POLÍTICA DE PRIVACIDAD DE NEVERAI

1. RESPONSABLE DEL TRATAMIENTO

2. DATOS QUE RECOPILAMOS
NeveRAi recopila los siguientes datos:
- Datos de cuenta: dirección de correo electrónico (si te registras), idioma preferido y preferencias de cocina (restricciones alimentarias, número de comensales, nivel de cocina).
- Datos de uso: ingredientes introducidos, recetas consultadas, frecuencia de uso y funcionalidades utilizadas.
- Datos técnicos: tipo de dispositivo, sistema operativo, versión de la app, dirección IP anonimizada y país de acceso.
- Datos de suscripción: tipo de plan contratado y estado de la suscripción. Los pagos son procesados directamente por Apple (App Store) o Google (Google Play). NeveRAi NO almacena datos de tarjetas de crédito ni datos bancarios.
NeveRAi NO recopila ni solicita en ningún momento tu nombre real, dirección postal, número de teléfono ni datos biométricos.
3. FINALIDAD DEL TRATAMIENTO
Utilizamos tus datos para:
- Proporcionarte recetas personalizadas basadas en tus ingredientes y preferencias.
- Mejorar el funcionamiento y la experiencia de la aplicación.
- Gestionar tu suscripción y acceso a funcionalidades premium.
- Enviarte comunicaciones relacionadas con el servicio (nunca spam comercial de terceros).
- Generar estadísticas anónimas de uso para mejorar el producto.
4. BASE LEGAL DEL TRATAMIENTO
- Ejecución del contrato: para proporcionarte el servicio de NeveRAi (artículo 6.1.b RGPD).
- Interés legítimo: para mejorar el producto y prevenir fraude (artículo 6.1.f RGPD).
- Consentimiento: para comunicaciones opcionales y cookies no esenciales (artículo 6.1.a RGPD).
5. PROCESAMIENTO DE DATOS CON INTELIGENCIA ARTIFICIAL
NeveRAi utiliza servicios de inteligencia artificial proporcionados por Anthropic (Estados Unidos) para generar recetas personalizadas. Los únicos datos enviados a este servicio son:
- Los ingredientes introducidos por el usuario.
- Las preferencias de cocina: idioma, número de personas, restricciones alimentarias y nivel de cocina.
No se envían datos personales identificativos como nombre, email, teléfono ni ubicación. Las fotografías de ingredientes se procesan en tiempo real y no se almacenan en ningún servidor externo.
Este procesamiento se realiza conforme al artículo 49.1.b del RGPD (necesario para la ejecución del servicio solicitado por el usuario).
IMPORTANTE SOBRE ALÉRGENOS: Las recetas generadas por NeveRAi incluyen una lista de alérgenos detectados. Esta lista se genera de forma automatizada mediante inteligencia artificial y una validación posterior por software. Sin embargo, NeveRAi NO garantiza la detección completa de todos los alérgenos posibles. Si tienes alergias o intolerancias alimentarias, verifica SIEMPRE los ingredientes de cada receta antes de cocinar. NeveRAi no sustituye el consejo de un profesional médico o nutricionista.
6. CONSERVACIÓN DE DATOS
- Datos de cuenta: mientras mantengas tu cuenta activa. Si eliminas tu cuenta, los datos se borran en un plazo máximo de 30 días.
- Datos de uso: se anonimizan transcurridos 12 meses.
- Datos técnicos: se conservan un máximo de 6 meses.
- Datos enviados a la IA: no se almacenan. Se procesan en tiempo real y se descartan inmediatamente.
7. DESTINATARIOS DE LOS DATOS
Tus datos pueden ser compartidos con:
- Anthropic (Estados Unidos): recibe los ingredientes y preferencias de cocina para generar recetas mediante inteligencia artificial. No recibe datos personales identificativos. Procesamiento conforme al artículo 49.1.b RGPD.
- Proveedores de infraestructura (Cloudflare): para alojar y servir la aplicación y la API.
- Apple y Google: para gestionar las suscripciones in-app.
- RevenueCat: para la gestión técnica de suscripciones.
No vendemos ni compartimos tus datos personales con terceros con fines publicitarios.
8. TRANSFERENCIAS INTERNACIONALES
Algunos de nuestros proveedores de servicios están ubicados fuera del Espacio Económico Europeo (EEE), particularmente en Estados Unidos (Anthropic, Cloudflare). Estas transferencias se realizan con garantías adecuadas conforme al artículo 46 del RGPD, incluyendo cláusulas contractuales tipo aprobadas por la Comisión Europea, y conforme al artículo 49.1.b del RGPD cuando el procesamiento es necesario para la ejecución del servicio.
9. TUS DERECHOS
Como usuario, tienes derecho a:
- Acceso: solicitar una copia de tus datos personales.
- Rectificación: corregir datos inexactos.
- Supresión: solicitar la eliminación de tus datos (disponible directamente en la app en Perfil > Eliminar cuenta).
- Limitación: restringir el tratamiento de tus datos.
- Portabilidad: recibir tus datos en un formato estructurado.
- Oposición: oponerte al tratamiento basado en interés legítimo.

