Mammoth AI 

Please read these Terms of Use ("Terms") carefully before using the Mammoth AI application.

By creating an account, downloading the App, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Mammoth AI is a subscription platform that provides users with access to multiple third-party generative AI models — including large language models, image generation models, and video generation models — through a single unified interface. Available models and pricing tiers are described at https://mammouth.ai/pricing and may change from time to time.

Mammoth acts as an intermediary that routes your requests to underlying AI providers. We do not develop or train the underlying AI models ourselves; they are provided by independent third parties (e.g., OpenAI, Anthropic, Google, Mistral, xAI, and others) under our commercial agreements with them.

2. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using Mammoth AI, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Accounts

• You must provide accurate and complete information when creating an account.

• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

• You must notify us immediately at [email protected] of any unauthorized use of your account.

• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions, Billing, and Cancellation

• Access to certain features requires a paid subscription. Current plans and pricing are listed at https://mammouth.ai/pricing and, where purchased via the Apple App Store, are governed by Apple's applicable pricing and billing terms.

• Auto-renewal: Subscriptions purchased through the App automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date.

• Managing subscriptions: If you subscribed via the Apple App Store, you can manage or cancel your subscription through your Apple ID account settings. If you subscribed via our website, you can manage your subscription from your Mammouth account settings.

• Refunds: Purchases made through the Apple App Store are subject to Apple's refund policies. Purchases made directly through our website are subject to our refund policy available at [link], where applicable law requires or permits.

• Price changes: We may change subscription prices from time to time. We will provide advance notice of any price increase before it applies to your next billing cycle.

• Free trials or credits: If offered, free trials or usage credits are subject to the specific terms disclosed at the time of the offer and may be modified or discontinued at our discretion.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation;

• Generate, upload, or distribute content that is unlawful, defamatory, harassing, hateful, obscene, or infringing on the rights of others, including intellectual property, privacy, or publicity rights;

• Generate child sexual abuse material, content sexualizing minors, or any content exploiting or endangering minors;

• Generate malware, phishing content, or material intended to facilitate cyberattacks or fraud;

• Generate content that provides instructions for creating weapons, explosives, or other materials capable of causing mass harm;

• Attempt to reverse-engineer, extract, or replicate the underlying AI models accessed through the Service;

• Use automated means (bots, scrapers) to access the Service outside of officially supported integrations (e.g., our API), or interfere with the Service's operation, security, or availability;

• Misrepresent AI-generated content as being created by a human where such misrepresentation could cause harm, or use the Service to generate misinformation intended to deceive;

• Circumvent usage limits, rate limits, or subscription tiers through unauthorized means;

• Resell, sublicense, or provide unauthorized third-party access to the Service.

We reserve the right to suspend or terminate access for any account found to violate this Acceptable Use section, and to report unlawful content to relevant authorities where required.

6. Third-Party AI Models

• The Service provides access to AI models developed and operated by independent third-party providers. We do not control, and are not responsible for, the accuracy, reliability, legality, or appropriateness of outputs generated by these third-party models.

• AI-generated content (text, images, video) may be inaccurate, biased, offensive, or otherwise objectionable. You are responsible for independently verifying any output before relying on it, especially for professional, medical, legal, or financial decisions.

• Availability of specific models is subject to change based on our agreements with third-party providers and is not guaranteed.

• Each third-party provider's own usage policies may apply to content generated using their models; you agree to comply with such policies where disclosed.

7. Intellectual Property

7.1 Our IP

The Mammoth AI name, logo, App design, and underlying software (excluding third-party AI models and User Content) are owned by Mammoth AI or its licensors and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service without our prior written consent.

7.2 Your Content

You retain ownership of the prompts and files you submit ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to process it solely for the purpose of operating and providing the Service (e.g., transmitting it to the AI model you selected and returning the output to you). We do not use your User Content to train any AI model.

7.3 AI-Generated Output

Subject to the terms of the underlying AI provider and applicable law, you may generally use output generated through the Service for your own purposes. However, ownership and usage rights of AI-generated content can vary by jurisdiction and by the policies of the underlying model provider, and in some cases may not be eligible for copyright protection. You are responsible for ensuring your use of generated output complies with applicable law and any third-party rights.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, available at https://mammouth.ai/privacy-policy (or the equivalent link in the App), which describes how we collect, use, and protect your information.

9. Disclaimers

THE SERVICE, INCLUDING ALL AI-GENERATED OUTPUT, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR INTENDED USE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAMMOUTH AI AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON AI-GENERATED OUTPUT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Nothing in these Terms limits liability that cannot be excluded or limited under applicable law (e.g., liability for gross negligence, willful misconduct, fraud, or death or personal injury caused by negligence).

11. Indemnification

You agree to indemnify and hold harmless Mammoth AI, its affiliates, and their respective officers and employees from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any third party's rights.

12. Termination

• You may stop using the Service and delete your account at any time.

• We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law.

• Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability) will survive.

13. Changes to the Service or Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; material changes will be communicated via the App or by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply and take precedence in the event of conflict with these Terms as they relate to the App Store:

• These Terms are between you and Mammoth AI only, not with Apple, and Apple is not responsible for the Service or its content.

• Apple has no obligation to provide maintenance or support for the App.

• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

• Apple is not responsible for addressing any claims relating to the App, including product liability claims, legal compliance claims, or claims under consumer protection law.

• Apple is not responsible for investigating, defending, or resolving any claims that the App infringes a third party's intellectual property rights.

• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

• You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of [Jurisdiction], without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of [Jurisdiction/Venue], except where mandatory consumer protection laws in your country of residence provide otherwise.

16. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mammoth AI regarding the Service.

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.

• No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
