END USER LICENSE AGREEMENT (EULA)

1. Introduction

This End User License Agreement ("Agreement") governs your installation and use of Monkey Jumpers VR ("MJVR," the "Game"), developed and operated by Spirit Games LLC ("Spirit Games," "we," "us," or "our").

By installing, launching, or using the Game, you agree to this Agreement. If you do not agree, you must stop using the Game.

This Agreement governs your license to use the Game. Your conduct, online services, and personal information are also subject to the MJVR Terms of Service and Privacy Policy.

2. License Grant

Subject to this Agreement, Spirit Games grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use MJVR for personal, non-commercial entertainment purposes on supported devices.

This license does not give you ownership of the Game, its software, or its intellectual property.

All rights not expressly granted under this Agreement remain reserved by Spirit Games or the applicable rights holders.

3. License Restrictions

Except where permitted by applicable law or expressly authorized by Spirit Games, you may not:

• Copy, redistribute, publish, or commercially exploit the Game or its protected assets.

• Sell, rent, sublicense, or transfer the Game or your license to another person.

• Reverse-engineer, decompile, or disassemble the Game.

• Modify, tamper with, or create unauthorized derivative versions of the Game.

• Remove or alter copyright notices, trademarks, or other proprietary notices.

• Circumvent technical protections or access restrictions.

• Use unauthorized modifications, cheats, or tools to manipulate online gameplay.

• Access or interfere with backend systems, servers, or services without authorization.

• Use the Game or its assets to create an unauthorized competing distribution of MJVR.

Nothing in this section restricts activities that applicable law expressly permits.

4. Intellectual Property Ownership

MJVR, including its original code, game systems, branding, original artwork, maps, models, audio, interfaces, and other original content, is owned by Spirit Games LLC or its respective licensors, except for third-party materials owned by their respective rights holders.

All applicable intellectual property rights remain with their owners.

Using MJVR does not grant you ownership of its assets, branding, or software. Any rights not expressly granted remain reserved.

Third-party software, assets, and services may be subject to separate licenses or terms.

5. Virtual Currency and Digital Content

The Game may include virtual currency, including JS ("Jumps"), and digital content such as cosmetics, hats, badges, titles, ranks, levels, and other rewards.

Unless expressly stated otherwise:

• Digital content is licensed for use within MJVR and is not a transfer of ownership of the underlying software or intellectual property.

• Virtual currency has no cash value and cannot be redeemed for real-world money.

• Digital content and virtual currency may not be sold or transferred outside authorized systems.

• Spirit Games may adjust, replace, or remove content where reasonably necessary for balancing, security, maintenance, or development.

• Rewards obtained through exploits, cheating, or unauthorized means may be corrected or revoked.

• Access to virtual items may be affected by account restrictions, technical problems, or discontinuation of online services.

Nothing in this Agreement overrides mandatory consumer rights or any applicable refund rights.

6. Updates and Modifications

Spirit Games may release updates, patches, new content, fixes, compatibility changes, and security improvements.

Some updates may be required to continue using the Game or its online features.

We may modify or discontinue particular features where reasonably necessary. We are not obligated to provide updates or support for every device or version indefinitely, except where required by applicable law.

7. Online Services

MJVR may rely on third-party services, including Meta, Photon, and PlayFab, to provide authentication, multiplayer networking, voice communication, cloud saves, leaderboards, and related functionality.

Your use of those services may be subject to additional third-party terms and privacy policies.

Spirit Games does not control all aspects of these independent services and cannot guarantee their uninterrupted availability.

Service outages, changes to third-party platforms, network failures, and compatibility issues may affect your ability to use certain features.

8. Security and Fair Play

You may not use the Game in a manner that compromises its security, integrity, or fair operation.

Unauthorized cheating, exploitation, tampering, or interference with online systems may violate this Agreement and the MJVR Terms of Service.

Where reasonably justified, Spirit Games may restrict access, suspend or terminate your license, correct illegitimate progression, or take other appropriate enforcement measures.

9. Term and Termination

This Agreement remains effective while you use MJVR or retain a license to use it.

Your license may be terminated if you materially violate this Agreement or if Spirit Games discontinues the Game, subject to applicable law.

Where appropriate, Spirit Games may suspend access while investigating suspected violations. Serious security threats or significant abuse may require immediate action.

Upon termination, you must stop using the Game and any materials you are no longer authorized to access.

Termination of your license does not automatically delete personal information or player data held by online services. Data requests are handled in accordance with the Privacy Policy.

10. Disclaimer of Warranties

To the maximum extent permitted by law, MJVR is provided on an "AS IS" and "AS AVAILABLE" basis.

Spirit Games does not guarantee that the Game will be uninterrupted, error-free, compatible with every device, or available indefinitely.

Nothing in this Agreement excludes warranties or legal protections that cannot lawfully be excluded.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Spirit Games LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, MJVR.

To the extent permitted by law, Spirit Games is not responsible for losses resulting from unsupported modifications, misuse of the Game, or interruptions to independent third-party services beyond its reasonable control.

Nothing in this Agreement excludes or limits liability where such exclusion or limitation is prohibited by law.

12. Changes to This Agreement

Spirit Games may update this Agreement to reflect changes to the Game, its licensing arrangements, or applicable legal requirements.

We will make reasonable efforts to notify users of material changes. Where required by law, we will provide additional notice or obtain consent before the changes take effect.

The latest version will display its effective or last-updated date.

13. Relationship to Other Policies

This Agreement should be read together with the MJVR Terms of Service and Privacy Policy.

The Terms of Service govern player conduct, online rules, and enforcement. The Privacy Policy explains how information is processed and how eligible privacy requests may be submitted.

Each document applies to its respective subject matter. Mandatory legal requirements take precedence where applicable.

14. Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
