These Terms of Use (“Terms”) govern your use of the AI Meal Planner mobile application (the “App”) by Sergey Holin (“Provider,” “we,” or “us”). They are a legal agreement between the user (“you”) and the Provider.
Acceptance
By downloading, accessing, or using the App, you accept and agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
Definitions
App: AI Meal Planner mobile application for iOS.
User Data: Information you provide, such as height, weight, age, dietary preferences, allergies, goals, and photos of meals (if uploaded for analysis).
AI Recommendations: Meal plans, calorie calculations, nutrition estimates, and diet suggestions generated by the App.
Subscription: Paid access to premium features, such as unlimited meal plans, advanced AI analysis, or ad-free experience.
License and Usage
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only.
You agree not to use the App for illegal, harmful, or misleading purposes.
Important Health Disclaimer: The App provides general informational suggestions only and is not medical or professional nutrition advice. AI Recommendations are estimates based on user input and public data; they may be inaccurate or incomplete. Always consult a qualified healthcare professional or registered dietitian before starting any diet, nutrition plan, or making health changes. We are not responsible for any health issues, injuries, or outcomes from using the App.
By using the App, you agree that if we receive a refund request for an in-app purchase from an end user, we reserve the right to provide Apple with information regarding the user's in-app purchase consumption. This includes data such as app usage time, anonymous account identifier, total amount spent, and total amount refunded.
User Data
You retain rights to your User Data.
By providing User Data (including meal photos), you grant us a license to process it temporarily to generate AI Recommendations.
We do not store sensitive health data longer than necessary and do not use it beyond providing the App's features.
You are responsible for the accuracy of your User Data and ensuring it does not violate others' rights.
Subscriptions & Payments
The App offers free basic features (e.g., limited daily calorie tracking or meal suggestions).
Premium features require a paid Subscription (monthly or yearly), charged via Apple App Store.
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the period.
Prices and details are shown in the App before purchase. Refunds are handled by Apple.
Account Security
If the App requires an account, you are responsible for keeping your credentials secure and for all activity under your account.
Termination
We may suspend or terminate your access at any time, for any reason, including violation of these Terms.
Upon termination, your right to use the App ends, and we may delete your data.
Disclaimer of Warranties
The App is provided “as is” without warranties of any kind. We do not guarantee accuracy, completeness, or suitability of AI Recommendations. Use at your own risk.
Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid us in the last 12 months.
Governing Law
These Terms are governed by the laws of United States.
Miscellaneous
These Terms and our Privacy Policy form the entire agreement.
We may update the Terms; continued use means acceptance of changes.
