Terms of Service

By purchasing a commission, adoptable, or other work from me, you agree to all of my terms of service, and you will be held to them whether you've read them in full or not. That is your responsibility.

WORKFLOW

• PAYMENT | I accept payment in full before I begin working. I do not accept payment plans or refunds, and I offer minimal holds (a few days at most, with a deposit on work over 35 dollars). I accept Cashapp and Paypal; Cashapp is heavily preferred and Paypal may be subject to a fee. I do not work with currencies other than US dollars.

• OFFTIME  | I do not work on the weekends, nor do I on holidays. There will be no progress on these days, and any updates sent will apply to the last applicable business day.

• ARTIST PROTECTION POLICY  | Due to recent complications with past commissions, I unfortunately have to enforce that commissions that don't receive responses or updates from clients after 6 months may be completed without feedback or even voided at my discretion, likely to be the latter depending on queue. This is to ensure fairness to all clients on my queue, to potential clients interested in my time, and to myself, who looks forward to a free queue every now and then for personal matters. This policy pertains to all relevant commissions, past and present. Please do not rush me to complete a commission if you have not or cannot provide feedback / "go aheads" in a timely manner.

MY WORK

• TAT | My TAT is typically a few weeks to a few months, and is very loose. I struggle with my mental health, I am still in school, and I take frequent breaks due to my lack of proper drawing equipment. If you want an artist with a speedy TAT, commission someone else. You are entitled to wips and timely updates accordingly, but please do not rush me and be mindful of my working speed.

• REFERENCES | I have aphantasia, and I am completely unable to visualize. Due to this, I only work with characters with a proper and complete visual reference. This includes a colored front view, back view, teeth view, tongue view, gum view, and paw view. Sloppy, description, or incomplete references will not be accepted.

• ART STYLE | Please keep in mind that I do not use pure black (#000000) or pure white (#FFFFFF) in my artwork. If your character features any of these colors, the hue will be shifted. Additionally, extremely dark or extremely light colors may be adjusted to improve the piece's readability. The artwork may not be 1:1 with your character in color, and if you are not okay with this, it is recommended that you commission another artist.

• CREDIT | You are entitled to share your commission or adoptable on your social platforms and within your circles. However, art of mine that is reposted without proper credit to me ("@modernlycann on Instagram" or a link to one of my other socials) will result in a blacklisting. Do not ask me to and do not attempt to remove my watermark under any circumstances.

• RIGHT TO REFUSE | I reserve the right to refuse any commission for any reason. Those who violate my TOS, are on my blacklist, or are on my DNI will not receive service from me under any circumstances and in any form. I can also void and refund a commission at any time for any reason.

COPYRIGHT AND USAGE

• COMMERCIAL | My work is for personal use only. It is not to be used in a commercial manner or for monetary gain under any circumstances, this includes but is not limited to advertisements, merchandise, endorsements, commercial products and services, etc.

• USAGE | I reserve the rights to all of my work. You are not to copy, trace, edit, heavily reference, redistribute, resell, or claim any of my work as your own without my explicit and written permission. Do not use my artwork or characters for roleplay or similar accounts or purposes. 

• AI | You are not permitted to use my work for artificial AI training or to be fed into any artificial intelligence systems. Doing so will result in an immediate blacklisting. I do not work with anyone who condones AI or AI usage under any circumstances.
