TÉRMINOS Y CONDICIONES DE USO DE NEVERAI

1. IDENTIFICACIÓN
Estos Términos y Condiciones regulan el uso de la aplicación NeveRAi, titularidad de Oscar Mozo Gozalo, con domicilio en España.

2. ACEPTACIÓN
Al descargar, instalar o utilizar NeveRAi, aceptas estos Términos y Condiciones en su totalidad. Si no estás de acuerdo, no utilices la aplicación.
3. DESCRIPCIÓN DEL SERVICIO
NeveRAi es una aplicación que utiliza inteligencia artificial para generar sugerencias de recetas basadas en los ingredientes que el usuario introduce. El servicio se ofrece en modalidad freemium:
- Plan Gratuito: hasta 3 consultas diarias con recetas básicas.
- Plan Pro (4,99 EUR/mes o 39,99 EUR/año): consultas ilimitadas, información nutricional completa, planificación semanal y lista de la compra.
- Plan Family (7,99 EUR/mes o 59,99 EUR/año): todo lo incluido en Pro más perfiles múltiples para miembros de la familia.
4. REGISTRO Y CUENTA
Para acceder a determinadas funcionalidades, puede ser necesario crear una cuenta. Te comprometes a proporcionar información veraz y a mantener la confidencialidad de tus credenciales de acceso. Eres responsable de toda la actividad que se realice desde tu cuenta.
5. SUSCRIPCIONES Y PAGOS
Las suscripciones se gestionan a través de Apple App Store o Google Play Store. Al suscribirte:
- El pago se carga a tu cuenta de Apple o Google al confirmar la compra.
- La suscripción se renueva automáticamente salvo que la canceles al menos 24 horas antes del final del periodo en curso.
- Puedes gestionar y cancelar tu suscripción desde los ajustes de tu cuenta de Apple o Google.
- Los reembolsos se rigen por las políticas de Apple App Store y Google Play Store respectivamente.
Los precios pueden variar según el país y están sujetos a cambios con previo aviso.
6. USO ACEPTABLE
Te comprometes a utilizar NeveRAi de forma lícita y conforme a estos Términos. Queda prohibido:
- Utilizar la aplicación con fines ilegales o no autorizados.
- Intentar acceder a sistemas o datos no autorizados.
- Reproducir, duplicar, copiar, vender o revender cualquier parte del servicio.
- Utilizar la aplicación para generar contenido que infrinja derechos de terceros.
- Interferir con el funcionamiento normal de la aplicación.
7. PROPIEDAD INTELECTUAL
Todos los derechos de propiedad intelectual sobre NeveRAi (incluyendo diseño, código, marca, logotipos y contenido original) pertenecen a Oscar Mozo Gozalo. Las recetas generadas por la IA se proporcionan como sugerencias de uso personal.
8. LIMITACIÓN DE RESPONSABILIDAD
NeveRAi proporciona sugerencias de recetas generadas por inteligencia artificial con fines informativos. En particular:
- Las recetas son sugerencias automáticas y pueden contener errores o imprecisiones.
- NeveRAi NO sustituye el consejo de un profesional de la nutrición o la salud.
- El usuario es responsable de verificar los ingredientes respecto a alergias, intolerancias o condiciones médicas.
- La información nutricional proporcionada es estimada y puede variar.
- NeveRAi no se hace responsable de reacciones alérgicas, intoxicaciones u otros problemas derivados del seguimiento de las recetas sugeridas.
EL SERVICIO SE PROPORCIONA "TAL CUAL" SIN GARANTÍAS DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS.
9. DISPONIBILIDAD DEL SERVICIO
Nos esforzamos por mantener NeveRAi disponible de forma continua, pero no garantizamos un servicio ininterrumpido. Podemos realizar mantenimientos, actualizaciones o modificaciones sin previo aviso. No seremos responsables por interrupciones temporales del servicio.
10. MODIFICACIONES
Nos reservamos el derecho de modificar estos Términos en cualquier momento. Los cambios significativos se notificarán a través de la aplicación o por correo electrónico. El uso continuado de la aplicación tras la notificación implica la aceptación de los nuevos Términos.
11. RESOLUCIÓN
Podemos suspender o cancelar tu acceso a NeveRAi si incumples estos Términos, sin perjuicio de otras acciones legales que pudieran corresponder.
12. LEY APLICABLE Y JURISDICCIÓN
Estos Términos se rigen por la legislación española. Para la resolución de cualquier controversia, ambas partes se someten a los juzgados y tribunales de la ciudad de domicilio del responsable, salvo que la normativa de protección al consumidor establezca otra cosa.

2. ACCEPTANCE
By downloading, installing, or using NeveRAi, you accept these Terms and Conditions in full. If you do not agree, do not use the application.
3. SERVICE DESCRIPTION
NeveRAi is an application that uses artificial intelligence to generate recipe suggestions based on ingredients entered by the user. The service is offered on a freemium basis:
- Free Plan: up to 3 daily queries with basic recipes.
- Pro Plan (EUR 4.99/month or EUR 39.99/year): unlimited queries, complete nutritional information, weekly meal planning, and shopping list.
- Family Plan (EUR 7.99/month or EUR 59.99/year): everything in Pro plus multiple profiles for family members.
4. REGISTRATION AND ACCOUNT
To access certain features, you may need to create an account. You agree to provide accurate information and to maintain the confidentiality of your login credentials. You are responsible for all activity that occurs under your account.
5. SUBSCRIPTIONS AND PAYMENTS
Subscriptions are managed through Apple App Store or Google Play Store. By subscribing:
- Payment is charged to your Apple or Google account upon purchase confirmation.
- The subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
- You can manage and cancel your subscription from your Apple or Google account settings.
- Refunds are governed by Apple App Store and Google Play Store policies respectively.
Prices may vary by country and are subject to change with prior notice.
6. ACCEPTABLE USE
You agree to use NeveRAi lawfully and in accordance with these Terms. The following is prohibited:
- Using the application for illegal or unauthorized purposes.
- Attempting to access unauthorized systems or data.
- Reproducing, duplicating, copying, selling, or reselling any part of the service.
- Using the application to generate content that infringes third-party rights.
- Interfering with the normal operation of the application.
7. INTELLECTUAL PROPERTY
All intellectual property rights in NeveRAi (including design, code, brand, logos, and original content) belong to Oscar Mozo Gozalo. Recipes generated by AI are provided as suggestions for personal use.
8. LIMITATION OF LIABILITY
NeveRAi provides AI-generated recipe suggestions for informational purposes. In particular:
- Recipes are automatic suggestions and may contain errors or inaccuracies.
- NeveRAi does NOT replace the advice of a nutrition or health professional.
- The user is responsible for verifying ingredients regarding allergies, intolerances, or medical conditions.
- Nutritional information provided is estimated and may vary.
- NeveRAi is not responsible for allergic reactions, food poisoning, or other problems arising from following suggested recipes.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
9. SERVICE AVAILABILITY
We strive to keep NeveRAi continuously available but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications without prior notice. We shall not be liable for temporary service interruptions.
10. MODIFICATIONS
We reserve the right to modify these Terms at any time. Significant changes will be notified through the application or by email. Continued use of the application after notification implies acceptance of the new Terms.
11. TERMINATION
We may suspend or cancel your access to NeveRAi if you breach these Terms, without prejudice to any other legal actions that may apply.
12. GOVERNING LAW AND JURISDICTION
These Terms are governed by Spanish law. For the resolution of any dispute, both parties submit to the courts of the city of domicile of the data controller, unless consumer protection regulations provide otherwise.
