Welcome to the Melkah application. Please read these Terms carefully before using the app. By using the app, you agree to be bound by these Terms, which constitute a legally binding agreement between you and Al-Qa'id Personal Establishment for Trading.
1. Eligibility and Use of Service
1.1 Legal Eligibility
Users must be at least 18 years of age. If a user is found to be under this age, we reserve the right to immediately delete their account and all associated data.
1.2 Purpose of Service
The Melkah application is designed to enable users to search for a life partner in an organized and safe manner, in accordance with Islamic values and Saudi culture, while preserving and protecting user privacy.
2. User Obligations and Conduct
2.1 Legal Compliance
Users agree to comply with all applicable laws and regulations in the Kingdom of Saudi Arabia and any relevant international laws in connection with their use of the application.
2.2 Prohibited Content and Conduct
Users are prohibited from posting or transmitting any content that:
• Violates Islamic Sharia law or public morals
• Constitutes harassment, threats, defamation, or infringement of the rights of others
• Contains explicit sexual or violent material
• Contains personal or confidential information of any third party without their consent
2.3 Security
Users must not attempt to gain unauthorized access to the application's systems, interfere with its operation, or transmit viruses or malicious code of any kind.
2.4 No Fraud
Creating fake or duplicate accounts in violation of our policies, or misusing the platform in any way, is strictly prohibited.
3. Personal Data Protection and Privacy
Al-Qa'id Personal Establishment for Trading is fully committed to compliance with the Saudi Personal Data Protection Law (PDPL), the European General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA).
3.1 Privacy Policy
This Privacy Policy forms an integral part of these Terms and explains how your personal data is collected, used, processed, and protected.
3.2 Data Collected
We collect the following categories of personal data:
• Registration and profile data: name, age/date of birth, gender, city/region, interests and preferences, profile photos, email address
• Technical data: IP address, device type, operating system, in-app activity log, device identifier (UDID)
The application does not collect biometric data or copies of official identity documents.
3.3 Purpose of Processing
Personal data is used exclusively for the following purposes:
• Creating and managing your user account
• Enabling spouse search and personalizing results
• Improving service quality and user experience
• Enhancing security and reducing fraud and misuse
• Compliance with applicable local and international regulations
3.4 Data Security
We implement appropriate technical and organizational measures to protect your personal data, including:
• Data encryption in transit (TLS/SSL) and at rest
• Access to data restricted to authorized personnel only, based on the principle of least privilege
• Regular review of security controls and protection procedures
• Data classification by sensitivity with appropriate controls applied to each category
3.5 Data Breach Notification
In the event of a personal data security breach:
• The Saudi Data & AI Authority (SDAIA) will be notified within 72 hours of discovering the breach, in accordance with Article 20 of the PDPL
• Affected data subjects will be notified promptly upon confirmation of the breach and determination of its scope
• All breaches will be documented and appropriate corrective actions will be taken
3.6 Transfer of Data Outside the Kingdom of Saudi Arabia
The application uses a number of technical service providers whose servers may process your data outside the Kingdom, including:
• Firebase (Google) — analytics and notifications
• Twilio — WhatsApp verification messages
• RevenueCat — subscription management
• Faceki — identity verification
Personal data is only transferred outside the Kingdom in accordance with the safeguards set out in Article 29 of the PDPL:
• Verifying that the receiving party provides an adequate level of protection equivalent to that in the Kingdom
• Executing written contracts with all service providers obligating them to maintain data confidentiality and protection
• Limiting transfers to the minimum necessary for service delivery
• Documenting all international data transfers
3.7 Your Rights
A. Under Saudi PDPL:
• Right to access your personal data and obtain a copy
• Right to correct inaccurate or incomplete data
• Right to request deletion of data once the purpose for collection has been fulfilled
• Right to restrict processing of your data in specified circumstances
• Right to object to the processing of your data
B. Under GDPR (European users):
• All rights listed above, plus the right to data portability
• Right to withdraw consent at any time without affecting the lawfulness of prior processing
C. Under CCPA (California users):
• Right to know what personal data has been collected and the purpose of collection
• Right to request deletion of personal data
• Right to opt out of the sale or sharing of personal data
• Right to non-discrimination when exercising these rights
3.8 Exercising Rights and Response Times
Requests to exercise your data rights may be submitted via:

We are committed to responding to access, correction, and deletion requests within no more than 30 business days from the date the request is received, in accordance with applicable regulations.
3.9 Data Retention and Disposal
Personal data is retained for as long as your account remains active. Upon requesting deletion or closing your account:
• Data is securely deleted within 30 days
• Certain data may be retained for a longer period if required by legal or regulatory obligations
• Data is disposed of using secure methods that prevent recovery
3.10 Sharing with Third Parties
Your personal data is never sold or rented to any third party. Sharing occurs only in the following circumstances:
• Technical service providers necessary for operating the application (who are contractually bound to protect data in accordance with PDPL, GDPR, and CCPA)
• Compliance with orders from competent judicial or regulatory authorities
• Protection of user or application rights in cases of necessity
4. Intellectual Property
All content, materials, and designs within the application, including trademarks, copyrights, and the Melkah logo, are the exclusive property of Al-Qa'id Personal Establishment for Trading or its licensors, and are protected under the intellectual property laws applicable in the Kingdom of Saudi Arabia.
5. Disclaimers and Limitation of Liability
5.1 Disclaimer
The application is provided on an "as is" and "as available" basis, without any express or implied warranties regarding the accuracy, completeness, or fitness for a particular purpose of the services.
5.2 Limitation of Liability
Al-Qa'id Personal Establishment for Trading shall not be liable for any direct, indirect, or consequential damages arising from the use of or inability to use the application, to the extent permitted by applicable law.
6. Indemnification
Users agree to indemnify and hold harmless Al-Qa'id Personal Establishment for Trading and its affiliates from any claims, damages, or losses arising from their violation of these Terms or unlawful use of the application.
7. Termination and Modification of Terms
7.1 Termination
We reserve the right to suspend or terminate your account at any time in the event of a violation of these Terms. In non-urgent cases, we will endeavor to notify you before taking action.
7.2 Modification
These Terms may be modified at any time. You will be notified of any material changes via the application or email with reasonable advance notice before they take effect. Continued use of the application after modifications are published constitutes acceptance of the updated Terms.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Both parties agree to the jurisdiction of the competent Saudi courts for the resolution of any dispute arising therefrom. In the event of any conflict between these Terms and applicable Saudi regulations, the Saudi regulations shall prevail.
9. Data Protection Officer
Al-Qa'id Personal Establishment for Trading has designated a Data Protection Officer (DPO) responsible for overseeing compliance with applicable data protection regulations. To contact the DPO or to exercise any of your rights:
