This Copyright Notice governs your use of the game Monkee ("the Game") and related services operated by Phoenic Analytics ("we," "our," or "us"). By installing, launching, or interacting with the Game or its services, you acknowledge and agree to the terms set forth in this Notice.

1. Ownership and Intellectual Property

All rights, titles, and interests in Monkee, including all software, graphics, assets, audio, text, and code, are owned or licensed by Phoenic Analytics. You are granted a limited, non-exclusive, non-transferable license to play the Game for personal, non-commercial purposes. You may not copy, distribute, modify, or create derivative works based on Monkee without our prior written consent from Phoenic Analytics.

2. DMCA Enforcement

Phoenic Analytics actively enforces its rights under the Digital Millennium Copyright Act (DMCA). We reserve the right to issue takedown notices, file DMCA complaints, and pursue civil and criminal remedies against unauthorised distribution, reproduction, or modification of Monkee, including on third-party platforms. Violators may face statutory damages, actual damages, and recovery of attorney’s fees as permitted by law.

3. Disclaimers

Monkee is provided "as is" and "as available," without warranties of any kind, either express or implied. We do not guarantee that the Game will be uninterrupted, error-free, or free from harmful components. Your use of the Game is at your own risk.

4. Limitation of Liability

To the fullest extent permitted by law, Phoenic Analytics and its affiliates, partners, or licensors shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of Monkee, including data loss, service interruptions, or unauthorized access.

5. Indemnification

You agree to indemnify, defend, and hold harmless Phoenic Analytics, its affiliates, employees, and partners from any claims, damages, liabilities, or expenses arising from your use of Monkee, violation of this Notice, or infringement of any rights of others.

6. Updates and Modifications

We may update or modify this Notice at any time. The "Last Updated" date at the top of this document indicates when this Notice was last changed. Continued use of Monkee after updates means you accept the revised Notice.

7. Unauthorized Copies & Distribution

You may not download, distribute, or promote unauthorized builds, cracked APKs, or repackaged versions of Monkee. This includes versions of the game that bypass authentication, modify gameplay, or remove this Notice. Phoenic Analytics reserves the right to issue takedowns, file DMCA notices, and pursue legal action against unauthorized distribution, even on third-party platforms like Google Drive, MediaFire, or Discord.

8. Governing Law

This Notice is governed by the laws of Canada and the province of British Columbia, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in that province.

9. Recovery of Legal Costs

In any legal action arising from infringement or breach of this Notice, Phoenic Analytics shall be entitled to recover reasonable attorney’s fees, court costs, and any other expenses incurred in enforcing its rights.

10. Enforcement and Remedies

Phoenic Analytics reserves the right to seek all available remedies under law and equity, including injunctive relief, damages, and specific performance, for any violation of this Notice.
