You must be at least 13 years old to play Monkey Tag. If you are under 18, you must have permission from a parent or legal guardian to use the Game. By using the Game, you represent that you meet these requirements.
Some features of Monkey Tag may require creating an account through PlayFab or another third-party service. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized access or use of your account.
You agree to use Monkey Tag only for lawful purposes and in accordance with these Terms. You must not: Use spam, or exploit webhooks, API, or any 3rd party services (such as Discord or PlayFab) in connection with the game in any abusive, automated, malicious or disruptive manner. Attempt to bypass, disable, or interfere with Discord server community protections, moderation tools, reports, or Copy/Use Technological Protection Measures (TPMs). Engage in denial-of-service attacks, flood requests, or mass automation intended to overload or interfere with Discord servers, PlayFab or any other backend infrastructure used by Monkey Tag. Reverse engineer, decompile, disassemble, or extract/use any source code of Monkey Tag. Modify, cheat, exploit, or create unauthorized tools or hacks for Monkey Tag. Circumvent any technical protection measures or security mechanisms for Monkey Tag. Use the game for commercial purposes without written permission from Andrew Chapman. Use automation, bots, or scripts to gain unfair advantage for Monkey Tag. You may not use the Game, its assets, or systems for commercial purposes (including paid mods, hosting, or access) without prior written permission from Andrew Chapman.
3.1. Threats, Harassment, and Coercion
You are strictly prohibited from engaging in: Threats, harassment, intimidation, or Manipulation of the developer (Andrew Chapman), any staff, or other players for any reason. Blackmail or coercion, such as pressuring the developer to ban/unban players, alter the game, give special items/currency, or make moderation decisions under threat. Disruptive conduct, including threats to leak personal information, release exploits, crash servers, hack/exploit, or interfere with the game's operations or community. Any such behavior is grounds for immediate ban and potential legal action.
4. Player-to-Player Voice Chat
Monkey Tag includes real-time voice chat functionality for player-to-player communication. By using this feature, you agree to: Communicate respectfully and avoid harassment, hate speech, discrimination, or explicit content. Refrain from sharing personal information, including addresses, passwords, or financial details. Acknowledge that voice data may be processed by third-party services (such as Photon Voice) to enable real-time communication. Understand that we monitor and/or record every voice chat session and may review reports of misconduct in accordance with applicable laws. We reserve the right to suspend or permanently ban players who misuse the voice chat system or violate community standards.
5. Ownership and Intellectual Property
All rights, title, and interest in Monkey Tag, including all software, graphics, assets, audio, text, and code, are owned or licensed by Andrew Chapman. You are granted a limited, non-exclusive, non-transferable license to play the Game for personal, non-commercial purposes. You may not copy, distribute, modify, or create derivative works based on Monkey Tag without our prior written consent. This work, including but not limited to all software, source code, object code, graphics, artwork, models, textures, animations, audio, music, documentation, trademarks, and other intellectual property, is protected under the Copyright Act (Canada), R.S.C., 1985, c. C-42 and applicable international copyright laws. Portions of this work are registered with the Canadian Intellectual Property Office (CIPO) under Registration No. 1246968, and pursuant to Section 53(2) of the Copyright Act, the Certificate of Registration constitutes prima facie evidence of copyright ownership and subsistence. Any unauthorized reproduction, copying, modification, distribution, publication, public communication, reverse engineering (except where expressly permitted by law), decompilation, asset extraction (including asset ripping), creation of derivative works, or any other exercise of the exclusive rights of the copyright owner constitutes copyright infringement under Section 27 of the Copyright Act. Any person who knowingly distributes, imports, sells, rents, or otherwise deals in infringing copies may also be liable for secondary infringement under Section 27(2). The circumvention, removal, disabling, bypassing, or impairment of any Technological Protection Measure (TPM), digital rights management (DRM), encryption, authentication, anti-tamper, or other security mechanism protecting this work is strictly prohibited under Section 41.1 of the Copyright Act. Andrew Chapman expressly reserves all rights to pursue all available civil and, where applicable, criminal remedies under Canadian law, including injunctions, statutory damages, compensatory damages, accounting of profits, recovery of legal costs, delivery or destruction of infringing materials pursuant to Sections 34–38.1, and criminal enforcement under Section 42 of the Copyright Act. Furthermore, any malicious or unauthorized interference with computer data, software, servers, online services, authentication systems, or security mechanisms associated with this work may constitute an offence under Section 430(1.1) of the Criminal Code of Canada, in addition to any civil liability. All rights not expressly granted are reserved by Andrew Chapman.
Monkey Tag uses third-party services including PlayFab, Photon, and Unity. Your use of these services within the Game is also subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of these third-party services.
Any data, messages, or other content that you create or share through Monkey Tag ("User Content") remains your responsibility. You grant Zapish Studios a worldwide, royalty-free, non-exclusive license to use, display, and distribute your User Content as necessary for operating and improving the Game. You must not upload or transmit any content that is unlawful, defamatory, or violates intellectual property rights.
We reserve the right to suspend or terminate your access to Monkey Tag at any time, without notice, if you violate these Terms, abuse the service, engage in conduct harmful to other players or the community, and even for no stated reason. Upon termination, your right to use the Game will immediately cease.
Monkey Tag is provided "as is" and "as available," without warranties of any kind, either express or implied. We do not guarantee that the Game will be uninterrupted, error-free, or free of harmful components. Your use of the Game is at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law, Zapish Studios and their affiliates, partners, or licensors shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of Monkey Tag, including data loss, service interruptions, or unauthorized access.
You agree to indemnify, defend, and hold harmless Zapish Studios, its affiliates, employees, and partners from any claims, damages, liabilities, or expenses arising from your use of Monkey Tag, violation of these Terms, or infringement of any rights of others.
12. Updates and Modifications
We may update or modify these Terms at any time. The "Last Updated" date at the top of this document indicates when these Terms were last changed. Continued use of Monkey Tag after updates means you accept the revised Terms.
13. Unauthorized Copies & APK Distribution
You may not download, distribute, or promote unauthorized builds, cracked APKs, or repackaged versions of Monkey Tag. This includes versions of the game that bypass authentication, modify gameplay, bypass Technological Protection Measures (TPMs), and/or violate these Terms. Zapish Studios reserves the right to issue takedowns, file DMCA notices, and pursue legal action against unauthorized distribution and breaking technological protection measures (TPMs), even on third-party platforms like Google Drive, MediaFire, or Discord. Zapish Studios may collect and retain IP addresses, account identifiers, and server logs for the purpose of investigating suspected violations and enforcing this Agreement.
These Terms are governed by the laws of Canada and the province of British Columbia, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in that province.
The Game may contain links to third-party websites or services that are not owned or controlled by Zapish Studios. Zapish Studios have no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Zapish Studios shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.
16. Technological Protection Measures
Monkey Tag has Technological Protection Measures (TPMs) to prevent Code Modification of the Game. If such Technological Protection Measures are removed, it will result in legal action following the Canadian Copyright Act R.S.C., 1985, c. C-42 Section 41.1
17. Cease and Desist Policy
Cease and Desist Protocols We reserve the right to issue formal Cease and Desist (C&D) orders against any individual or entity found to be infringing upon our intellectual property rights, distributing unauthorized copies, creating unauthorized modifications (mods) that facilitate cheating or alter the core experience maliciously, hosting unauthorized private servers, or bypassing the Games' Technological Protection Measures (TPMs). Failure to comply with a Cease and Desist order within the stipulated timeframe will result in immediate legal escalation, including but not limited to civil litigation for damages and pursuit of statutory penalties to the fullest extent of the law.
