Furthermore, MPPCBpublishes a list that divides the industries into red, orange, green and white categories. While the red category mentions 102 industries that are classified as heavily polluting, there are 108 industries under the Orange category that are moderately polluting. The green category industries identified by the board are 94 in number, and the white category industries, are 750 in number, including those exempted from obtaining consent certificates. Any person releasing trade effluent into streams or wells, sewers or on land must apply to the Member Secretary, Madhya Pradesh Pollution Control Board.

The Jabalpur Bench of the Madhya Pradesh High Court, on July 28, ordered the Madhya Pradesh Pollution Control Board (MPPCB) to not allow any movement of toxic waste from Bhopal's Union Carbide site to the Defence Research and Development Organization (DRDO) incineration facility at Butibori near Nagpur. The movement has been stayed till the next hearing which is scheduled for August 11. The court also directed the pollution control boards of both the states to inspect the defunct plant site in Bhopal. 

 

 The court was addressing an intervention appeal filed by the Maharashtra government against the MP High Court's order of July 12 that allowed the incineration of toxic waste of the Union Carbide plant in Nagpur. The appeal was filed by the Maharashtra government. 

 

 Maharashtra government claimed that Madhya Pradesh had not sought a No Objection Certificate (NOC) from them. In the intervention appeal the Maharashtra government added that since there was a facility in Pithampur, near Indore, to treat such waste, the waste should be disposed off within the state itself.

Additionally, advance manifests provide the Service with an opportunity to more thoroughly analyze information regarding persons from countries participating in the Visa Waiver program, who are seeking to enter into or depart from the United States upon arrival under the VWP and to identify individuals who may be inadmissible to the United States or otherwise of interest to the Service or another law enforcement agency. Submission of early advance passenger information also facilitates the ability of the Service to notify other law enforcement authorities that an arriving passenger on board may present a potential safety or security risk. Furthermore, the development of an automated entry and exit control system will allow the Service to fulfill the reporting requirements mandated by sectin 217(h)(1)(C) of the Act.

No person or vessel will be able to enter or remain in these safety and security zones at any time without the permission of the Captain of the Port. Each person or vessel in a safety and security zone will be required to obey any direction or order of the Captain of the Port. The Captain of the Port will be able to take possession and control of any vessel in a security zone and remove any person, vessel, article or thing from a security zone. No person will be able to board, take or place any article or thing on board any vessel or waterfront facility in a security zone without permission of the Captain of the Port. These regulations are issued under authority contained in 50 U.S.C. 191, 33 U.S.C. 1225, 1226, and 1231.

This revision restructures and reorganizes Regulations 45CSR3, governing the prevention and control air pollution from the operation of hot mix asphalt plants. This revision specifies standards for opacity and particulate test methods. This revision also changes the opacity standard during start-up and shutdown from 60% to 40% with averaging of emissions using approved EPA test methods.

Under section 307(b)(1) of the Clean Air Act, petitions for judicial review of this action must be filed in the United States Court of Appeals for the appropriate circuit by December 10, 2002. Filing a petition for reconsideration by the Administrator of this final rule approving revisions to West Virginia's regulation to prevent and control air pollution from the operation of hot mix asphalt plants does not affect the finality of this rule for the purposes of judicial review nor does it extend the time within which a petition for judicial review may be filed, and shall not postpone the effectiveness of such rule or action.
