Please read these Terms of Use ("Terms") carefully before using Mountain Identifier: PeakGuide ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

Mountain Identifier: PeakGuide is a mobile application that uses artificial intelligence technology to identify mountains and peaks from photographs. The App provides information including but not limited to mountain names, elevation data, geographic location, climate information, climbing routes, cultural significance, and regional wildlife data.

2. Accuracy Disclaimer

The mountain identification and related information provided by the App are generated using AI-based image analysis and are intended for informational and educational purposes only. While we strive to provide accurate results:

• Identification results may be inaccurate due to image quality, lighting conditions, weather, camera angle, or other factors.
  
  

• Elevation, climate, and geographic data are approximate and should not be relied upon for navigation, safety planning, or critical decision-making.
  
  

• Climbing route information, including difficulty ratings and estimated durations, is provided as general guidance only and should not be used as a substitute for professional mountaineering advice, certified guides, or official trail information.
  
  

• Wildlife information is general in nature and may not reflect current conditions in a specific area.
  
  

You acknowledge that outdoor activities including hiking and mountaineering carry inherent risks, and you assume full responsibility for your safety. Never rely solely on this App for navigation or safety decisions in outdoor environments.

3. Subscriptions and Payments

The App offers the following purchase options:

• Weekly Subscription: Provides full access to all premium features for a recurring weekly fee. A free trial period may be offered for first-time subscribers.
  
  

• Lifetime Access: A one-time purchase that grants permanent access to all premium features.
  
  

All payments are processed through your Apple ID account via the App Store. By subscribing, you agree to the following:

• Payment is charged to your Apple ID account upon confirmation of purchase.
  
  

• Weekly subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
  
  

• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
  
  

• You can manage and cancel your subscriptions at any time by going to your Account Settings in the App Store after purchase.
  
  

• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
  
  

4. Free Trial

We may offer a free trial period for new subscribers. During the free trial, you will have full access to premium features at no cost. If you do not cancel before the free trial expires, your subscription will automatically convert to a paid weekly subscription, and your Apple ID account will be charged accordingly. You may cancel the free trial at any time through your App Store Account Settings.

5. Refunds

All purchases and subscriptions are processed by Apple. Refund requests must be directed to Apple in accordance with their refund policy. We do not have the ability to process refunds directly. To request a refund, visit https://reportaproblem.apple.com.

6. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable local, national, or international law or regulation.
  
  

• Attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
  
  

• Use the App to transmit any harmful, offensive, or otherwise objectionable content.
  
  

• Attempt to gain unauthorized access to any portion of the App or its related systems.
  
  

• Use the App for any commercial purpose without our prior written consent.
  
  

• Redistribute, sublicense, or resell access to the App or its content.
  
  

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Mountain Identifier: PeakGuide and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

• The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
  
  

• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
  
  

• We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
  
  

• We are not responsible for any injury, loss, or damage resulting from reliance on information provided by the App, including but not limited to climbing route data, elevation information, or weather conditions.
  
  

• Our total liability to you for any claims arising from or related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
  
  

9. Indemnification

You agree to indemnify and hold harmless Mountain Identifier: PeakGuide, its developers, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or your violation of these Terms.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms within the App or on our website. Your continued use of the App after any changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Turkey.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
