By using our application, you agree to the Standard Apple Licensed Application End User License Agreement.
We are NguyenPhuc AnhThu Limited ("NguyenPhuc AnhThu", "we", "us"), a developer of mobile game applications that are made available via app stores including the Apple App Store and Google Play Store (our "Games").
As a precondition for using the services, you must agree to these Terms of Service ("Agreement"). By using or otherwise accessing the services, you agree to the Agreement. If you do not agree to the Agreement, you may not use or otherwise access the services.
Unless otherwise specified by a component of the applicable service, the services are free to use or download but may contain features that allow purchases within the services.
1. About
By downloading one of our Games, you accept this Agreement and our Privacy Policy. Your relationship with NguyenPhuc AnhThu will be subject to these and only this Agreement and our Privacy Policy.
Each time you download one of our Games to your device a new Agreement is concluded and its terms apply to your use of that Game. Application stores and platforms may provide their own terms that apply to your relationship with those stores and platforms.
You represent that you are 13 years or older. If you are younger than 18 years, you may only download our Games and play them if your parent or legal guardian has reviewed this Agreement and allowed you to do so. NguyenPhuc AnhThu may require adequate proof of identity, age, and guardian consent at any time.
You represent that you are accessing our Games as a private person. Any commercial use of our Games is not allowed.
2. End-User License Agreement
2.1. License
Subject to the terms of this Agreement, NguyenPhuc AnhThu grants you a non-transferable, non-exclusive, license to (a) use for your personal use, and (b) copy for the purpose of downloading, installing and executing the number of copies for which you are authorized by the download site of each Game on a mobile device that you own or control for your use (the “License”).
2.2. Certain Restrictions
The rights granted to you are subject to these restrictions: you may not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit any Game; modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile, or reverse engineer any part of the Games except where prohibited by law; access any Game in order to build a similar or competitive service or application; copy, reproduce, distribute, republish, download, display, post, or transmit any part of any Game except as expressly stated herein; or remove or destroy any copyright notices or other proprietary markings contained on or in any Game.
Any future release, update, or other addition to the functionality of any Game, including in-app purchases, additional levels, and gameplay enhancements, is subject to this Agreement unless otherwise provided in terms associated with such addition. All copyright and other proprietary notices on any Game content must be retained on any copies.
2.3. Local Laws
You are solely responsible for compliance with all applicable laws, including without limitation export and import regulations.
2.4. Modification
NguyenPhuc AnhThu reserves the right, at any time, to modify, suspend, or discontinue the Games or any part thereof with or without notice. You agree that NguyenPhuc AnhThu will not be liable to you or to any third party for any modification, suspension, or discontinuance of any Game or any part thereof.
2.5 Ownership
Games provided to you are licensed and not sold. NguyenPhuc AnhThu and its licensors own all right, title, and interest, including all related intellectual property rights, in and to all Games, excluding your User Content. This Agreement is not a sale and does not convey to you any ownership rights in or related to any Game.
The NguyenPhuc AnhThu name, logo, and the product names associated with the Games belong to NguyenPhuc AnhThu or its licensors, and no right or license is granted to use them by implication, estoppel, or otherwise. NguyenPhuc AnhThu and its licensors reserve all rights not granted in this Agreement.
2.6. Ads
When you start or stop a Game, it may display an ad. During gameplay, banners, rewarded videos, and interstitial ads may be displayed.
3. User Content
User Content means any and all content that a user uploads, distributes, or otherwise provides via any Game. You are solely responsible for your User Content and assume all risks associated with its use, including any reliance on its accuracy, completeness, usefulness, or any disclosure that makes you or any third party personally identifiable.
You represent and warrant that your User Content does not violate the Acceptable Use Policy. You may not state or imply that your User Content is in any way provided, sponsored, or endorsed by NguyenPhuc AnhThu. NguyenPhuc AnhThu is not obligated to back up any User Content, and User Content may be deleted at any time.
3.1. License
By uploading, distributing, or otherwise using your User Content with any Game, you automatically grant NguyenPhuc AnhThu an irrevocable, non-exclusive, royalty-free, fully paid, worldwide license, with the right to grant sublicenses, to reproduce, distribute, publicly display, publicly perform, prepare derivative works of, incorporate into other works, and otherwise use your User Content solely to display your User Content in any Game.
3.2. Feedback
If you provide NguyenPhuc AnhThu any feedback or suggestions, you assign to NguyenPhuc AnhThu all rights in the feedback and agree that NguyenPhuc AnhThu has the right to use that feedback and related information in any manner it deems appropriate. NguyenPhuc AnhThu will treat any feedback as non-confidential and non-proprietary.
3.3. Acceptable Use Policy
You agree not to use any Game to upload, distribute, or otherwise use any User Content that violates any third-party rights; is tortious, defamatory, false, intentionally misleading, harassing, abusive, threatening, harmful, vulgar, obscene, offensive, pornographic, racist, discriminatory, or otherwise objectionable; harms minors; constitutes unsolicited advertising or spam; or violates any law, regulation, or contractual obligation.
