1. ACCEPTANCE OF TERMS
By downloading, installing, or using the Nearby Places application ("App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.
2. DESCRIPTION OF SERVICE
Nearby Places is a mobile application that helps users discover nearby points of interest such as restaurants, cafes, pharmacies, banks, and other establishments. The App uses your device's location to display relevant places in your vicinity.
3. ELIGIBILITY
The App is available to users of all ages. No account registration is required to use the App.
4. LICENSE TO USE
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
5. USER RESPONSIBILITIES
By using the App, you agree to:
- Provide accurate location permissions for the App to function properly
- Use the App only for lawful purposes
- Not attempt to reverse engineer, modify, or tamper with the App
- Not use the App in any way that could damage, disable, or impair the service
6. LOCATION SERVICES
- The App requires access to your device's location to function
- You can enable or disable location services at any time through your device settings
- Disabling location services will limit the App's functionality
7. THIRD-PARTY SERVICES
The App uses Apple Maps for mapping and place search functionality. Your use of these features is also subject to Apple's Terms of Service and Privacy Policy.
8. ACCURACY OF INFORMATION
- Place information (names, addresses, phone numbers, websites) is provided by Apple Maps
- We do not guarantee the accuracy, completeness, or timeliness of this information
- Business hours, availability, and other details may change without notice
- Always verify important information directly with the establishment
9. INTELLECTUAL PROPERTY
- The App, including its design, features, and content, is owned by Nearby Places
- You may not copy, modify, distribute, or create derivative works based on the App
- All trademarks, logos, and service marks displayed in the App are our property or the property of their respective owners
10. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF INFORMATION
11. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, or business opportunities
- Any damages resulting from your use or inability to use the App
- Any damages resulting from reliance on information provided through the App
12. INDEMNIFICATION
You agree to indemnify and hold harmless Nearby Places and its owners from any claims, damages, losses, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
13. MODIFICATIONS TO THE APP
We reserve the right to:
- Modify, suspend, or discontinue the App at any time without notice
- Add or remove features or functionality
- Update these Terms of Use at any time
14. CHANGES TO TERMS
We may update these Terms of Use from time to time. Continued use of the App after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
15. TERMINATION
We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
16. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
17. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. ENTIRE AGREEMENT
These Terms of Use constitute the entire agreement between you and Nearby Places regarding the use of the App and supersede any prior agreements.

1. KOŞULLARIN KABULÜ
Nearby Places uygulamasını ("Uygulama") indirerek, yükleyerek veya kullanarak bu Kullanım Koşullarına bağlı olmayı kabul etmiş olursunuz. Bu koşulları kabul etmiyorsanız, lütfen Uygulamayı kullanmayın.
2. HİZMET TANIMI
Nearby Places, kullanıcıların restoranlar, kafeler, eczaneler, bankalar ve diğer işletmeler gibi yakındaki ilgi çekici noktaları keşfetmelerine yardımcı olan bir mobil uygulamadır. Uygulama, çevrenizdeki ilgili yerleri görüntülemek için cihazınızın konumunu kullanır.
3. UYGUNLUK
Uygulama her yaştan kullanıcıya açıktır. Uygulamayı kullanmak için hesap kaydı gerekmez.
4. KULLANIM LİSANSI
Size bu Koşullara uygun olarak Uygulamayı kişisel, ticari olmayan amaçlarla kullanmanız için sınırlı, münhasır olmayan, devredilemez, iptal edilebilir bir lisans veriyoruz.
5. KULLANICI SORUMLULUKLARI
Uygulamayı kullanarak şunları kabul etmiş olursunuz:
- Uygulamanın düzgün çalışması için doğru konum izinleri sağlamak
- Uygulamayı yalnızca yasal amaçlarla kullanmak
- Uygulamayı tersine mühendislik yapmaya, değiştirmeye veya kurcalamaya çalışmamak
- Uygulamayı hizmete zarar verebilecek, devre dışı bırakabilecek veya bozabilecek şekilde kullanmamak
6. KONUM HİZMETLERİ
- Uygulamanın çalışması için cihazınızın konumuna erişim gerekir
- Konum hizmetlerini cihaz ayarlarınızdan istediğiniz zaman etkinleştirebilir veya devre dışı bırakabilirsiniz
- Konum hizmetlerini devre dışı bırakmak Uygulamanın işlevselliğini sınırlayacaktır
7. ÜÇÜNCÜ TARAF HİZMETLER
Uygulama, haritalama ve yer arama işlevselliği için Apple Maps kullanır. Bu özelliklerin kullanımınız ayrıca Apple'ın Hizmet Şartları ve Gizlilik Politikasına tabidir.
