According to Paragraph 9 of Appendix No. 1 of Decision No. 305 of the Cabinet of Ministers of the Republic of Azerbaijan dated October 14, 2013, mobile phones and other wireless devices imported from abroad must be necessarily declared to the customs authority.

Starting from February 15 of the current year, in order to register the mobile phones in the website portal.rinn.az, their registration in the electronic system of the State Customs Committee is required.

In turn, the Ministry of Digital Development and Transport informed that from February 15, IMEI will not be registered for mobile phones imported into the country by individuals for personal use and not declared at the customs authorities.

It should be noted that for the registration of IMEI (International Mobile Equipment Identity - the international identifier of mobile equipment) of the Ministry of Communications, you have to pay another 20 to 150 dollars, depending on the price of the phone.

Besides, state fee for registration of mobile devices must be set according to the market prices of the mobile device. To set the registration fee of mobile devices for the market prices, Data Processing Center of the Ministry of Transport, Communications and High Technologies (MTCHT) has developed an information system and integrated it into the website www.imei.az. At the same time, according to the relevant item (1.2) of the decision of the Cabinet of Ministers, necessary information has also been posted on the official website of the Ministry of Transport, Communications and High Technologies.

It is to be recalled that the registration of mobile devices in our country has been conducted since 2013. During registration, a mobile device is checked for compliance with the standards of the International GSM Association. Mobile Device Registration System (MDRS) does not allow the use of devices that are not approved by the International GSM Association. These standards, along with technical specifications, also prevent the sale of low-quality mobile phones emitting harmful radiation to human body.

The mobile device registration system does not allow the use of lost and stolen phones on the network. The use of the lost device in the territory of the republic is terminated at the request of the device owner.

Citizens can register their mobile devices online by accessing www.imei.az or www.smartpay.az. They can also apply to "Shebeke" service centers and post offices for registration.

The introduction of 5G technology could also impose additional costs on users. The average fee for a 5G-supporting mobile device on the market starts at 600 manat ($353) for Androids and 1,600 manat ($941) for iOS-operated mobile phones.11 As of January 2022, the minimum wage in Azerbaijan was 300 manat ($176) per month, according to official data released in December 2021.12

The SIM cards, serial numbers, and phone numbers of all mobile phones in Azerbaijan must be registered. This requirement was introduced by the Cabinet of Ministers in 2011 without parliamentary approval.1 Mobile operators are required to limit service to any unregistered devices. Mobile operators have also started linking SIM cards to Asan Imza, a government-launched mobile ID service, though it is not required.2

In January 2019, the government shut down mobile internet and phone service during a political rally; later, scores of attendees were questioned by police based on location data taken from their mobile devices. Many took to social media platforms to accuse mobile service providers of disclosing the names, phone numbers, and location data of subscribers who attended the rally. When Azadliq Radio inquired about these accusations, mobile companies cited the need to comply with certain legislation. Under Article 39 of the Law on Communication, the service providers are obliged to provide government institutions with any requested subscriber data.6

Azerbaijan has established fines for changing or copying the mobile device's IMEI number (International Mobile Equipment Identity) in order to prevent avoiding mobile device registration, News.az reports.

The majority of national governments (around 160) require mandatory SIM-card registration, which means you need your real name and personal details to sign up for phone service. And just under 20 of these also require biometrics, e.g. your fingerprints or a facial scan, with eight more countries in the process of implementing such requirements.

Furthermore, Qatar faced controversy during the 2022 World Cup for mobile phone tracking through apps as well as the possibility that they could track SIM cards. The country introduced new rules for football fans, making it much easier for them to obtain SIM cards. However, news outlets questioned the likelihood that phones were being tracked through IMEI numbers, SIM cards, and apps used on the phone.

April 15th: In a surprise move, President Duterte vetoed proposed legislation approved by both chambers seeking to mandate the registration of all SIM cards and social media accounts in the country according to reports. The reason appears to be that the original scope of the SIM Card Registration Bill had expanded to include registration of social media accounts where users must provide a real name and phone number on creating an account.

Simultaneously, The Kenya Kwanza Alliance (a coalition of political parties) has threatened to file a case to stop the ongoing nationwide SIM card registration by mobile network operators in the country. The deadline for registration is 15th April.

In February, it was reported that Safaricom, one of the leading mobile telephone network providers in Kenya, is asking users to visit the nearest Safaricom shop or any partner agency with their IDs to update their SIM details in a process that will also require submitting face biometrics.

In July, Telenor Myanmar announced an agreement to sell 100% of mobile operations to M1 Group and exit the market. Part of the sale would reportedly include transferring personal data of subscribers to the new entity, including call records and location data. Civil society are fearful this data will be passed onto the junta by M1 Group. PI responded that the transfer of this personal data, on top of information provided during mandatory SIM registration, such as ID cards and addresses, makes people even more vulnerable to surveillance and arrest. In December 2017, it was reported that the Cabinet planned to introduce biometric SIM card registration, which would force Lebanese citizens and residents to provide a thumbprint to purchase a SIM card. Similarly, the Lebanese government reintroduced a proposal for IMEI registration, mandating that everyone who purchased a phone to have their identity attached to the IMEI number of the device. The Ministry of Security ordered the Uganda Communications Commission to verify information provided by telephone users in the SIM card registration system by matching it with data collected during the National Identity card registration exercise. To bring its mandatory SIM card registration policy in line with the Registration of Persons Act 2015, Uganda required that people register their SIM card exclusively with their national ID card, as no other form of ID will be accepted going forward.