You also agree not to use any Game to upload or distribute computer viruses, worms, or malicious code; collect information regarding other users without consent; disable, overly burden, impair, or interfere with servers or networks connected to the Games; attempt to gain unauthorized access; or interfere with another user's use and enjoyment of any Game.
3.4. Enforcement
NguyenPhuc AnhThu reserves the right, but has no obligation, to review any User Content in its sole discretion. User Content may be removed or modified at any time for any reason with or without notice.
4. Term and Termination
This User Agreement runs for an indefinite term. Either party may terminate the Agreement at any time by giving 14 days notice in written or electronic form. You may also terminate the Agreement with immediate effect by deleting the Game from your device or removing the Game from your Facebook apps.
If there are reasonable grounds to believe that you are in material breach of these Terms of Service, access to the Game may be suspended or the Agreement terminated. Either party may also terminate for cause without notice.
Upon expiry, you will no longer be able to access the Game that was the subject matter of the Agreement. In-game progress and any other Game-related data will be deleted. Any termination may involve deletion of User Content from live databases, and NguyenPhuc AnhThu will not have liability to you for such termination.
5. Indemnity
You agree to defend, indemnify, and hold harmless NguyenPhuc AnhThu and its suppliers from and against any claims, suits, losses, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, brought by third parties resulting from or relating to your use of any Game, your User Content, or your violation of this Agreement.
6. Third Parties
The availability of the Game depends on the third party from which you received it, for example the Apple App Store or Google Play. This Agreement is between you and NguyenPhuc AnhThu, not with the Application Store. The Application Store is not responsible for the Game, its content, maintenance, support services, warranties, or claims relating to it.
NguyenPhuc AnhThu may permit certain third-party applications, such as leaderboards or game networks, to provide content through the Game. Those services are offered only as a convenience. NguyenPhuc AnhThu does not control them and makes no representations or warranties with respect to them. You use all third-party services at your own risk and should review their own terms and privacy policies.
A Game may also contain User Content provided by other users. NguyenPhuc AnhThu does not control that content, does not approve or endorse it, and you interact with other users at your own risk.
7. Disclaimers
Games are provided "as-is" and as available, and NguyenPhuc AnhThu and its suppliers expressly disclaim any warranties and conditions of any kind, whether express or implied, including warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement.
NguyenPhuc AnhThu and its suppliers make no warranty that any Game will meet your requirements, be available on an uninterrupted, timely, secure, or error-free basis, or be accurate, reliable, complete, legal, or safe. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
8. Limitation on Liability
In no event shall NguyenPhuc AnhThu or its suppliers be liable to you or any third party for any lost profits or any indirect, consequential, exemplary, incidental, special, or punitive damages arising from or relating to this Agreement, NguyenPhuc AnhThu privacy practices, or any Game, even if NguyenPhuc AnhThu has been advised of the possibility of such damages.
Access to and use of any Game are at your own discretion and risk, and you will be solely responsible for any damage to your computer system or mobile device or loss of data resulting from that access or use. NguyenPhuc AnhThu liability to you for any damages arising from or related to this Agreement will at all times be limited to the amount you have paid NguyenPhuc AnhThu in the prior 12 months, if any.
9. Fees
Some parts of the service may offer virtual items or subscriptions. Virtual items are licensed to you on a limited, personal, non-transferable, non-sublicensable, and revocable basis and only for non-commercial use.
NguyenPhuc AnhThu may manage, control, modify, or eliminate virtual items at any time, with or without notice. Subject to mandatory legislation, purchases and redemptions of virtual items are final and non-refundable.
Subscriptions may be billed on a recurring basis through your App Store or Google Play account. Trial subscriptions, automatic renewals, cancellations, and billing matters are governed by the platform through which the app was downloaded. Except when required by law, paid subscription fees are non-refundable.
10. Miscellaneous
This Agreement is subject to occasional revision, and any substantial changes may be posted on the site or sent by email notice where applicable. Continued use of the Games following notice of such changes indicates acknowledgement and agreement to be bound by the updated terms.
If any provision of this Agreement is held to be invalid or unenforceable, the other provisions remain unimpaired, and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.
This Agreement is the final, complete, and exclusive agreement between you and NguyenPhuc AnhThu with respect to the subject matter hereof and supersedes all prior discussions and agreements.

11. Apple Application Store Additional Terms and Conditions
If you are using a Game from the Apple Application Store, the additional terms and conditions in this section apply. To the extent the other terms of this Agreement are less restrictive than, or otherwise conflict with, the terms in this section, the more restrictive Apple-related terms apply.
NguyenPhuc AnhThu and you acknowledge that this Agreement is concluded between NguyenPhuc AnhThu and you only, and not with Apple. NguyenPhuc AnhThu, not Apple, is solely responsible for the Game and the content thereof, for maintenance and support services, for product warranties to the extent not effectively disclaimed, and for addressing any claims relating to the Game, including intellectual property claims.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you once you accept its terms.
