We at “napID”, service provider of authenticating the authorized user, provide spam blocking, avoid fraudsters for login on any website are committed to protecting your privacy. We have prepared this Privacy Policy to describe to you our practices regarding the personal data we collect from users of our Application. Our registered office is at Prince Infocity II, Unit No.1, 283/3 and 283/4, Perungudi, OMR, Chennai, Tamil Nadu, India 600096.

By using the Services, users consent to the collection and use of their Personal Data by us. You also represent to us that you have any and all authorizations necessary to use these Services including using them to process Personal Data. We collect and use the information you provide to us, including information obtained from your use of the Services. Also, we may use the information that we collect for our internal purposes to develop, tune, enhance, and improve our Services, and for advertising and marketing consistent with this Privacy Policy.

This privacy policy has been compiled to better serve those who are concerned with how their 'Personal Data’ is being used online. Personal data means data which relate to a living individual who can be identified – (a) from those data, or (b) from those data and other information which is in the possession of, or is likely to come into the possession of, the data controller, and includes any expression of opinion about the individual and any indication of the intentions of the data controller or any other person in respect of the individual.

This Privacy Policy is intended to inform users about how our Application treats Personal Data that it processes about users. If users do not agree to any part of this Privacy Policy, then we cannot provide its Services to users and users should stop accessing our services.

By using the Services, You acknowledge, consent and agree that we may collect, process, and use the information that you provide to us and that such information shall only be used by us or third parties acting under our direction, pursuant to confidentiality agreements, to develop, tune, enhance, and improve the Services.

Although we may attempt to notify you when changes are made to this Privacy Policy, you are responsible for periodically reviewing any changes which may be made to the Policy. We may, in our sole discretion, modify or revise the Policy at any time, and you agree to be bound by such modifications or revisions.


1. INFORMATION WE COLLECT:

1.1.1. When you register to use our Services by establishing an Account, we will collect Personal Data as necessary to offer and fulfill the Services you request. Depending on the Services you choose, we may require you to provide us with your Personal name/Business name; Business type; Mobile number; Email address; Website address, user ids of customers, nature of user ids to establish an Account. We may require you to provide us with additional Personal Data as you use our Services.

1.1.2 Permissions Required in your mobile:
Location - We use this to detect precise location of where your id is accessed.
Call - We use this to detect single vs dual sim and let user choose.

1.2. Transaction and experience information – When you use our Services or access our App or Sites, for example, making the user id to sleep and awake, we collect information about the user id from the user id provider, as well as other information associated with the user id such as mobile number, status of the user id, nature of user to perform the services listed under the Terms of Service.

1.2.1. Participant information – As part of our commitment to your privacy, we work to reduce the amount of Personal Information that we collect and store about our Users. However, in order to provide the service of authenticating the right user during login process, we collect and store the following Personal Information about our Users

1. Device ID (including brand, model, unique ID, operating system info)

2. Mobile Number of the owner of the user id

3.Device location

1.3. Information that you choose to provide us to obtain additional Services or specific online Services – If you request or participate in an optional Site feature, or request enhanced Services or other elective functionality, we may collect additional information from you. We will provide you with a separate notice at the time of collection, if the use of that information differs from the uses disclosed in this Privacy Statement.

1.4. By using our App, you acknowledge and agree that you may be transferring your personal data outside of the country in which you have contributed it (“your country”), and that you consent to any transfer of information outside of your country. These countries may not have similar data protection laws to those that apply in your country. However, if we transfer your personal data outside of your country in this way, we will take steps to try to ensure that your privacy rights are protected in compliance with applicable data protection law and this Privacy Policy.

2. HOW WE USE YOUR INFORMATION:

2.1. We use the personal information we collect to fulfill your requests for services, improve our services and contact you.

