TERMS OF USE (END USER LICENSE AGREEMENT)

These Terms of Use ("Terms") govern your use of the Makely iOS app (the "App") provided by Makely ("we," "us"). By downloading or using the App, you agree to these Terms.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, in accordance with these Terms and the Apple Media Services Terms. You may not reverse-engineer, sublicense, or redistribute the App.

2. Subscriptions

• Plans: Makely Pro is offered as a monthly subscription at $11.99/month and an annual subscription at $59.99/year (prices may vary by region).

• Free Trial: New subscribers receive a 7-day free trial. The trial automatically converts to a paid subscription unless cancelled at least 24 hours before it ends.

• Auto-Renewal: Subscriptions renew automatically at the end of each period at the then-current price unless cancelled.

• Cancellation: Manage or cancel your subscription any time in iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period.

• Refunds: All payments are handled by Apple. Refunds are governed by Apple's policy; contact Apple Support to request one.

3. AI-Generated Content — Important Disclaimer

Makely uses AI to extract and generate project details, including materials lists, dimensions, tools, and step-by-step instructions. AI output may be inaccurate, incomplete, or unsafe. Before purchasing materials, beginning construction, or following any extracted plan, you are solely responsible for verifying:

• Material quantities, dimensions, and specifications.

• Tool selection and safe operation.

• Structural, electrical, plumbing, and load-bearing considerations.

• Compliance with local building codes, permits, and safety regulations.

Makely is a planning aid, not a substitute for professional advice. For projects involving electricity, gas, plumbing, structural changes, or work at height, consult a qualified professional.

4. User Content and Conduct

When you paste a link or share content into the App, you represent that you have the right to do so. Do not submit content that is private, copyrighted by others without permission, or violates the source platform's terms. You are responsible for the content you submit.

You agree not to use the App to: violate any law, infringe intellectual property rights, harass others, attempt to disrupt the App's operation, or extract content at a scale or rate that could harm third-party services we rely on.

5. Intellectual Property

The App, including its design, code, branding, and marketing content, is owned by Makely. Projects you create remain yours.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKELY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR PROPERTY, ARISING OUT OF YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Apple-Required Acknowledgements

You acknowledge that these Terms are between you and Makely, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support for the App. In the event of any failure of the App to conform to applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

9. Termination

We may suspend or terminate your access to the App at any time for breach of these Terms. You may stop using the App at any time by uninstalling it.

10. Governing Law

These Terms are governed by the laws of the Republic of Uzbekistan, without regard to conflict-of-laws principles. Disputes shall be resolved in the courts of the Republic of Uzbekistan.

11. Changes

We may update these Terms. Material changes will be posted with a new Effective Date. Continued use means you accept the updated Terms.
