These Terms of Service (these "Terms") set forth the terms between the Development Team and the users ("Users") of the Hoop MBTI App (the "Service").
"App" means the application software designed for smartphones and/or tablet computers which is provided by the Development Team for the Service."Test Data" means the test answers, result reports, and related personal MBTI type analysis data generated by Users during the use of the Service.
(1) Users shall consent to these Terms and use the Service in accordance with these Terms.
(2) Minors may use the Service only by obtaining consent from their legal guardian, such as a parent.
(3) Any matters not stipulated in these Terms are subject to applicable laws, regulations, and platform rules.
All rights in regard to the App and the Service (including, without limitation, intellectual property rights such as copyrights, trademark rights, patent rights, etc.) shall be retained by the Development Team or the third party licensors of such rights.
(1) The Development Team shall provide Users with MBTI personality testing services, including but not limited to:
Multiple-length MBTI type assessment questionnaires
Personalized MBTI type analysis reports
Historical test record management
Result sharing functionality
Detailed descriptions of the nine MBTI types
(2) The test history and use rights with respect to the Service will no longer be available when the App is deleted from smartphones or tablet computers, and Users will not be able to transfer the test history and use rights to another device.
(3) The Development Team reserves the right to provide Users with advertisements through the Service.
(4) The Development Team reserves the right to modify, cease, or terminate, at its own discretion, the whole or part of the Service at any time without any prior notice to Users.
(1) The Development Team places the highest priority on the privacy of Users and exercises the utmost care regarding security measures for the continued security of any and all information collected from Users.
(2) For the handling of Users' test data and personal information, please refer to the Privacy Policy.
(3) Users' MBTI test results are used solely to provide personalized services and will not be disclosed to third parties without Users' consent.
Users shall not engage in any of the following acts when using the Service:
(1) Acts that violate the law, court verdicts, resolutions or orders, or administrative measures that are legally binding;
(2) Acts that may hinder the public order or customs;
(3) Acts that infringe intellectual property rights, fame, privacy, and all other rights of the Development Team and/or a third party granted by law or contract;
(4) Acts of posting or transmitting violent, explicit sexual content, discriminatory expressions, or other inappropriate information;
(5) Acts that may lead to the misrepresentation of others or intentionally spread false information;
(6) Acts of using the Service for harassment or other improper purposes;
(7) Acts that interfere with the servers and/or network systems of the Service, that abuse the Service by means of plugins, cheat tools, or other technical measures;
(8) Acts of making unreasonable inquiries or interfering with the Service operation;
(9) Acts that aid or encourage any activity stated above or other acts deemed inappropriate by the Development Team.
(1) Users shall use this Service at their own risk and shall bear all responsibility for any action carried out and the results upon the use of this Service.
(2) Users are responsible for backing up and storing their test data. The Development Team does not guarantee permanent data storage.
(3) If a User violates these Terms, the Development Team may take necessary measures including but not limited to suspending or terminating the Service.
(4) If the Development Team suffers loss/damage due to a User's use of the Service, such User shall compensate the Development Team upon its request.
(1) The Development Team does not expressly or impliedly guarantee that the Service is free from defects, including but not limited to stability, reliability, and accuracy.
(2) The Development Team shall not be responsible for any damage inflicted upon Users in relation to the use of the Service.
(3) MBTI test results are for reference only and do not constitute professional psychological counseling advice. Users should treat test results rationally and understand that the Hoop MBTI is a tool for personal growth and self-awareness.
(4) The Development Team's liability for compensation shall be limited to the total amount of service fees received from the User in the particular calendar month.
The Development Team may modify these Terms when it deems necessary without providing prior notice to Users. The modification will become effective once the modified Terms are posted in the App. Users shall be deemed to have granted valid consent to the modified Terms by continuing to use the Service.
(1) If any provision of these Terms is deemed invalid, the remaining provisions shall remain in effect.
(2) The Development Team reserves the right to interpret these Terms.