2.2. By providing us your e-mail address, you consent to us using the e-mail address to send you our Application and services related notices, including any notices required by law, in lieu of communication by postal mail. You also agree that we may send notifications of activity on our Application to the e-mail address you give us, in accordance with any applicable privacy settings. We may use your e-mail address to send you other messages, such as newsletters, changes to our features, or other information. If you do not want to receive optional e-mail messages, you may modify it by unsubscribing through the email.

2.3. Our settings may also allow you to adjust your communications preferences. If you do not wish to receive promotional email messages from us, you may opt out by following the unsubscribe instructions in those emails. If you opt out, you will still receive non-promotional emails from us about your account and our Services.

2.4. Following termination or deactivation of your services, we may (but are under no obligation to) retain your information for archival purposes. We will not publicly disclose any of your personal data other than as described in this Privacy Policy.

2.5. At our sole discretion, for any reason or no reason at all, we reserve the right to remove any content or messages, if we believe that such action is necessary (a) to conform to the law, comply with legal process served on us, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce this policy, to take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our Application; or (c) to exercise or protect the rights, property, or personal safety of the Application, our users, or others.

2.8. If you want to deactivate your account then you can send email at support@naID.co. After the account gets deactivated you can still view the history of previous activities.

2.9. Third Party Service Providers: We employ other companies and individuals to perform functions on our behalf. Examples may include providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments and providing customer service.

2.10. In-House Promotions: We may on occasion combine information we receive through our Services with outside records to enhance our ability to market our products and services that may be of interest to you. If you have signed up to receive our e-mails and prefer not to receive marketing information in connection with our Services, please follow the “unsubscribe” instructions provided on any marketing e-mail you receive in connection with our Services or by following the instructions in our Email Opt Out Form, as described below under “Unsubscribe Requests”.

2.11. Business Transfers: As our businesses continue to evolve, we might sell one or more of our companies, subsidiaries or business units. In such transactions, personally identifiable information generally is one of the transferred business assets. In such event, this Privacy Policy may be amended as set forth below or the collection and uses of your personally identifiable information may be governed by a different privacy policy.

Protection of Our Services and Others: We reserve the right to release personally identifiable information to unaffiliated third parties when we believe its release is appropriate to comply with the law, enforce or apply our Terms and Conditions and other agreements, or protect the rights, property or safety of us, our users or others. 2.13. With Your Consent: Other than as set out above, you will receive notice and have the opportunity to withhold consent when personally identifiable information about you might be shared with unaffiliated third parties.


3. HOW WE SHARE YOUR INFORMATION:

3.1. As a matter of policy, we will not sell or rent information about you and we will not disclose information about you in a manner inconsistent with this Privacy Policy except as required by law or government regulation. We cooperate with law enforcement inquiries, as well as other third parties, to enforce laws such as those regarding intellectual property rights, fraud and other personal rights.

3.2. We will not share the personal information we collect about you with any third party for their own marketing purposes without your consent. We have contract with third parties prohibiting them from sharing your personal data. However when you enter into transactions with third party payment gateways they access your Personal Information and we are not liable for any breach of the same.

3.3. We collate statistics about site traffic, sales and other commercial information which we pass onto third parties to assist us with improving the services we provide to you. We also use demographic information to tailor the Site and we share that information with third parties so that they can build up a better picture of our customer base and general consumer trends.

3.4. If you do not agree with our Privacy Policy, Terms of Service, please discontinue use of our Service; your continued usage of the Service will signify your assent to and acceptance of our Privacy Policy and Terms of Use.

WE CAN (AND YOU AUTHORIZE US TO) DISCLOSE ANY INFORMATION ABOUT YOU TO LAW ENFORCEMENT, OTHER GOVERNMENT OFFICIALS, ANY LAWSUIT OR ANY OTHER THIRD PARTY THAT WE, IN OUR SOLE DISCRETION, BELIEVE NECESSARY OR APPROPRIATE IN CONNECTION WITH AN INVESTIGATION OF FRAUD, INTELLECTUAL PROPERTY INFRINGEMENT, OR OTHER ACTIVITY THAT IS ILLEGAL OR MAY EXPOSE US, OR YOU, TO LIABILITY.