También puedes presentar una reclamación ante la Agencia Española de Protección de Datos (www.aepd.es).
10. SEGURIDAD
Implementamos medidas técnicas y organizativas para proteger tus datos, incluyendo:
- Cifrado en tránsito (HTTPS/TLS) en todas las comunicaciones.
- Token de autenticación entre la app y la API.
- Rate limiting para prevenir abuso del servicio.
- Almacenamiento local cifrado en el dispositivo.
- Acceso restringido a los sistemas.
11. MENORES
NeveRAi no está dirigida a menores de 16 años. No recopilamos conscientemente datos de menores de 16 años. Si detectamos que un menor ha proporcionado datos personales, los eliminaremos de inmediato.
12. CAMBIOS EN ESTA POLÍTICA
Nos reservamos el derecho de actualizar esta política. Te notificaremos de cambios significativos a través de la aplicación o por correo electrónico. La fecha de última actualización aparece al inicio del documento.

2. DATA WE COLLECT
NeveRAi collects the following data:
- Account data: email address (if you register), preferred language, and cooking preferences (dietary restrictions, number of diners, cooking level).
- Usage data: ingredients entered, recipes viewed, usage frequency, and features used.
- Technical data: device type, operating system, app version, anonymized IP address, and country of access.
- Subscription data: plan type and subscription status. Payments are processed directly by Apple (App Store) or Google (Google Play). NeveRAi does NOT store credit card or banking information.
NeveRAi does NOT collect or request your real name, postal address, phone number or biometric data at any time.
3. PURPOSE OF DATA PROCESSING
We use your data to:
- Provide personalized recipes based on your ingredients and preferences.
- Improve the app's functionality and user experience.
- Manage your subscription and access to premium features.
- Send you service-related communications (never third-party advertising spam).
- Generate anonymous usage statistics to improve the product.
4. LEGAL BASIS
- Contract performance: to provide you with the NeveRAi service (Article 6.1.b GDPR).
- Legitimate interest: to improve the product and prevent fraud (Article 6.1.f GDPR).
- Consent: for optional communications and non-essential cookies (Article 6.1.a GDPR).
5. AI DATA PROCESSING
NeveRAi uses artificial intelligence services provided by Anthropic (United States) to generate personalized recipes. The only data sent to this service is:
- The ingredients entered by the user.
- Cooking preferences: language, number of people, dietary restrictions and cooking level.
No personally identifiable data such as name, email, phone number or location is sent. Photos of ingredients are processed in real time and are not stored on any external server.
This processing is carried out in accordance with Article 49.1.b of the GDPR (necessary for the performance of the service requested by the user).
IMPORTANT ABOUT ALLERGENS: Recipes generated by NeveRAi include a list of detected allergens. This list is generated automatically using artificial intelligence and subsequent software validation. However, NeveRAi does NOT guarantee complete detection of all possible allergens. If you have food allergies or intolerances, ALWAYS verify the ingredients of each recipe before cooking. NeveRAi does not replace the advice of a medical professional or nutritionist.
6. DATA RETENTION
- Account data: retained while your account is active. If you delete your account, data is erased within 30 days.
- Usage data: anonymized after 12 months.
- Technical data: retained for a maximum of 6 months.
- Data sent to AI: not stored. Processed in real time and immediately discarded.
7. DATA RECIPIENTS
Your data may be shared with:
- Anthropic (United States): receives ingredients and cooking preferences to generate recipes using artificial intelligence. Does not receive personally identifiable data. Processing in accordance with Article 49.1.b GDPR.
- Infrastructure providers (Cloudflare): to host and serve the application and API.
- Apple and Google: to manage in-app subscriptions.
- RevenueCat: for technical subscription management.
We do not sell or share your personal data with third parties for advertising purposes.
8. INTERNATIONAL TRANSFERS
Some of our service providers are located outside the European Economic Area (EEA), particularly in the United States (Anthropic, Cloudflare). These transfers are carried out with appropriate safeguards under Article 46 of the GDPR, including standard contractual clauses approved by the European Commission, and under Article 49.1.b of the GDPR when processing is necessary for the performance of the service.
9. YOUR RIGHTS
As a user, you have the right to:
- Access: request a copy of your personal data.
- Rectification: correct inaccurate data.
- Erasure: request deletion of your data (available directly in the app under Profile > Delete account).
- Restriction: restrict processing of your data.
- Portability: receive your data in a structured format.
- Objection: object to processing based on legitimate interest.
To exercise your rights, write to us at hola@neverai.app. We will respond within 30 days.
You may also file a complaint with the Spanish Data Protection Agency (www.aepd.es).
10. SECURITY
We implement technical and organizational measures to protect your data, including:
- Encryption in transit (HTTPS/TLS) for all communications.
- Authentication token between the app and the API.
- Rate limiting to prevent service abuse.
- Encrypted local storage on the device.
- Restricted access to systems.
11. CHILDREN
NeveRAi is not intended for children under 16 years of age. We do not knowingly collect data from children under 16. If we detect that a minor has provided personal data, we will delete it immediately.
12. CHANGES TO THIS POLICY
We reserve the right to update this policy. We will notify you of significant changes through the application or by email. The last update date appears at the top of this document.
