These Terms and Conditions ("Terms") govern your use of the Motiverse mobile application ("the App"), operated by Pixdazz ("we", "us", "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Use of the App
- The App lets you browse, create, and share motivational quotes for your personal, non-commercial use.
- You must be old enough to consent to use the App under the laws of your country.
- You agree not to misuse the App or use it for any unlawful purpose.
2. The App and your device
- The App does not require an account. When you first open it, it registers an anonymous device identifier and basic device information with our servers to deliver quote content, manage premium options, and handle notifications, as described in our Privacy Policy.
- How your data is collected, used, retained, and shared is described in full in our Privacy Policy.
- You are responsible for any mobile carrier data charges or fees incurred while using the online features of the App.
3. Content you create
- You retain ownership of the quotes, text layouts, and designs you create in the editor.
- Content you create is processed locally on your device. When you share or save a quote, you are responsible for how and where you distribute the resulting image.
4. Acceptable use and your responsibilities
You are solely responsible for the content you create and share, and the prompts you submit. You agree not to use the App to create, share, or submit to the AI Coach any content that:
- is obscene, sexually explicit, hateful, harassing, or otherwise indecent;
- is illegal, infringes others' rights (including intellectual-property or privacy rights), or violates any applicable law;
- misattributes statements to a real person in a misleading, defamatory, or harmful way;
- impersonates another person or entity for fraud or deception;
- attempts to scrape, reverse engineer, or disrupt our backend API servers (motiverse.pixdazz.xyz).
You confirm that you have the right to use any image you add to a quote, including the rights of any identifiable person it depicts. We may suspend or terminate access for violations.
5. Quote library, AI-generated output, and intellectual property
- Quotes provided in the App are offered for inspirational and informational purposes. Attributions are provided on a best-effort basis and may not always be complete or verified.
- The App allows you to generate quotes and receive advice via an AI-powered coach. You acknowledge that AI-generated content is probabilistic, may occasionally be inaccurate, incomplete, or repetitive, and should not be relied upon as factual or professional advice.
- The App, including its design, branding, and curated content library, is owned by Pixdazz and protected by applicable laws. You may not copy, redistribute, or commercially exploit the App or its content library except as the App allows.
- We do not claim ownership of the original quotes or images you create.
6. Notifications
The App may send push notifications (for example, daily inspiration) if you opt in. You can disable notifications at any time in your device settings.
7. Disclaimer
- The App is provided "as is" and "as available" without warranties of any kind, express or implied.
- The quotes, AI Coach advice, and other content are provided for general inspiration and do not constitute professional, medical, psychological, financial, or legal advice.
8. Limitation of liability
To the maximum extent permitted by law, Pixdazz and its developers shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits or data, arising from your use of, or inability to use, the App.
9. Termination
We may suspend or terminate your access to the App's backend features (such as AI capabilities and quote updates) at any time if you violate these Terms or use the App unlawfully.
10. Changes to these Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws applicable in the jurisdiction in which Pixdazz operates, without regard to conflict-of-law principles.