4. ENSURING INFORMATION IS ACCURATE AND UP-TO-DATE

4.1. We take reasonable precautions to ensure that the Personal Data we Collect, Use and Disclose is complete, relevant and up-to-date. However, the accuracy of that information depends to a large extent on the information you provide. That's why we recommend that you:

5.2. By using this Application or the Services or providing Personal Information to us, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of this Application or Services.

We cannot, however, ensure or warrant the security of any information you transmit to us and you do so at your own risk. Once we receive your transmission of information, we make commercially reasonable efforts to ensure the security of our systems. If we learn of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps.

5.5. We shall not be liable for any leak of your personal Information through Payment Gateway websites and you should exercise your due cautions while transacting.

6.1.2. Changing or Deleting Your Personal Data: You may change any of your personal information by visiting the Application and following the directions therein or by emailing us at support@napid.co. You may request deletion of your personal data by us, and we will use commercially reasonable efforts to honor your request, but please note that we may be required to keep such information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives. We may also retain your information for fraud prevention or similar purposes.

6.1.3. You may, of course, decline to submit personal data through the Application, in which case, we may not be able to provide our services to you. You can review and correct the information about you that we keep on file by editing your account settings or by contacting us directly at support@napid.co

7. CHILDREN’S PRIVACY:

Protecting the privacy of young children is especially important. Thus, we do not knowingly collect or solicit personal information from anyone under the age of 18 or knowingly allow such persons to register. If you are under 18, please do not attempt to register for the Service or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 18 may provide any personal data for accessing the Service. In the event that we learn that we have collected personal data from a child under age 18, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 18, please contact us.


8. MERGER AND ACQUISITIONS

I. In case of a merger or acquisition, we reserve the right to transfer all the information, [GS1] including personal data, stored with us to the new entity or company thus formed. Any change in the Application’s policies and standing will be notified to you through email.


9. LINKS TO THIRD PARTY APPLICATIONS:

Our Application contains links to other Applications. The fact that we link to an Application is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third party Applications. These other Applications may place their own cookies or other files on your computer, collect data or solicit personally identifiable information from you. Other sites follow different rules regarding the use or disclosure of the personally identifiable information you submit to them. We encourage you to read the privacy policies or statements of the other Applications you visit and we shall not be responsible for any actions or inactions of the third party websites in regard to your personal information.

It is our policy to provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via e-mail notice, written or hard copy notice, or through conspicuous posting of such notice on the Application, as determined by us in our sole discretion. We reserve the right to determine the form and means of providing notifications to you, provided that you may opt out of certain means of notification as described in this Privacy Policy.


11. STORING PERSONAL DATA

We retain your information only for as long as is necessary for the purposes for which we process the information as set out in this policy. However, we may retain your Personal Data for a longer period of time where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.


12. OPTING OUT OF INFORMATION SHARING

12.1. We understand and respect that not all users may want to allow us to share their information. If you do not want us to share your information, please contact us through the Application and we will remove your information as soon as reasonably practicable. When contacting us, please clearly state your request, including your name, mailing address, email address and phone number.

12.2. However, under the following circumstances, we may still be required to share your personal information:

a) if we are responding to court orders or legal process, or if we need to establish or exercise our legal rights or defend against legal claims.

b) If we believe it is necessary to share information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Use or as otherwise required by law.

c) If we believe it is necessary to restrict or inhibit any user from using any of our App, including, without limitation, by means of "hacking" or defacing any portion thereof.

13. PHISHING OR FALSE EMAILS:

If you receive an unsolicited email that appears to be from us or one of our members that requests personal data (such as your credit card, login, or password), or that asks you to verify or confirm your account or other personal information by clicking on a link, or to provide your personal information to any other user that email was likely to have been sent by someone trying to unlawfully obtain your information, sometimes referred to as a "phisher" or "spoofer." We do not ask for this type of information in an email. Do not provide the information or click on the link. Please contact us on the contact details provided on the Application if you get an email like this.

