1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Monkey Jumpers VR ("MJVR," the "Game"), including its online services, multiplayer features, community features, and associated services operated by Spirit Games LLC ("Spirit Games," "we," "us," or "our").

By accessing or using MJVR, you agree to these Terms and any applicable rules presented within the Game. If you do not agree, you must stop using the Game.

Your use of MJVR may also be subject to our End User License Agreement ("EULA"), Privacy Policy, and the terms of third-party platforms and services.

2. Eligibility

You may use MJVR only if you are legally permitted to do so under applicable law and the rules of the platform through which you access the Game.

If you are under the age of legal majority in your jurisdiction, you must have any parental or guardian consent required by applicable law.

You must provide truthful information when required and may not misrepresent your age or identity to evade applicable requirements.

3. Changes to These Terms

We may update these Terms to reflect changes to MJVR, our services, security requirements, or applicable law.

We will make reasonable efforts to notify users of material changes through our website, the Game, or another appropriate communication channel. Where required by law, we will obtain consent or provide additional notice before changes take effect.

The updated Terms will include a revised effective or last-updated date. Continued use after changes take effect constitutes acceptance only where legally permitted.

4. Acceptable Use

You agree to use MJVR fairly, lawfully, and respectfully.

You must not:

• Cheat, exploit bugs, manipulate game mechanics, or use unauthorized tools to gain an unfair advantage.

• Manipulate ranks, matchmaking, leaderboards, rewards, progression, or virtual currency.

• Harass, threaten, bully, stalk, or intentionally disrupt other players.

• Use slurs, targeted abuse, or other prohibited conduct in violation of applicable rules.

• Impersonate Spirit Games staff, developers, moderators, or other players.

• Exploit vulnerabilities or attempt unauthorized access to accounts, servers, or backend systems.

• Disrupt multiplayer sessions, voice services, or the availability of the Game.

• Submit false or deliberately misleading moderation reports.

• Distribute malicious software or use MJVR to facilitate fraud or unlawful activity.

• Circumvent suspensions, bans, or other enforcement measures.

• Use unauthorized modifications that compromise security, fair play, or the integrity of online services.

Nothing in these Terms prohibits conduct that applicable law expressly protects.

5. Cheating, Exploits, and Security

We may use technical systems, gameplay information, player reports, and other relevant evidence to identify suspected cheating, exploitation, unauthorized modifications, account abuse, or security violations.

Players are encouraged to report reproducible bugs and security vulnerabilities through official support channels rather than exploiting them or distributing instructions intended to facilitate abuse.

We may correct improperly obtained rewards, remove illegitimate leaderboard results, reset affected progression, restrict features, or suspend access where reasonably justified.

We do not guarantee that every exploit will be detected or that every report will result in enforcement.

6. Moderation and Enforcement

We aim to maintain a fair and welcoming environment.

Depending on the severity, frequency, and circumstances of a violation, Spirit Games may issue warnings, remove content where supported, restrict features, reset illegitimate progress, temporarily suspend access, or permanently ban a player.

Serious misconduct, repeated violations, cheating, harassment, security attacks, or attempts to circumvent enforcement may result in immediate restrictions where reasonably necessary.

Where available, players may request a review through our official support channel. We may consider relevant evidence and the circumstances of the case. We do not guarantee that every decision can be appealed or reversed.

We may preserve relevant moderation records where reasonably necessary for security, enforcement, or legal compliance, subject to applicable law and our Privacy Policy.

7. Accounts and Player Data

MJVR may use Meta, PlayFab, Photon, and other providers to support authentication, multiplayer connectivity, voice communication, cloud data, and game progression.

You are responsible for maintaining the security of any accounts or platform credentials under your control. You must not use another person's account or credentials without authorization.

Some player data may be associated with platform identifiers or stored by third-party providers. Account availability, saved progression, and access to individual features may be affected by provider outages, account restrictions, technical failures, or changes to third-party services.

We do not guarantee that all progression or data can always be recovered.

8. Virtual Currency, Ranks, and Digital Items

MJVR may offer virtual currency, including JS ("Jumps"), cosmetics, hats, badges, titles, levels, ranks, and other digital rewards.

Unless expressly stated otherwise:

• Virtual currency and digital items are intended for use within MJVR.

• They have no cash value and do not represent a bank deposit, investment, or ownership interest.

• They may not be sold, transferred, exchanged, or redeemed for real money except where we expressly authorize it or applicable law requires otherwise.

• We may adjust game balance, rewards, rankings, prices, progression, or item availability as the Game evolves.

• We may reverse improperly granted currency or rewards and correct leaderboard results affected by cheating or exploitation.

Virtual items and progression may be affected by technical failures, account restrictions, updates, or discontinuation of services. Any mandatory consumer rights remain unaffected.

If MJVR offers paid purchases, additional purchase terms and applicable platform refund policies may apply.

9. Updates and Availability

We may update, maintain, modify, suspend, or discontinue features of MJVR to address compatibility, security, balancing, operational, or development needs.

Online features depend on network connectivity and third-party providers. We do not guarantee uninterrupted availability, error-free operation, or permanent availability of any particular feature.

We may require players to install a supported version of the Game to access online services.

10. Intellectual Property

MJVR and its original software, branding, artwork, maps, models, audio, interface elements, and other original materials are owned by Spirit Games LLC or its respective licensors, except for third-party materials belonging to their owners.

You may not copy, distribute, sell, commercially exploit, or create unauthorized derivative works from protected materials without appropriate permission, except where applicable law permits.

Third-party trademarks, software, and services remain the property of their respective owners.

11. Third-Party Services

MJVR may rely on services operated by Meta, Photon, PlayFab, and other third parties.

Those services may be subject to separate terms, privacy policies, availability conditions, and technical limitations. Spirit Games does not control the operation of independent third-party services.

Nothing in these Terms overrides your rights under applicable third-party terms or mandatory law.

12. Privacy

Our Privacy Policy explains how information associated with MJVR is collected, used, shared, retained, and deleted.

By using MJVR, you acknowledge that your information may be processed as described in the Privacy Policy and as otherwise permitted by applicable law.

These Terms do not replace the Privacy Policy.

13. Disclaimers

To the maximum extent permitted by law, MJVR is provided on an "AS IS" and "AS AVAILABLE" basis.

We do not guarantee that the Game will always be available, secure in every circumstance, compatible with every device, or free from errors or interruptions.

Nothing in these Terms excludes any warranty or protection that cannot lawfully be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Spirit Games LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use MJVR.

To the extent permitted by law, we are not responsible for losses arising from unsupported modifications, user misconduct, or interruptions to independent third-party services beyond our reasonable control.

Nothing in these Terms excludes or limits liability where doing so is prohibited by law.

15. Suspension and Termination

You may stop using MJVR at any time.

We may suspend or terminate access where reasonably necessary to enforce these Terms, protect players, prevent fraud or cheating, address security threats, comply with legal obligations, or discontinue the Game.

Where appropriate and legally permissible, we may provide notice or an opportunity to address a violation. Some situations may require immediate action.

Termination of access does not automatically delete information retained by online services. Data requests are handled under our Privacy Policy.

16. Governing Law

These Terms are subject to applicable law. Any governing-law or dispute-resolution provisions will apply only to the extent permitted by applicable law and without depriving consumers of mandatory protections in their jurisdiction.
