End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you (the "User") and Moore Equine LLC for the use of the Moore Equine App mobile application ("App"). By installing, accessing, or using the App, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not install or use the App.

1. License Grant

Subject to the terms of this Agreement, the Company grants you a non-exclusive, non-transferable, revocable license to install and use the App on your mobile device for personal, non-commercial purposes. This license is for use only in accordance with the functionality of the App as provided by the Company.

2. Restrictions

You agree that you will not:

·         Modify, alter, translate, or create derivative works based on the App.

·         Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law.

·         Use the App for any unlawful or illegal purposes.

·         Distribute, sublicense, rent, or lease the App to any third party.

·         Use the App in a manner that could damage, disable, or impair the App’s functioning or interfere with any other users’ use of the App.

3. User Accounts

In order to access certain features of the App, you may be required to create an account. You agree to provide accurate and complete information during the registration process. You are responsible for maintaining the confidentiality of your account information and for all activity under your account.

4. Content

·         You retain ownership of any content you upload, post, or transmit through the App, such as product listings, photos, descriptions, and reviews. By posting content, you grant the Company a worldwide, royalty-free, and non-exclusive license to use, display, distribute, and promote your content within the App and for marketing purposes.

·         The Company does not claim ownership of the content you submit but reserves the right to remove any content that violates the terms of this Agreement or is deemed inappropriate by the Company.

5. Intellectual Property Rights

All intellectual property rights in the App, including software, content, design, and logos, are owned by Moore Equine LLC or its licensors. Except for the limited license granted to you, you do not have any rights to these intellectual property assets.

6. Privacy

By using the App, you agree to the collection, use, and disclosure of your information as described in our Privacy Policy, which is incorporated into this Agreement by reference. Please review the Privacy Policy for detailed information on how your data is handled.

7. Subscription and Payments

The App may offer a subscription service that allows you to access additional features, such as adding listings. Payment for subscriptions is handled manually and is non-refundable. You are responsible for ensuring that all payments are made correctly and on time.

8. Termination

The Company reserves the right to terminate or suspend your access to the App at any time, without notice, if you violate any terms of this Agreement or if we believe your actions are harmful to the App or its users. Upon termination, you must immediately cease using the App, and your access to any paid features will be revoked.

9. Disclaimers and Limitations of Liability

The App is provided "as is," and the Company makes no warranties, express or implied, regarding the App’s functionality, accuracy, or reliability. To the fullest extent permitted by law, the Company shall not be liable for any damages arising from your use of the App, including indirect, incidental, or consequential damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, and its employees from any claims, damages, losses, and expenses (including legal fees) arising from your use of the App or your violation of this Agreement.

11. Governing Law

This Agreement shall be governed by the laws of USA without regard to its conflict of law provisions. Any disputes related to this Agreement will be resolved in the courts located in USA.

12. Amendments

The Company reserves the right to update or modify this Agreement at any time. Any changes will be posted within the App or on our website. By continuing to use the App after such changes, you agree to the updated terms.