14. CHANGES TO OUR PRIVACY POLICY:

14.1. We may update this Privacy Policy and information security procedures from time to time. If these privacy and/or information security procedures materially change at any time in the future, we will post the new changes conspicuously on the Application to notify you and provide you with the ability to opt out in accordance with the provisions set forth above.

14.2. Continued use of our Application and Service, following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.


15. BREACH OF PRIVACY POLICY

We reserve the right to terminate or suspend any account or delete certain contents from any profile or public domain within the ambit of this Application if the said account or content is found to be in violation of our privacy policy. We sincerely request you to respect privacy and secrecy concerns of others. The jurisdiction of any breach or dispute shall be determined in accordance with the terms of use of the Application.

16. NO RESERVATIONS:

We do not accept any reservation or any type of limited acceptance of our privacy policy. You expressly agree to each and every term and condition as stipulated in this policy without any exception whatsoever.

17. NO CONFLICT:

The policy constitutes a part of the user terms. We have taken utmost care to avoid any inconsistency or conflict of this policy with any other terms, agreements or guidelines available on our Application. In case there exists a conflict, we request you to kindly contact us for the final provision and interpretation.

18. CALIFORNIA CONSUMER PRIVACY ACT COMPLIANCE SUPPLEMENT

1. The California Consumer Privacy Act of 2018 (“CCPA”) only applies to residents of California. A “resident” is natural person who resides in California.

2. We are providing you this Notice at Collection in compliance with the CCPA. You must read and accept this Notice at Collection prior to submitting any Personal Information to us as part of creating your Account and signing up for the napID Services.

3. As a California resident, you have the Right to Know certain information regarding the Personal Information that we gather about you. We will respond to your Right to Know request within forty-five (45) calendar days. If we are unable to process your request within forty-five (45) calendar days, then we will inform you that we have extended the deadline for an additional forty-five (45) days. As part of our process for answering your Right to Know request, we will need to ask you additional information in order to verify that you are actually the person you claim to be. We will only use this requested information as part of our verification process and not for any other reason.

4. We collect your Personal Information for the below purposes

a. We collect the Personal Information listed above in order to provide Services to you.

b. To create napID vendor account and napID app users

c. To Provide sleep and awake activity for your user ids you must provide us access to your Device ID

d. In order to create an account with napID app, you must allow permission to send SMS or make Phone Calls for authentication purposes to make your account secure.

e. To create napID vendor account, you must provide us the valid email address during account creation.

5. We may share your Personal Information with third parties to perform the service of napID as per the terms of service including sending emails, sending SMS, making Phone Calls, allowing you to login to the napID Mobile Application, protecting against security threats and vulnerabilities, and processing payment for SMS and Phone Call notifications. These third parties include user id providers, napID Mobile Application push notifications, payment processors, email processing.

6. We do not and will never sell, trade, or otherwise transfer your Personal Information to an unrelated third party for marketing, advertising, or other uses. To Unrelated third parties do not include those that assist us in performing our Services (including but not limited to include user id providers, napID Mobile Application push notifications, payment processors, email processing, SMS and Phone Call notifications, security and fraud prevention). We may release your Personal Information when it is appropriate to comply with the law, enforce this Privacy Policy, or protect ours or others’ rights, property, or safety.

7. You may contact us via email at support@napid.co with the subject line “CCPA Right to Know” and a description of the Personal Information that you are requesting in the body of the email.

8. We may refuse to disclose your Personal Information if,

    1. We cannot verify your request.

    2. Your request is manifestly unfounded or excessive.

    3. If we have already provided you with the requested Personal Information more than two times in the prior 12-month period.

    4. You request that we disclose Personal Information that is your social security number, financial account number, account password, or PIN. This information cannot be disclosed in a Request to Know under the CCPA, in addition, napID does not collect any of this information from Users.

