These Terms of Use apply to the application Moven: Motivation & Habits (the “Application”), developed by Ihor Zhuravskyi (the “Service Provider”).

By downloading, accessing, or using the Application, you agree to these Terms of Use. Please read them carefully before using the Application.

Use of the Application

Moven provides motivational content, motivational audio, Daily Challenges, Daily Actions, Streak tracking, progress tracking, and other features designed to support motivation, consistency, and personal development.

You agree to use the Application only for lawful purposes and in accordance with these Terms of Use.

You are responsible for maintaining the security of your device and your account and for activity performed through your account.

User Accounts

Some features of the Application require an account created using Sign in with Apple or Google Sign-In.

You are responsible for providing accurate information and maintaining access to your account.

You may permanently delete your Moven account through the account deletion feature available within the Application.

Intellectual Property

The Moven name, branding, design, text, graphics, audio content, software, and other materials available through the Application are owned by or licensed to the Service Provider and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, reverse engineer, or create derivative works from the Application or its content without prior written permission from the Service Provider, except where permitted by applicable law.

Moven Pro Subscriptions

Moven offers optional Moven Pro subscriptions that provide access to premium features and content.

Subscriptions are purchased through the Apple App Store and are subject to Apple's applicable terms and conditions.

Available subscription options, billing periods, prices, and applicable terms are displayed before you complete a purchase.

Subscriptions automatically renew unless canceled in accordance with the subscription terms provided by Apple.

You can manage or cancel your subscription through your Apple Account subscription settings.

Deleting your Moven account does not automatically cancel an active Apple App Store subscription. You must manage or cancel your subscription separately through your Apple Account settings.

Purchases and Restore Purchases

Moven uses Apple's in-app purchase system to process subscriptions.

If you have previously purchased a Moven Pro subscription, you may use the Restore Purchases feature to restore eligible purchases associated with your Apple Account.

Subscription access is subject to successful verification of the applicable purchase.

Agreement with the Service Provider

These Terms of Use constitute an agreement between you and the Service Provider.

Apple is not a party to these Terms of Use and is not responsible for the Application, its content, maintenance, or support.

To the extent required by applicable law, Apple is a third-party beneficiary of these Terms of Use and may enforce these Terms against you.

Modifications to the Application

The Service Provider may update, modify, add, or remove features, content, or functionality of the Application from time to time.

We may make such changes to maintain, improve, secure, or further develop the Application.

If changes materially affect these Terms of Use, the updated Terms will be published with a new effective date.

Availability and Internet Connection

Some features of the Application require an active internet connection.

The Service Provider is not responsible for interruptions or limitations caused by your internet connection, mobile network, device, operating system, or other circumstances outside our reasonable control.

Your mobile carrier may charge you for mobile data usage.

Health and Personal Development Disclaimer

Moven is intended for general motivation, personal development, habit-building, and informational purposes only.

The Application does not provide medical, psychological, fitness, nutritional, or other professional advice.

Information and activities provided through the Application are not a substitute for advice from a qualified professional.

You are responsible for determining whether any activity or suggestion provided through the Application is appropriate for you.

Limitation of Liability

The Application is provided on an “as is” and “as available” basis.

To the extent permitted by applicable law, the Service Provider does not guarantee that the Application will always be available, uninterrupted, secure, or error-free.

To the extent permitted by applicable law, the Service Provider will not be responsible for indirect, incidental, special, consequential, or other damages arising from or related to your use of the Application.

Nothing in these Terms of Use excludes or limits any liability that cannot legally be excluded or limited under applicable law.

Suspension and Termination

The Service Provider may suspend or discontinue the Application or any part of it when reasonably necessary, including for maintenance, security, legal, or technical reasons.

You may stop using the Application at any time.

If your account is deleted or your access to the Application is terminated, you must stop using the Application and may uninstall it from your device.

Termination of your Moven account does not automatically cancel an active Apple App Store subscription.

Third-Party Services

The Application relies on third-party services necessary for its operation, including Supabase, RevenueCat, Apple services, Apple Sign In, and Google Sign-In.

These services may be subject to their own terms, conditions, and privacy policies.

The Service Provider is not responsible for the availability or operation of third-party services outside its reasonable control.

Changes to These Terms

We may update these Terms of Use from time to time.

Any changes will be published on this page with an updated effective date.

Your continued use of the Application after the updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
