These Terms and Conditions ("Terms") govern your access to and use of NA's mobile and macOS applications (collectively, the "Apps"). By downloading, installing, accessing, or using the Apps, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should discontinue use of the Apps immediately.
By using the Apps, you confirm that you have read, understood, and agreed to these Terms. You must be at least 13 years of age, or the minimum legal age required in your jurisdiction, to use the Apps.
Subject to your compliance with these Terms, NA grants you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the Apps solely for your personal and non-commercial use.
You agree that you will not:
Modify, adapt, reproduce, distribute, or create derivative works based on the Apps.
Reverse engineer, decompile, disassemble, or attempt to obtain the source code of the Apps.
Use the Apps for unlawful, fraudulent, or unauthorized purposes.
Interfere with the operation, security, or integrity of the Apps.
Engage in activities that may harm NA, its users, or its services.
NA reserves the right to suspend, restrict, or terminate access to the Apps at any time if these Terms are violated.
All content, software, trademarks, logos, graphics, designs, and other intellectual property associated with the Apps are owned by or licensed to NA and are protected by applicable copyright, trademark, and intellectual property laws.
Nothing in these Terms grants you ownership of any intellectual property rights. You may not use, copy, reproduce, or exploit any intellectual property belonging to NA without prior written consent.
Certain features of the Apps may require an active subscription. All subscriptions are offered and processed through Apple's App Store and are subject to Apple's billing terms, conditions, and policies.
All payments, subscription renewals, cancellations, refunds, and billing-related matters are handled exclusively by Apple through your Apple ID account. NA does not collect, store, process, or have access to your payment card information.
Subscription benefits and premium features are available only while the applicable App and its related services remain available and supported. While we strive to maintain and support our Apps, we do not guarantee that any App, feature, service, or content will remain available indefinitely.
NA reserves the right to modify, suspend, discontinue, remove, or replace any App, feature, service, or functionality at any time, subject to applicable laws and App Store policies.
By purchasing a subscription, you acknowledge and agree that the continued availability of an App on the App Store is not guaranteed and that subscription purchases do not constitute a guarantee of perpetual access to the App, its features, or related services.
For subscription management, cancellations, billing inquiries, or refund requests, please refer to your Apple Account settings or contact Apple Support directly.
The Apps are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
To the fullest extent permitted by applicable law, NA disclaims all warranties, including but not limited to:
Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy, reliability, or completeness of content
Continuous, uninterrupted, secure, or error-free operation
We do not guarantee that the Apps will always be available, free of bugs, or compatible with all devices and operating systems.
To the maximum extent permitted by law, NA shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the Apps.
This includes, without limitation, damages for:
Loss of data
Loss of profits or revenue
Business interruption
Device malfunction
Service downtime
Errors, omissions, or inaccuracies within the Apps
If you are dissatisfied with any aspect of the Apps, your sole and exclusive remedy is to discontinue using them.
The Apps may provide access to third-party websites, services, content, or integrations. These third-party services operate independently and may have their own terms and privacy policies.
NA does not control and is not responsible for the availability, content, accuracy, or practices of any third-party service. Your use of third-party services is entirely at your own risk.
NA reserves the right to modify, revise, or update these Terms at any time. Any changes will become effective immediately upon publication within the Apps or through other appropriate means.
Your continued use of the Apps after changes are posted constitutes your acceptance of the revised Terms.
These Terms shall be governed by and interpreted in accordance with the laws applicable in your jurisdiction, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Apps shall be subject to the exclusive jurisdiction of the competent courts within the applicable jurisdiction.