9. As a California resident, you have the Right to Delete certain Personal Information that we gather about you. We will respond to your Right to Delete request within forty-five (45) calendar days. If we are unable to process your request within forty-five (45) calendar days, then we will inform you that we have extended the deadline for an additional forty-five (45) days. As part of our process for answering your Right to Delete request, we will need to ask you additional information in order to verify that you are actually the person you claim to be. We will only use this requested information as part of our verification process and not for any other reason.

10. As a California resident, you have the Right to “Opt-Out” from a business’s practice of selling your Personal Information. napID has the policy of not selling, trading, or otherwise transferring your Personal Information to an unrelated third party for marketing, advertising, or other uses. If our policy changes in the future, we will notify you prior to selling, trading, or otherwise transferring your Personal Information to an unrelated third party for marketing, advertising, or other uses and obtain your consent for such practices. At such a time, this Privacy Policy will be updated to outline the procedure for opting out of such sale, trade, or transfer.

11. We will not discriminate against you based on your exercise of your rights under the CCPA. However, if we are unable to process your CCPA request and continue to provide you napID Service under the Terms of Service, then you may no longer be able to receive napID Service under the Terms of Service.

12. napID has not sold California residents’ Personal Information over the past 12-month time frame and do not intend to do so. This includes the Personal Information of children under the age of sixteen (16).

13. In accordance with California Civ. Code s. 1798.82(a), we will notify you if your unencrypted Personal Information was, or we have reason to believe has been, acquired by an unauthorized person. In addition, we will notify you if your encrypted Personal Information was, or we have reason to believe has been, acquired by an unauthorized person and the encryption key was, or we have reason to believe has been, acquired by an unauthorized person and we have reason to believe that the encryption key could be used to make your Personal Information readable or usable. Such notification may be posted to our Site and sent via email to Users who have provided us with an email address. It will be titled “Notice of Data Breach”, and it will include:

19. GENERAL DATA PROTECTION REGULATION OF THE EUROPEAN UNION COMPLIANCE SUPPLEMENT

1. The General Data Protection Regulations of the European Union (“GDPR”) applies to residents and citizens of countries in the European Union. A “resident” is natural person who resides in a European Union Country.

2. “napID” is a service provider of authenticating the authorized user for login on any website. You can contact us via email at support@napid.co with the subject line “GDPR.”

3. napID takes the security of your Personal Data seriously. To that end, we minimize the Personal Data that we collect about you and are transparent in how it is processed and used. napID collects minimal to no Personal Data for Users who only download and use the napID Mobile Application. For napID vendor, napID collects your business details along with your customer and employee Data in order to manage your Account and provide Service to you according to the Terms of Service. You recognize and agree that in order for napID to provide you napID Service under the Terms of Service, you must grant us consent to use and process the Personal Data that we request at sign-up. Processing the requested Personal Data is necessary for us to perform Services under the Terms of Service. The requested Personal Information includes:

If you fail to provide such Personal Data or request that we delete such Personal Data, we will be unable to provide you napID Service under the Terms of Service and your access to the napID Service will be cancelled pursuant to the Terms of Service. In addition, we may in the future email you with special offers on other products or napID Services that we think may be of value to you. If you have agreed to receive marketing emails, you may always opt out in the future by clicking the “Unsubscribe” button at the bottom of a marketing email to be removed from our direct marketing list.

5. Analytic Data. In addition to the Personal Data that is required to provide napID Services, we collect cookies, Google Analytics, and Facebook Pixels for the legitimate interest of improving and providing the napID Services. We retain and analyze this information to evaluate how you, and other Users, move around our Site and the napID Mobile Applications. This helps us to understand how our Site and the napID Mobile Applications are used so that we can continually provide improved Services.

6. We use your Personal Data for the following reasons:

a. To administer your Account and provide napID Services to you.

b. To verify your identity when you login to use the Services.

c. To personalize the advertisements that you see on our Site and the napID Mobile Application.

d. To personalize the advertisements that you see on other websites.

f. To inform you about products, Services, and promotional offers that you might find interesting, if you have opted into these types of communications.

g. To send you emails, SMS sending and notifications, or Phone Call notifications about login attempts and issues with your Account.

