COMMERCIAL USE:

I will do commercial work but there will be extra charges and payment depending on the format of use. 

Commercial prices include a +60% charge, rounded to the nearest dollar, depending on the project and use. 

Merch and other items will require inquiry and negotiations; I am uncomfortable with merch being sold without payment in some way. If you plan to use my work in this way, we must discuss it and come to an agreement on proper payment.  

Payment, half to full, must be sent via Paypal/Stripe/Ko-fi before I begin working.

In the case of a cancel or other issue, I will refund money if the work hasn't been completed/A large portion of work hasn't been done. 

If a work HAS been completed and you are unhappy, I am open to making some changes to the existing work but you will not be given a refund and large changes may result in extra charges.

After an order is completed, a few small changes may be made but anything major or requires extra work will require an extra charge. 

I prefer payment/ordering through ko-fi, but I will set up an invoice if need be. Just keep in mind that certain financial companies(paypal, stripe, etc.) take different and sometimes hefty fees, especially for conversion of currencies. If you need more info on this, feel free to ask!!

If you wish to be given a WIP,  please specify. Otherwise, unless I'm confused or have questions, I won't send one! This is due to how i work on art/work ethic. I will always give an update when asked and will do my best to inform you of anything that may hinder progress. 

I usually don't, but may post WIPs time to time. I also may post art soon after it's been approved. If you would like me to not post your art/hold out until a certain date/etc, PLEASE let me know. 

Please note, I have a fast turnaround time; Most work is typically completed within days to a week of ordering. This means: (1) you should be available to answer questions and requests for additional info, (2) you are aware your piece may be far in the process and adding extra details days after ordering may be impossible or complicated. If you are not communicative and attentive in the information you provide before the process begins, I am not liable for your work turning out in a way that you did not intend or want.(i.e. I was not informed __ was  supposed be a demon now and the refs didn't show this, so i drew__ as a regular ol' joe-- I am not responsible for critical information being withheld from me!!) By agreeing to my ToS or purchasing commissions through ko-fi/invoice, you are agreeing you are aware of this term and reliable for sending me the necessary information.

Any aggressive, overly personal, abusive, discriminating, belittling, harmful, or offensive speak/communication will not be tolerated and may end with termination of your order or you being added to a blacklist. By agreeing, you are agreeing to speak respectfully and understandably and are acknowledging that any hateful/aggressive/negative speak will result in cancellation and possibly partial/full refund if the work is not completed/mostly completed. 

My art is still my art. I hold the right to re-use the art I create for you in my feed, gallery, samples, art collages, etc. I will not resell your art or repurpose it for anyone else unless you give me permission. 

You CANNOT use my art for NFT/AI purposes.  Client shall not reproduce and/or otherwise use my work in any manner for purposes of training artificial intelligence(AI) technologies that are capable of generating works in the same style or genre as the work/artwork originally created by me, nor shall clients sublicense others to reproduce and/or otherwise use the work in any manner for purposes of training artificial intelligence(AI) technologies to generate work. As the original creator, and therefore rights holder of my creations, only I should control who is/what sites are using/selling my work. 

You are not permitted to resell my art under any circumstances. If you are selling a character I did art of, my art must be sold in package with the character for no additional fee/not sold separately. (ex. i did art of your character Timmy, but now you want to sell Timmy on toyhouse. You must give my art with Timmy and not ask Timmy's buyer to pay you for it.)

No removing my name/watermark from your piece. **

No stealing and claiming as your own. If you wish to put the art piece on a website like toyhou.se for your character, give me credit! Link my twitter, ko-fi, or better yet my carrd! 

I will never hand out your personal information. By agreeing, you also confirm you will not hand out my personal information you may see/become privy to through transactions.

When asking for a commission, please be respectful. Do not be vague or difficult to communicate with, it's frustrating and might make me confused! I want to make sure i'm doing you justice! 

There might be more. I'll update this when I find other important info to disclose or a situation arises. I have the right to change my ToS as need be.

**If you intend to use my work for commercial purposes where a watermark would be hidden, gaudy or disrupt flow, please discuss it with me. As long as we have discussed how to properly credit me, I do not mind sending an unmarked version for your use. Never remove my watermark; but you are free to discuss the use with me and I would be happy to send an unmarked version  for your project.
