Please read these Terms of Use ("Terms") carefully before using the Lyn mobile application ("the App"), operated by Botart Yazılım ve ARGE AS ("We" or "Us"). Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the App.
Lyn is a mobile application that allows users to generate images using artificial intelligence technology. The App enables users to create images through text prompts (text-to-image) or by transforming existing images (image-to-image) using generative AI models. The App processes your inputs to generate unique visual content based on your specifications.
Your Input: You are solely responsible for the text prompts and images you provide to the App ("Your Input"). You represent and warrant that you have the necessary rights and permissions to use and share Your Input with the App for image generation purposes.
Compliance with Laws: You agree to use the App in compliance with all applicable local, national, and international laws and regulations, including intellectual property and privacy laws.
Lawful Content: You agree not to create or attempt to create any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable. You may not generate images depicting violence, illegal activities, explicit sexual content, or content that infringes on the rights of others.
Image Upload Rights: When using the image-to-image feature, you warrant that you own the rights to any images you upload or have obtained proper permissions from the rights holders. You are solely responsible for ensuring you have the legal right to use and transform uploaded images.
No Misuse: You agree not to use the App for any purpose that is unlawful or prohibited by these Terms. You may not use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use and enjoyment of the App.
Your Input: You retain all rights in and to Your Input (the text prompts and images you provide).
Generated Images: Images generated by the App ("Generated Content") are provided to you for your personal use. You acknowledge that Generated Content is created through AI processing and may incorporate elements derived from the AI model's training data. While you may use Generated Content, you should be aware of potential limitations on commercial use depending on the underlying AI service terms.
Prohibited Uses of Generated Content: You may not use Generated Content to:
Create misleading, deceptive, or fraudulent content
Impersonate real individuals without consent
Violate any third-party intellectual property rights
Generate content for illegal purposes
App Ownership: The App itself, including its design, features, and underlying technology (excluding Your Input and Generated Content), is and will remain the exclusive property of Botart Yazılım ve ARGE AS and its licensors.
AI Limitations: You acknowledge that the App utilizes artificial intelligence, which may not always produce accurate, appropriate, or desired results. Generated images may contain errors, artifacts, biases, or unexpected elements. The quality and appropriateness of Generated Content cannot be guaranteed.
No Guarantees: We do not guarantee the accuracy, quality, or suitability of Generated Content or the App's functionality. The App is provided on an "AS IS" and "AS AVAILABLE" basis.
No Warranty: We make no warranties, express or implied, regarding the App or Generated Content, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Third-Party Services: The App relies on third-party AI services and other third-party services (such as RevenueCat, Firebase, Adjust, Meta SDKs). We are not responsible for the availability, accuracy, quality, or practices of these third-party services. Your use of the App is also subject to the terms and conditions and privacy policies of these third parties.
Content Moderation: While we implement content moderation measures, we cannot guarantee that all inappropriate or unwanted content will be prevented. You use the App at your own discretion and risk.
You agree not to use the App:
In any way that violates any applicable national, regional, federal, state, local or international law or regulation.
To generate content that exploits, harms, or attempts to exploit or harm minors in any way.
To generate content that infringes on intellectual property rights, including copyrights, trademarks, or publicity rights of others.
To create deepfakes or misleading content impersonating real individuals without proper authorization.
To generate content for spam, harassment, or malicious purposes.
To impersonate or attempt to impersonate Botart Yazılım ve ARGE AS, its employees, another user, or any other person or entity.
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the App, or which, as determined by us, may harm Botart Yazılım ve ARGE AS or users of the App or expose them to liability.
To attempt to reverse engineer, circumvent, or manipulate the App's content moderation or safety features.
We reserve the right to review, monitor, and remove any Generated Content or user account that violates these Terms. We may employ automated and manual content moderation systems. However, we are not obligated to monitor all content and cannot guarantee comprehensive content review.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.
In no event shall Botart Yazılım ve ARGE AS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from or generated by the App; (iv) unauthorized access, use, or alteration of your transmissions or content; and (v) any claims arising from Generated Content or your use thereof, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
These Terms shall be governed and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
The App is not intended for use by individuals under the age of 13. By using the App, you confirm that you are at least 13 years of age. If you are between 13 and 18 years of age, you must have parental or guardian consent to use the App.
