What you can use the music for, including monetized content.

You may use LWR Creator Music recordings as part of your own creative content, including:

• YouTube videos and other online videos

• Podcasts

• Films and other audiovisual projects

• Livestreams and streams

• Social media content

• Other similar creative projects

You may monetize your content. You do not owe LWR a licence fee simply because your content generates revenue.

This permission applies to the use of the music as part of your creative content. It does not transfer ownership of the recording or the underlying musical work to you.

Your use remains subject to all other provisions of these Terms, including the rules concerning Brand & Commercial Use and Recurring Creator Use.

Advertising, products, companies, promotional campaigns, etc.

LWR Creator Music is intended primarily for creator use. Using an LWR recording to advertise, promote, brand or sell a product, service, company, organization or commercial campaign is considered Brand & Commercial Use and may require a separate licence.

Examples include:

• Advertising and commercials

• Product or service promotion

• Corporate or company promotional videos

• Brand campaigns and branded content

• Commercial marketing or promotional materials

• Music used as part of a company's ongoing brand identity

Monetizing your own creator content does not, by itself, make it Brand & Commercial Use. However, if the music is being used to help sell, advertise or promote something, contact LWR before using the recording for that purpose.

LWR may authorize Brand & Commercial Use under a separate commercial or synchronization licence.

Podcasts, YouTube series, shows, themes, and other continuing uses.

Using an LWR Creator Music recording in a single video, podcast episode, stream or other individual piece of content is considered Creator Use. Using a recording as an ongoing or recurring part of a continuing production is considered Recurring Creator Use.

Examples include:

• A podcast theme or recurring intro/outro

• The theme music for a YouTube series or ongoing show

• Music regularly used in episodes of a continuing production

• Music that becomes permanently associated with a particular podcast, channel, show or production

Recurring Creator Use may require separate authorization from LWR. LWR may approve recurring use for a defined period, such as one year, and may renew, modify or decline that authorization.

LWR may also limit the number of productions using a particular recording as recurring music. This allows LWR to manage how its recordings become associated with ongoing productions and to protect the identity and future value of its catalogue.

Success does not automatically create a payment obligation. LWR may continue to authorize recurring use for free, renew it under different terms, negotiate a separate commercial or synchronization licence, or discontinue future authorization.

If you would like to make an LWR recording part of the continuing identity of your production, contact LWR before establishing that recurring use.

What credit is required and the suggested copy/paste format.

Credit is required whenever you use an LWR Creator Music recording.

Where reasonably possible, credit should be included in the video's, podcast's, project's or other content's description or accompanying credits.

For convenience, LWR provides the following suggested format:

When using a different LWR Creator Music recording, replace "CAPRICE" with the title of the recording being used.

Where a platform does not provide a practical way to include a full credit or link, provide the credit in the most appropriate available manner.

Linking to the LWR Creator Music page or the applicable recording page, where the platform allows it, is appreciated.

The purpose of attribution is simple: to identify the music and help listeners discover Low Wave Records Creator Music.

Free to use does not mean free to own.

LWR Creator Music gives you permission to use an LWR recording under these Terms. It does not transfer ownership of the recording or the underlying musical work to you.

Low Wave Records and/or the applicable rights holders retain all ownership and copyright interests in the music.

You may not:

• Claim an LWR recording as your own

• Register an LWR recording or musical work as your own copyright

• Sell, license, or redistribute an LWR recording as though you own it

• Grant another person or organization ownership or rights that you do not have

• Remove or alter information identifying the recording or its rights holders

• Misrepresent your relationship with Low Wave Records or imply that LWR has endorsed your content when it has not

Your permission is simply to use the music within the scope of the LWR Creator Music Terms of Service.

Free use is a permission to use the music—not a transfer of ownership.

What isn't permitted and what happens if the Terms are violated.

LWR Creator Music recordings may not be used in ways that violate these Terms or applicable law.

Prohibited uses include:

• Using the music for unlawful, fraudulent, defamatory or otherwise unlawful purposes

• Intentionally removing, falsifying or misrepresenting required attribution

• Claiming an LWR recording or musical work as your own

• Selling, licensing or redistributing the music as though you own it

• Circumventing these Terms or attempting to obtain rights that have not been granted

• Using the music in a way that falsely suggests endorsement, sponsorship or affiliation with Low Wave Records

If you violate these Terms, LWR may terminate your permission to use the recording and may take other action available to it under applicable law.

If permission is terminated, you must stop making new uses of the affected recording under the LWR Creator Music programme.

LWR may consider the nature and circumstances of a violation when deciding what action, if any, is appropriate.

LWR's ability to withdraw a recording or change or discontinue the programme.

LWR Creator Music is a catalogue made available at LWR's discretion. LWR reserves the right to modify, suspend or discontinue the programme, or to withdraw any recording from LWR Creator Music, at any time.

If a recording is withdrawn, LWR will generally stop granting new permissions to use that recording through the Creator Music programme.

A recording's availability is indicated by its listing on the LWR Creator Music page of the Low Wave Records website. If a recording is no longer listed among the available Creator Music recordings, it should be considered no longer available for new Creator Music use.

LWR may also maintain a Discontinued Tracks section identifying recordings that have been withdrawn from the programme.

Withdrawal does not automatically make a previously authorized use unauthorized. If you were using a recording in accordance with these Terms before it was withdrawn, your existing use will generally remain permitted under the Terms that applied when you began using it, unless LWR has expressly stated otherwise.

Where LWR has separately authorized Recurring Creator Use for a defined period, that authorization will normally remain in effect until its stated expiration, unless its specific terms provide otherwise.

LWR may withdraw a recording for any reason, including catalogue management, commercial considerations, rights issues, or changes to the Creator Music programme.

In plain English: LWR reserves the right to pull the plug.

How LWR can update the Terms and how changes apply.

LWR may update these Terms from time to time to reflect changes to the LWR Creator Music programme, its catalogue, licensing practices or other circumstances.

The current version of these Terms will be made available on the LWR Creator Music website, with the “Last updated” date shown at the top of the page.

Changes will apply to uses made after the updated Terms take effect. LWR will not normally apply new Terms retroactively to uses that were already authorized under an earlier version.

If a significant change affects an existing authorization, LWR may provide additional notice or specify how the change applies.

By continuing to download or use LWR Creator Music recordings after updated Terms take effect, you agree to the updated Terms.