8. BİLGİ DOĞRULUĞU
- Yer bilgileri (adlar, adresler, telefon numaraları, web siteleri) Apple Maps tarafından sağlanmaktadır
- Bu bilgilerin doğruluğunu, eksiksizliğini veya güncelliğini garanti etmiyoruz
- Çalışma saatleri, müsaitlik ve diğer ayrıntılar önceden haber verilmeksizin değişebilir
- Önemli bilgileri her zaman doğrudan ilgili işletmeden doğrulayın
9. FİKRİ MÜLKİYET
- Uygulama, tasarımı, özellikleri ve içeriği dahil olmak üzere Nearby Places'a aittir
- Uygulamayı kopyalayamaz, değiştiremez, dağıtamaz veya ona dayalı türev çalışmalar oluşturamazsınız
- Uygulamada görüntülenen tüm ticari markalar, logolar ve hizmet markaları bizim mülkümüz veya ilgili sahiplerinin mülküdür
10. GARANTİ REDDİ
UYGULAMA, AŞAĞIDAKİLER DAHİL ANCAK BUNLARLA SINIRLI OLMAMAK ÜZERE, AÇIK VEYA ZIMNİ HİÇBİR GARANTİ OLMAKSIZIN "OLDUĞU GİBİ" VE "MEVCUT OLDUĞU ŞEKİLDE" SUNULMAKTADIR:
- TİCARİ ELVERİŞLİLİK
- BELİRLİ BİR AMACA UYGUNLUK
- İHLAL ETMEME
- BİLGİ DOĞRULUĞU VEYA GÜVENİLİRLİĞİ
11. SORUMLULUK SINIRLAMASI
YASALARIN İZİN VERDİĞİ AZAMİ ÖLÇÜDE, AŞAĞIDAKİLERDEN SORUMLU DEĞİLİZ:
- Dolaylı, arızi, özel, sonuçsal veya cezai zararlar
- Kar, veri veya iş fırsatı kayıpları
- Uygulamayı kullanımınızdan veya kullanamamanızdan kaynaklanan zararlar
- Uygulama aracılığıyla sağlanan bilgilere güvenmenizden kaynaklanan zararlar
12. TAZMİNAT
Aşağıdakilerden kaynaklanan her türlü talep, zarar, kayıp veya masrafa karşı Nearby Places'ı ve sahiplerini tazmin etmeyi ve zararsız tutmayı kabul edersiniz:
- Uygulamayı kullanımınız
- Bu Koşulları ihlal etmeniz
- Herhangi bir üçüncü taraf hakkını ihlal etmeniz
13. UYGULAMADA DEĞİŞİKLİKLER
Şu hakları saklı tutarız:
- Uygulamayı herhangi bir zamanda önceden haber vermeksizin değiştirmek, askıya almak veya durdurmak
- Özellikler veya işlevsellik eklemek veya kaldırmak
- Bu Kullanım Koşullarını herhangi bir zamanda güncellemek
14. KOŞULLARDA DEĞİŞİKLİKLER
Bu Kullanım Koşullarını zaman zaman güncelleyebiliriz. Herhangi bir değişiklikten sonra Uygulamayı kullanmaya devam etmeniz, yeni Koşulları kabul ettiğiniz anlamına gelir. Bu Koşulları periyodik olarak gözden geçirmenizi öneririz.
15. FESİH
Bu Koşulları ihlal ettiğine veya diğer kullanıcılara, bize veya üçüncü taraflara zararlı olduğuna inandığımız davranışlar için herhangi bir zamanda, önceden haber vermeksizin Uygulamaya erişiminizi sonlandırma veya askıya alma hakkını saklı tutarız.
16. UYGULANACAK HUKUK
Bu Koşullar, kanunlar ihtilafı hükümleri dikkate alınmaksızın, Türkiye Cumhuriyeti yasalarına göre yönetilecek ve yorumlanacaktır.
17. BÖLÜNEBİLİRLİK
Bu Koşulların herhangi bir hükmünün uygulanamaz veya geçersiz olduğu tespit edilirse, söz konusu hüküm gerekli olan asgari ölçüde sınırlandırılacak veya ortadan kaldırılacak ve kalan hükümler tam olarak yürürlükte kalmaya devam edecektir.
18. TAM ANLAŞMA
Bu Kullanım Koşulları, Uygulamanın kullanımına ilişkin sizinle Nearby Places arasındaki tam anlaşmayı oluşturur ve önceki tüm anlaşmaların yerine geçer.
