our affiliated social media. If you wish to opt out of photo use for yourself or your child, please contact us at nfepto@gmail.com
You may not:
a. Use, repost, download, or distribute any images from this site;
b. Share or republish images of children or families without prior written consent from the PTO and the legal guardian of the child.
c. Unauthorized use of media from this site may result in legal action.
8. Disclaimers
Content is provided “as is,” without warranties of any kind.
The PTO is not responsible for any errors, omissions, or damages related to the use of the site.
Third-party links are provided for convenience only. We do not control and are not responsible for those sites.
9. Limitation of Liability & Indemnification
To the fullest extent permitted by law:
a. You release and hold harmless the PTO, its officers, members, and volunteers from any claims or damages related to your use of the site or participation in PTO activities.
b. You agree to indemnify and defend the PTO against any third-party claims arising from your breach of these terms or misuse of the website.
10. Dispute Resolution: Mediation and Arbitration
Any dispute arising out of or relating to your use of this website or PTO activities shall be resolved as follows:
a. Mediation
The parties will first attempt to resolve disputes through informal negotiation. If that fails, they agree to confidential, non-binding mediation with a mutually agreed-upon mediator in Fayette County, Georgia.
b. Arbitration
If mediation does not resolve the dispute within 30 days of written notice, the parties agree to submit the matter to binding arbitration under the rules of the American Arbitration Association (AAA) or another agreed-upon forum. Arbitration will be conducted in Fayette County, Georgia, and judgment may be entered on the award.
c. Class Action Waiver
Disputes must be resolved individually. Class actions and collective proceedings are not permitted.
d. Exception for Equitable Relief
The PTO may seek injunctive relief in court to address unauthorized use of its intellectual property or misuse of children’s images.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Georgia. Any permitted court proceeding must take place in Fayette County, Georgia.
12. Severability and Modification
If any provision of this policy is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
We reserve the right to update or modify these Terms at any time. Continued use of the website after changes are posted constitutes your acceptance of those changes.
