1. Acceptance of Terms

By accessing or using the MindPark application (hereinafter referred to as "the App"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree to these Terms, you must not use the App. MindPark reserves the right to modify these Terms at any time without prior notice. Your continued use of the App constitutes your acceptance of any such changes.

2. Eligibility

To use the App, you must be at least 6 years old. By using the App, you represent and warrant that you meet this age requirement. If you are under 13, you must have your parent or guardian’s permission to use the App.

3. User Account

• Account Creation: To access certain features of the App, you may be required to create an account. You must provide accurate and complete information and keep your account details updated.

• Security: You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

• Termination: MindPark reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to a violation of these Terms.

4. Use of the App

• Permitted Use: You are granted a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

• Prohibited Use: You agree not to use the App for any unlawful purpose or in any way that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App. Prohibited activities include, but are not limited to, using the App to:

  • Engage in any fraudulent or deceptive activities.

  • Upload or transmit viruses or other harmful code.

  • Violate the intellectual property rights of MindPark or others.

  • Collect or store personal data about other users.

5. Intellectual Property Rights 

• Ownership: All content and materials on the App, including but not limited to text, graphics, logos, and software, are the property of MindPark or its licensors and are protected by intellectual property laws.

• Restrictions: You may not copy, modify, distribute, sell, or lease any part of the App or its content without prior written permission from MindPark. You may not reverse engineer or attempt to extract the source code of the App.

6. User Content 

• Responsibility: You are solely responsible for any content you upload, post, or otherwise make available through the App. You grant MindPark a worldwide, royalty-free, non-exclusive license to use, distribute, reproduce, modify, and display such content in connection with operating and providing the App.

• Monitoring: MindPark reserves the right, but not the obligation, to monitor and review user content and to remove or edit any content that it deems in violation of these Terms or otherwise inappropriate.

7. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which can be found here. By using the App, you consent    to the practices described in the Privacy Policy. 

8. Disclaimers 

• No Warranty: The App is provided "as is" and "as available," without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

• No Guarantee: MindPark does not guarantee that the App will be uninterrupted, secure, or error-free, or that any defects will be corrected.

9. Limitation of Liability 

To the fullest extent permitted by applicable law, MindPark shall not be liable for any direct, indirect, incidental,      special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the App, even   if MindPark has been advised of the possibility of such damages. 

10. Indemnification 

You agree to indemnify, defend, and hold harmless MindPark and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App or violation of these Terms. 

11. Governing Law 

These Terms and any dispute arising out of or in connection with these Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MindPark operates, without regard to its conflict of law provisions. 

12. Dispute Resolution 

• Informal Resolution: Before resorting to formal legal action, you agree to contact MindPark to seek an informal resolution to any disputes.

• Arbitration: If a dispute cannot be resolved informally, it shall be resolved by binding arbitration in accordance with the rules of the jurisdiction in which MindPark operates.

13. Changes to the App 

MindPark reserves the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice. 

14. Miscellaneous 

• Entire Agreement: These Terms constitute the entire agreement between you and MindPark regarding your use of the App and supersede all prior agreements and understandings.

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

• Waiver: The failure of MindPark to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