7. You provide us with Personal Data directly when you register for an Account. In addition, we collect and process data when you view or use our Site via your web browser’s cookies.

We may share your Personal Information with third parties to perform the service of napID as per the terms of service including sending emails, sending SMS, making Phone Calls, allowing you to login to the napID Mobile Application, protecting against security threats and vulnerabilities, and processing payment for SMS and Phone Call notifications. These third parties include user id providers, napID Mobile Application push notifications, payment processors, email processing. In addition, we will release your Personal Data when it is required to comply with the law, enforce this Privacy Policy, or protect ours or others’ rights, property, or safety.

9. We do not and will never sell, trade, or otherwise transfer your Personal Information to an unrelated third party for marketing, advertising, or other uses.

10. Your Personal Data can only be accessed by napID employees, contractors, and third parties who have a legitimate interest in processing the Personal Data.

11. We store your Personal Data on a secure Azure cloud located In the United States and respective regions of the vendors. All Personal Data is encrypted using industry standard encryption methods. We will update this GDPR Supplement if we change the location of your Personal Data.

12. We will store your Personal Data as long as you have an active Account and use the napID Services. After you cancel your Services and delete your Account, we will delete all your Personal Data within 7 days. However, we will maintain all records of payment and invoices for the period of time required by applicable governmental and regulatory bodies.

13. We may transfer and store your Personal Data in countries other than the country in which the Personal Data was originally collected. These countries may be outside of the European Economic Area (“EEA”). These countries may not have the same data protection laws as the country in which you reside or provide the Personal Data. If your Personal Data is transferred, we will protect your Personal Data as described in this Privacy Policy and comply with applicable legal requirements for transferring Personal Data outside of the EEA. If you reside in the EEA, we will only transfer your Personal Data if:

a. The country to which the Personal Data is being transferred to has been granted a European Commission adequacy decision;

b. The recipient of the Personal Data is located in the US and has certified to the US-EU Privacy Shield Framework or its successor frameworks; OR

c. We have put in place appropriate safeguards for the transfer.

14. Pursuant to Article 8 of GDPR, children under the age of 16 are not allowed to give us consent to use and process their Personal Data. Therefore, if you are under the age of 16, you cannot consent to this Privacy Policy or the Terms of Service. If we discover that you are under the age of 16, your consent will be revoked and your license to use the napID Service under the Terms of Service will be cancelled effective immediately.

15. GDPR Rights.

a. Pursuant to Article 15 of GDPR, you have the right to obtain from napID confirmation as to whether your Personal Data is being processed. If we are processing your Personal Data, you have the right to know the purposes of the processing, the categories of your Personal Data being processed, who the recipients of your Personal Data, and how long we believe your Personal Data will be stored for. We will respond to your request within thirty (30) calendar days. We will provide this information to you in a machine-readable format. We may charge you a small fee to provide this information.

b. Pursuant to Article 16 of GDPR, you have the right to request that we correct any of your Personal Data that is incorrect or incomplete. We will endeavor to correct and/or complete your Personal Data within thirty (30) calendar days of your request.

c. Pursuant to Article 17 of GDPR, you have the right to request that we erase your Personal Data when the Personal Data is no longer necessary for the purpose for which it was collected and processed, there is no legal grounds for processing, there is no overriding legitimate interest for us to process your Personal Data, your Personal Data has been unlawfully processed, or we have been compelled to comply with a legal obligation from a country in the European Union or Member States. We will respond to your request within thirty (30) calendar days.

d. Pursuant to Article 18 of GDPR, you have the right to require us to restrict processing your Personal Data when you are contesting the accuracy of your Personal Data, the processing is unlawful, we no longer need your Personal Data but are storing it for the establishment, exercise, or defense of legal claims, or you are exercising your right to object to processing under Article 21 of the GDPR.
