Acceptance of Terms
By downloading or using Noir Metronome (the “App”), you agree to these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.
Description of the Service
Noir Metronome is a premium-style metronome app with a black and gold visual design, designed to help users practice rhythm, timing, tempo control, and musical focus. The App may include features such as:
Accurate metronome playback
Adjustable BPM settings
Multiple metronome sounds
Beat, accent, and rhythm pattern options
BPM Ramp features for gradual tempo changes
Visual beat indicators or pulse animations
Practice presets, saved settings, or recent tempo records, if available
Sound and/or vibration feedback, if supported and enabled
Optional notification features for practice reminders, if available
Optional copy, export, or share features for practice settings or results, if available
The App is provided “as is” for personal and non-commercial use.
Permissions and Device Features
Noir Metronome is designed to work without requiring account sign-in. Depending on your device and enabled features, the App may request access to certain device permissions or system features, such as:
Internet access, for ads, billing, analytics, crash reporting, or optional remote content
Notification access, for practice reminders, if supported and enabled
Vibration access, for haptic beat feedback, if supported and enabled
Audio-related device features, for metronome sound playback and sound feedback
Photos / Media / Storage access, only if the App provides save, export, or share features that require file access
If you deny required permissions, some features may not function properly or may be unavailable.
User Responsibilities
You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:
Reverse engineer, decompile, or modify any part of the App
Use the App to distribute malware, spam, or harmful content
Attempt to gain unauthorized access to the App’s data or systems
Misuse the App, advertisements, billing features, or reward-based features
Use the App in a way that infringes the rights of others
You are solely responsible for how you use the App and for any settings, presets, screenshots, practice records, or other content you choose to save, export, copy, or share from the App.
Accuracy and Use Disclaimer
Noir Metronome is provided as a general music practice and rhythm-training tool for convenience only. While we aim to provide a reliable experience, we do not guarantee that all BPM timing, sound playback, beat indicators, BPM Ramp behavior, saved records, or app behavior will always be accurate or error-free in all situations.
Metronome timing and playback may be affected by factors such as device hardware, operating system behavior, audio latency, Bluetooth or wireless audio delay, battery-saving modes, background apps, device performance, and speaker or headphone conditions.
You are responsible for verifying any important timing, tempo, or practice results before relying on them. The App is not intended for legal, medical, safety-critical, emergency, professional certification, or professional performance decision-making use. Flowbit Labs is not responsible for decisions or outcomes based on information shown, played, or stored in the App.
Advertisements and Purchases
The free version of the App may display advertisements through Google AdMob or similar third-party networks. We may also offer:
In-app purchases to remove ads or unlock premium features, if applicable
Rewarded ads that may temporarily unlock benefits or extra features, if applicable
All purchases are handled through the official Google Play Store billing system, and refunds are processed according to Google’s policies. We do not provide direct refunds outside of what is supported by Google Play.
Disclaimer of Warranties
The App is provided “as is” without warranties of any kind, express or implied. We do not guarantee that the App will always function without interruption, error, defect, timing issue, playback issue, or compatibility issue, or that any issues will be corrected immediately. Use of the App is at your own risk.
Limitation of Liability
To the fullest extent permitted by law, Flowbit Labs is not liable for any direct, indirect, incidental, or consequential damages resulting from:
Your use or inability to use the App
Any inaccurate BPM timing, beat playback, visual beat indicator, BPM Ramp behavior, saved record, or practice result
Any loss of local practice history, presets, saved BPM values, sound settings, ramp settings, cached data, preferences, or practice records due to device issues, OS updates, storage limitations, permission changes, or app crashes
Any audio playback, vibration, notification, export, sharing, billing, or advertisement-related issues
Any actions or failures of third-party services such as advertising networks, analytics providers, crash reporting tools, sharing components, notification services, or billing services
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
Termination
We may suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms or misuse the service. You may also stop using and uninstall the App at any time.
Updates and Changes
We may update or modify these Terms from time to time. The updated version will take effect once it is posted with a new “Last updated” date. Continued use of the App after such updates means you accept the revised Terms.
We may also update the App itself, for example through new features, bug fixes, UI changes, metronome timing adjustments, BPM Ramp improvements, sound updates, performance improvements, compatibility updates, or advertisement-related updates.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law principles.
