These Terms of Use govern your access to and use of the Natus Ad Evolver mobile application and related services, provided by OudNé.

By downloading, accessing, or using the Service, you agree to be bound by these Terms of Use. If you do not agree to these Terms, please do not use the Service.

1. Purpose of the Service

Natus Ad Evolver is a brain training and cognitive development application intended for general wellness, educational, and entertainment purposes only.

The Service is not medical advice, does not provide diagnosis or treatment, and is not a medical device. You should not rely on the Service for any medical purpose.

2. Eligibility and Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

• misuse the Service;

• attempt to interfere with the proper functioning of the Service;

• copy, reproduce, distribute, or modify any part of the Service without authorization;

• use the Service in any way that violates applicable laws or regulations.

3. Accounts

Some features of the Service may require you to create an account or provide certain information.

You agree to provide accurate, complete, and up-to-date information and to keep your login credentials secure. You are responsible for any activity that occurs under your account.

4. Subscriptions

The Service may offer auto-renewable subscription plans that provide access to premium features.

By purchasing a subscription:

• payment will be charged to your Apple ID account at confirmation of purchase;

• the subscription renews automatically unless it is cancelled at least 24 hours before the end of the current billing period;

• your account will be charged for renewal within 24 hours prior to the end of the current billing period;

• you may manage or cancel your subscription at any time through your Apple account settings after purchase.

The price, billing period, and features included in each subscription plan are displayed in the app before purchase.

5. Free Trial

If a free trial is offered, it will automatically convert into a paid subscription at the end of the trial period unless cancelled at least 24 hours before the end of the trial.

If applicable, any unused portion of a free trial period will be forfeited when you purchase a subscription before the end of the trial period.

6. Payments and Refunds

All subscription purchases are processed through Apple’s App Store payment system.

Refunds are handled by Apple in accordance with Apple’s applicable policies. We do not directly issue refunds for purchases made through the App Store.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

8. Intellectual Property

The Service, including but not limited to its content, design, text, graphics, features, logos, and software, is the exclusive property of Quentin Auschitzky, unless otherwise stated, and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, publish, license, sell, or otherwise exploit any part of the Service without our prior written consent.

9. Third-Party Services

The Service may contain links to third-party websites or services, or may rely on third-party tools and technologies.

We are not responsible for the availability, content, accuracy, or practices of any third-party services.

10. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, OudNé shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or business opportunities arising out of or related to your use of, or inability to use, the Service.

Your use of the Service is at your sole risk.

12. Changes to the Service and Pricing

We reserve the right to modify, suspend, or discontinue all or part of the Service at any time, with or without notice.

We may also change subscription offerings or pricing from time to time. Any pricing changes related to subscriptions will be communicated and applied in accordance with Apple’s App Store rules and policies.

13. Termination

We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your use of the Service is unlawful, harmful, or abusive.

You may stop using the Service at any time. Cancellation of a subscription does not automatically delete your account unless otherwise specified.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the competent courts of France, unless otherwise required by applicable consumer law.
