Terms of Service

IMPORTANT: This app is a decision-support tool only. It does not provide medical, legal, financial, or psychological advice. All final decisions are solely your responsibility.
The following terms are defined as follows in these Terms of Service:
- "Service" refers to the mobile application "AI Council – Decision Support" and all associated features.
- "We" or "Us" refers to the developer operating the Service (nkfactory).
- "User" refers to any person who accesses or uses the Service.
- "External AI Service" refers to third-party AI services (such as OpenAI) used by this Service to generate outputs.
- "Deliberation" refers to the process by which multiple AI personas analyze a topic submitted by the User and generate reference information.
2-1. The Service is an AI-powered tool designed to assist Users in thinking through decisions.
2-2. The Service does NOT constitute any of the following:
- Medical diagnosis, medical advice, or psychological counseling
- Legal consultation or legal advice
- Investment advice, tax advice, or financial planning
- Any form of judgment, certification, or determination by a public authority
2-3. All AI-generated content, including verdicts such as 'Approved' or 'Rejected,' is reference information only. Such outputs carry no legal, official, diagnostic, or binding effect of any kind.
2-4. All decisions and actions taken based on use of the Service are solely the User's responsibility.
3-1. AI-generated outputs from this Service may:
- Contain factually incorrect information (hallucinations).
- Fail to reflect the most current information.
- Not be suitable for any specific purpose.
- Not guarantee any future outcome or result.
3-2. We make no warranties regarding the accuracy, completeness, timeliness, or fitness for purpose of any AI output.
3-3. Using AI output from this Service as the direct basis for the following decisions is outside the intended scope of the Service:
- Medical treatment, medication, or surgical decisions
- Legal proceedings, litigation, or contract execution
- Major financial decisions including investments or asset disposals
- Major life changes such as divorce, resignation, or relocation
4-1. This Service uses AI services provided by OpenAI, LLC (e.g., GPT-4o mini) to generate AI outputs.
4-2. Topics and questions entered by Users will be transmitted to External AI Services for processing. This may involve international data transfers.
4-3. We are not responsible for any changes, outages, or quality variations in External AI Services.
4-4. Users must not use this Service in ways that violate the terms of service of any External AI Service.
5-1. Users are solely responsible for all content they input into the Service.
5-2. The following types of input are prohibited:
- Personally identifiable information about third parties (names, addresses, contact details, etc.)
- Content that defames or violates the privacy of third parties
- Sensitive information about third parties including health, mental status, or criminal history
- False or unlawful information
- Content that infringes third-party copyrights or intellectual property rights
5-3. This Service is not designed for inputting personal or sensitive third-party information. Users bear full responsibility for any consequences arising from such inputs.
6-1. The Service provides statistical reference indicators (such as Deliberation Trend Reports) compiled from past deliberation history.
6-2. Statistical display outputs have the following characteristics:
- They are statistical reference information based on past deliberation data only.
- They do not constitute psychological diagnosis, personality assessment, or mental health evaluation.
- They do not constitute medical, psychological, legal, financial, or any other professional advice or diagnosis.
- They carry no legal evidentiary value, official authority, or contractual effect.
6-3. Displayed values such as confidence scores and conflict axes are AI-generated reference indicators and should not be interpreted as definitive measurements.
7-1. Paid plan Users may access long-term storage of deliberation history.
7-2. Long-term storage is provided on a conditional basis, subject to the following terms:
- Deliberation history is accessible during an active paid subscription.
- After cancellation, access may be restricted to read-only for a period determined by Us.
- Accounts inactive for 2 or more years may be subject to archiving.
- Accounts inactive for 5 or more years may have data deleted after advance notice.
- Data storage is not guaranteed in the event the Service is discontinued.
7-3. Stored deliberation history does not constitute an official document, legal record, or certified proof of any kind.
7-4. Users may request deletion of their data at any time. Deletion requests take priority over all other retention conditions.
8-1. Users may delete their account at any time.
8-2. Upon account deletion request, We will delete the User's Firebase Authentication credentials and associated Firestore data. Complete deletion will be carried out within a maximum of 30 days from the request.
8-3. Due to backup system processing times, deletion may not be instantaneous. Submission of a deletion request does not mean immediate complete deletion.
8-4. In the event We reasonably confirm a User has passed away, We may deactivate or delete the account. We do not guarantee inheritance or transfer of account data.
9-1. This Service is not designed to provide emotional support or to foster dependency.
9-2. If you are experiencing significant difficulty making decisions or are in emotional distress, please consult a qualified professional such as a doctor or counselor.
9-3. We are not responsible for any harm arising from excessive reliance on this Service.
10-1. The Service offers multiple plans: Free, Pro, and Ultra.
10-2. Paid plans are monthly auto-renewing subscriptions.
10-3. Payment will be charged to your Apple ID account at the time of purchase confirmation.
10-4. Renewal charges will be applied within 24 hours before the end of each billing period.
10-5. Subscriptions will automatically renew unless cancelled at least 24 hours before the end of the current period.
10-6. Subscriptions can be managed and cancelled through your App Store account settings.
10-7. Refunds are generally not provided except as required by Apple's policies.
11-1. Our total liability to any User shall not exceed the amount paid by that User in the one month immediately preceding the claim.
11-2. We are not liable for the following:
- Damages arising from reliance on AI output
- Indirect, special, incidental, or consequential damages
- Loss of profits, business opportunities, or data
- Emotional or psychological damages
- Damages caused by outages, changes, or failures of External AI Services
- Claims from third parties arising from User-submitted content
11-3. The above limitations do not apply in cases of our willful misconduct or gross negligence.
The following activities are prohibited:
- Using the Service for any unlawful purpose
- Using the Service in violation of any External AI Service's terms
- Unauthorized access, reverse engineering, or tampering with the Service
- Interfering with other Users' use of the Service
- Using the Service to harass or defame any person
- Commercially reselling or redistributing the Service without our permission
13-1. We may modify, add to, suspend, or discontinue the Service at any time without prior notice.
13-2. In the event of Service termination, We will endeavor to provide advance notice through the app or this page where reasonably possible.
13-3. We do not guarantee data preservation or migration upon Service termination.
14-1. We reserve the right to update these Terms at any time. Updated Terms take effect upon posting to the app or this page.
14-2. Continued use of the Service after updated Terms are posted constitutes acceptance of the updated Terms.
15-1. These Terms are governed by the laws of Japan.
15-2. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Japanese court having jurisdiction over the location of our principal place of business.
